OLD BUSINESS: CONSIDERATIOPJ OF AWARpING BIO CONTRACT FOR•FIRE APPARATUS - 1250 GpM PUMPER TNBLED 6/16/80 : CONSIDERATION OF CHANGE ORD[R rl TO SPECIFICATION #FD 80-1: Mr. Robert Aldrich, Fire Chief, stated this item had been tabled at the June 16 Council meetiny, as the City was not familiar with the equipment made by the iow bidder and wished further informaiion. Upon a voice vote, all vating <ye,.Mayor fdee declared.ti7e motion carried unani- mously. _ i �'.. _.._._..... . _. .. __......_... 0 i J � i � � 181 REGL�LAR MEETING OF JULY 7, 1980 NEW BUSINESS: PAGE 3 CONSIDERATTON OF NEW PUBLIC NUISANCE QRUTNA[�CE: Mr. Faora, Public Works Director, stated, based on the Council's direction, a new publ�ic nuisance ardinance -is submitted for the Council's consideration. Mr. Flora stated the League of Cities and surroundinc� communities were contacted to rece9ve information regarding their nuisance ordinances and methods of enforce- ment. Ne stated, in the draft before the Council, nuisances were defined which effeci hQalth, safety, peace, safety and rrelfare. Mr. Flora stated this ordinance wouid repiace Chapter 110 of the exisiing City Code and although there is a slight duplication �in other ordinances, this ordinance provides a means of abatement and control. Mr. Herrick, City Attorney, felt this draft shouTd be s��bmitted to his office and Carl Newqu�st, as pub79c nuisance violations are difficult to prosecute. Mayor Nee questioned Item 16 on Page 3 of the draft ordinance, as he felt this didn't make sense. t4r. Flora stated the word "lawfut" sf�ould be changed to "unlawful". h10TI0N by Councilman Fitzpatrick to refer this draft ordinance to the City Attorney and to bring ii back to the Council for ihe first meeting in August, after the Attorney's revie�. Seconded by Councilwoman Moses. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mr. Qureshi poinied out, when an ordinance is adopted,.it puts some liability on the City to enforce it and 9f this is not done, the City is open for damages, Councilman Schneider stated many items in this ordinarice are presently in existing codes, howeuer, the scope has been broadened. Mayor Nee quest9oned if there are ar,y items in the ordinance tne Council �vasn't willir.g to enforce. - Counc;lman Fitzpatrick felt this would be the pu��pose of the review 6y the City Attorney. Mr. Herrick, City Attorney, felt there are two approaches to public nuisances, either to have a short gener•al statement or to go inte enumberating specific violations. He felt, if they go into specific violations, it should be ]ooked at very carefully. Mayor Nee also pointed out: that Section 110.06 covers the abatement of nuisance by the City Council, but the parac�raph goes on to make it an administrative abatement. Mr. Herrick stated he had some concern about a procedure where a City offic�al sends out a notice about a nuisance and gives a ceri:ain period of time to abate this nuisance. He stated, if it 9s not abated, and the City goes in and pro- ceeds with the abatement, but does not give that person any opportunity to ap- pear at a hearing to give their opinion or offer• evidence whether it is or is not a nuisance, and a suit is brough� against the City, ar�d the court do°sn't agree the person was given due process, the City could be liabie. He stated it is his recollection the present ordinance urovi�les an intermediate step of a public hearing where a person has an opportunity to come before the Council. CONSIDERATION OF PROPOSAL FOR RFGIS7RATI0�'� OF CONDOMINIUM �ONVERSIONS Mr. Flura, Public 4Jorks Director, stated questions have been raised regarding coridominium conversions such as converting existing rental property to condo- miniums, canverting a school to conc!ominiemis, and conversion of land for condo- miniums. CounciTman Fitzpatrick stated this applicant previ�usly applied for a variance, which was granted, to reduce•ihe area of the lot from 9,000 to 7,800 square feet which is already below the reyuirement for a sing]e family dwe7ling and he now wants to make this dwelling into a duplex. Mr. King, the applicant, state� the land to the South was sold,.however, he wasn't the sole owner of the property. He felt the codes of the City really don't apply themselves to a basement unit and d�es not look at this as a duplex. Counci]man.,Fitzpatrick stated he hesita.tgd.�to move for denial as he reaiizes Mr. King is surrounded by multiples, but felt this is a sub-standard lot and would be a sub-standard floor area and that the hardship was self-inflicted. He stated it was the intent of the Com�ission that this policy,be adopted by the Council, as written or amended, which would then give them some direction. Councilman Fitzpatrick referred to Item V, Capital Improver�ents and questioned the improvements on file with the Metropolitan Council which need no further approval. Mr. Qure:hi, City Manager, stated, basically, these improrements provide for a trail system and shelters. He pointed out the improvements on fiie with the Metropolitan Counci] do not include any buil.ding in Locke Park, but only the trait system. � Mr. Qureshi, City Manager, stated he felt this was a good agreement and ad- dresses all the concerns of the Park a.n�! Recreation Commission and Council. He pointed out any agreement entered into can be amended by the consent of both parties. Councilman Barnette questioned Item XI, Termination, with reference to main- taining the trail. He pofnted out, if the City terminates the agreement, the trai] shall be maintained by the City, however, there is no reference to main- taining the trail, if the agreement is terminated by ihe County. He fe]t this should be fncluded in the agreement or at least in a cor�munication to the County. Mr. Flora stated the Appeals Corrrnission has recommended approval af the variance to reduce the square footage and to temporarily waive the requirement for a garage which is not to be built until September, 1982. Mr. Qureshi, City Manager, pointed oui there would