PLEDGE OF ALLEGIANCE: - Mayor Nee led the Council and audience in the Pledge of Allegiance to the Flag. RQLL CALL: MEMBERS PRESENT: Councilman Barnette. Councilman Schneider, Mayor Nee, Councilman Fitzpatrick,and Councilwoman Moses FffM6ER5 ABSENT: None PRESENTATION OF CERTIFICATE OF APPRECIATION: HARRY CASE, VOLUNTEER FIREFIGHTER: Mayor Nee stated a certificate of appreciation has been prepared for Mr. Harry Case, who has served the City for many years as a volunteer firefighter „ and now he is retiring from the department. He further stated Mr. Case was not able to be present this evening to receive this certificate and, therefore, requested this be forwarded to him. APPROVAL OF MINUTES: REGULAR MEETIN6, �UIY 20, 1981: MOTION by Councilman Barnette to approve the minutes as presented. Seconded by Councilwanan Moses. Upon a voice vote, all voting a�ye, Mayor Nee declared the motion carried unanimously. ADOPTION OF AGENDA: MOTION by Councilman Fitzpatrick to adopt the agenda as submitted. Seconded by Councilman Schneider. Mayor Nee stated there has been a request to consider a variance for the property at 7110 Riverview Terrace which has been before and acted on by the Appeals Comnission. MOTION by Councilman Fitzpatrick to amend the agenda by adding the above item: "Consideration of a Variance Request for the property at 7110 Riverview Terrace". Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. UPON A VOICE VOTE TAKEN ON THE MAIN M07ION, all voted a�ye, and Mayor Nee declared the motion carried unanimously. OPEN FORUM: Mr. George Doday, 630 Lafayette Street, appeared before the Council regarding an ordinance relating to the keeping of livestock, and asked if any changes could be made to the ordinance. Mr. Herrick, City Attorney. stated Mr. Doda�y had called him and had indicated the people living next door had a hutch or several hutches of rabbits which he felt was detrimental to the enjoyment of his property. Mr. Herrick stated Mr. Doday had raised the question that perhaps the ordinance relating to the keeping of livestock was outdated and probably shouldn't be allowed in the City. He stated he had advised Mr. Doday this would be a question for the Council to consider. ;n i� �. �, REGULAR MEETING OF AUfUST 3, 1981 PA6E 2 Mr. Herrick felt one question is if there is a violation of a permit which is causing a nuisance and the other question is whether the City wishes to permit livestock in the City in areas zoned R-1. _ Mayor Nee stated the Council has received a copy of a letter sent to Mrs. Olson from the Inspection Department and it appears they are not meeting the terms of the ordinance as it now stands, since a 30 foot separation from adjoining property is required and they have only 10 feet. Mr. Doday questioned if the Council had any intentions of changin� the ordinance. Mrs. Helen Doday stated they work hard to keep their property beautiful, but the farnily next door had rabbit hutches next to their bedroom window. She stated since they asked them to move the hutches, they have been harassed. Mrs. Doday stated she wouldn't care if they had the rabbits, as long as they didn't have the odor.. Mayor Nee stated an inspection was made of this property and the owners were asked to make some revisions regarding the handling of manure, etc., and if this doesn't solve the problem, the Council m�y have to take a look at the whole ordinance. Councilman Barnette questioned how the manure is disposed of when the hutches are cleaned. Mr. Dodaty stated it is th►rown about 20 feet from his kitchen windaw. Mr. Doday further stated they have had 7 windows brnken and the whoie thing started because they didn't want the rabbits under their window. Councilwoman Moses stated she had talked with Mr. Doday last week and felt he had made some very good points and is concerned and will check into it f u rthe r. Mr. 6ordon Fanberg, 8330 Broad Avenue, stated he has seen Mr. Doddy harassed by the Olson childern who ride bikes over his yard and call him names. He stated they also come into his yard with their bikes, plt�y their games in the street, and throw rocks at your car if you get in their way. Mayor Nee stated