be a common driveway for the properties at 7109 and 7115 Ea.st River Road. Mr. Flora stated.the front setback for Lot 7, Mr. Torgrimson's property, is 47 feet and for Lot 8, hir. Mire's property, 41 feet. He pointed out the setbacks vary due to the curve in the road. Mr. Qureshi stated he would recommend ihat the driveway be paved up to 20 feet of the property east of ��:� ;•:�st line of the house so there is at least one parking space on the side of the house�of each property. Mr. Qureshi stated on Lot 8 an easement shouTd be given to the City for drainage. hir. hiunn stated this small trianguiar piece of property is owned by him, and is not part of Mr. Mire's lot, but he would give the necessary easement. . MOTION by Councilman Fitzpatrick to concur with the recommendation of the Appeals Commission a�d grant the variance to reduce the floor area from the required 1,020 square feet io £�4 square feet and to tempo- rarily waive the requirement for a garage until September, 1982, but with the stipuiation there be a paved portion of the driveway extending 20 feet beyond the front setback of the house. Councilwoman Moses voiced concern on whether Mr. Torgrimson and Mr. Mire were aware of the requirement for paving, and if they would have the funds from iheir loan tq cover this cost. Mr. Torgrimson stated FHA requires only a partial driveway or a path for parking. N� stated he went over his plans with the City Planner and this item wasn'i, brought to his attention. He stated the driveway issue was never discussed, however,.he felt it �•�as his responsibility to find out what �vas required and he will have to deal with this require- ment.. The requirement for payiny wouid not keep iiin� from moving into the house. Mr. Mire stated this requirement for the paving would not present a probTem with him. • Councilman Barnette questicned what the cost would be for the paving. Mr. htunn stated he would estimate the cost to be about $5�0. Mr. Herrick, City Attorney, felt ti�e applicants should be familiar with what is requ9red in the City Code. }fe stated the Appeals Ccrm- mission apparently feels there are hardsh4ps involved, but this hasn't been discussed. Ne pointed out this type of variance should be handled very carefully because it does set a precede�it. He stated standards have..been adopted, ho�vever, if.the:Commission and Coun�il fee� they are too strict, then they should be amenued. Mr. Herrick stated he was concerned with the variance being granted with the understanding that, in two years, the garage would t�e cnn- structed, since there may be a problem of enforcement. He stated reference was made to the fact that the reason these varfance requests by Mr. Torgrimson and Mr. Mire are before the Council was because adequate notice wasn't sent out. He asked if adjacent property own- ers were notified of the variance requPSts. Mr. Flora stated they were notified, however, noti�es to persons within the 500 foot radius went ta the wrong addresses. Mr. Herrick felt, if th� requirement for paving was to be waived, proper notice shouTd be given to the adjaceni property owners since this question was not addressed at the Appeals.t;ommission meeting. Mr. Qureshi reviewed the amaunts to be appropriated in the various areas of Legislative, City Management, Police, Fire, and Parks and Recreation. Councilwoman Moses asked what amount was received last year from revenue shariny funds: P1r. Erunsell, City Cl.erk, stated�about $230,600. Counci)woman Moses questioned if th�.State received any.revenue sharing funds or if this was just given to cities. Councilman Schneider pointed out, therefore, it would.be anywhere from six months to a year to have a re?oning that doesn't comform with the Gomprehensive Plan, since it would have to go through the amendment _ procedure which may, in fact, require Legislative action. 'Qureshi, Ci�y Manager MENtO FROt�1: John G� Flora, Public Works f}irector P+IEMO DATE: July 17, 1980 SUBJECT: Em?rgercy Repair - Well No. 8 Durirtg the evening of Sunday, July 6th, th� deep well pump of 'vJell #8 broke from its cor�trol rade On Monday morning, July 1th, primarily due to high temperatures and waier demar�ds placed on the City, we contacted Layne P�iinnesota, the c�mpany which is currently w�rkin� on repairing We17 No. 12, and r��quest�d �hey initiate action to r�trieve the pump and repair Well #8. � In contracting for the repair of Well #12, Layne Minnesota was the low bidder, and they guarantee us �he same prices for pulling, inspecting and repairing We17 #�. Accordingly, the emergency requ�st to them pro- vided us the lowest prices we had rzceiv�d for this type of work. Layne Nlinnesota has been H�orking o� att�mptin� to retrieve the pump since Monday, June 7th. During th�.t week, they were u�-ing a small cable rig and fr�ictiori type assembly in an att�m��t to withdraw tihe pump from the well ho�e. This pr�cedure did not accomplish any satis- factor,y resu�-cs. On �riday, July 11-ch, they. brcught in a large drill- ing rig and are using a mechanical device as a retrieval method. To date, th�y have r�ot b�en ab� � to wi thdraa�r i;ne pump frarn the wel l hol e. They are currently in the process ofi using campressed air to free the pump. If this does not work, the next procedure will be to pump sand fro�n the hole and attempt to free ihe pump. Cost for the first v�eek's effort was approximately $4,900. It is anti- cipated that the cost for this week's work will be slightly greater. Total cost to repair and reinstall the pump into Well #8 is unknown at this time. We will ree,uire an emergency Ordinance to cover the emergency actions taken to repair 6Je17 #8. There are suffic�ent funds in the Utility Rc- count to defray the costs. We have been able te satisfy the City's water demands during �he recent warm spell. This has necessitated op�rating all of our pumps the majority of each day. If �lell #8 was in operational condition, we wo�ld have be�n able to provide cooling and rest p�riods for the rema�ning wells.