the Council would review the ordinance regarding the keeping of livestock and would do something about the kids ptdying in the street.. Mr. Herrick felt it might be appropriate to review this ordinance, as long as they are in the process of reviewing-the zoning ordinances, to determine if this is st'ill a valid.ordinance for the City. Mr. Qureshi, City Manager, stated they�can take action to correct any ordinance violations, however, the Council would have to consider whether they wish to continue or make any changes to the ordinance. Councilwoman Moses stated she wouldn't want this situation next door to her property and in that perspective, would like to take a look at the ordinance. Councilman Fitzpatrick stated, evidentally, the rabbits were kept closer than 30 feet fran the property line and asked if compliance with the ordinance was ever checked. Mr. Qureshi stated the owners do have an extra lot, but chose to keep the hutches closer to Mr. Doday's property. Councilman Schneider stated it seemed the whol� issue is if the ordinance should be on the books and, if it is permissible to keep livestock, how large the ar.ea should be before it is allowed. 2U9 REGULAR MEETING OF AU6UST 3, 1981 PAGE 3 Mr. Qureshi stated if the Council felt there should be a larger area required, this could be added into the ordinance. He pointed out this is the first complaint they have had on the ordinance. and it could be referred to the Planning Comnission for their recomnendation. Mayor Nee asked for a report at the next regular meeting�regarding the inspection and what has been accomplished. He further requested the Police Department be advised of the complaint regarding the children playing in the street, and the possibiiity of i�►lementing the crime watch program for this area. CONSIDERATION OF A VARIANCE �Y47 RE UESTED BY MR. 6 MRS. MAY FOR PRQPERTY LOCATED AT 7110 RIVERVIEW TERRACE BOARD OF APPEALS MINUTES Of JULY 14, 1981 : Mr. Qureshi, City Manager, stated the Board of Appeals has recomnended approval of this variance by a 3 to 1 vote, and the Planning Carmission has received the minutes of the Board of Appeals relating to this variance request. Mr. Flora, Public Works Director, stated the variance is for a porch, which is being constructed on the back of this property, to extend 2-1/2 feet into the 100 foot setback: Mr. Flora stated there was some discussion at the hearing before the Board of Appeals as one neighbor felt the variance would preclude her from viewing the river from her window. He stated the property owner to the South did not object to the variar.ce and, based on discussions, it was felt the porch extension really didn't affect the objecting owner's view. Mr. Bill May was present at the meeting and submitted a drawing of the proposed addition. Councilwoman Moses stated she understands Mr. May had the footings poured before he real ized there was a 100 foot setback requi red. Mr. May stated he had asked for the variance to be considered this evening because at the Board of Appeals meeting. Ms. 6abe1 stated the item would be before the Council this eveninq. He stated he had called the City Hal] this morriing and found it wasn't on the agenda, and had requested it be considered since it has been five weeks and he has not been able to work on the addition. MOTION by Councilman Fitzpatrick to concur with the recomnendation of the Board of Appeals and grant a variance of 2-1/2 feet into the 100 foot setback required for the property at 7110 Riverview Terrace, for the purpose of adding an enclosed porch. Seconded by Councilwoman Moses. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. NEW BUSINESS: 1 CONSIDERATION OF 1982 PRELIMINARY BUDGET INCLUDING REVENUE SHARING AND SETTING PUBLIC HEARING fi0R AUGUST 17, 1981: MOTION by Councilwoman Moses to receive the 1982 preliminary budget and set the public hearing for August 17, 1981. Seconded by Councilman Schneider. Upon a voice vote, all voting a�ye, Mayor Nee declared the motion carried unanimously. 2 COYSIDERATION OF WAIVIN6 THE fEE FOR A SI6N PERMIT FOR ANOKA COUNTY CETA CENTER RIVERWOOD CONP1UNITY CENTER 7150 E T RIVER ROAD : MOTION by Councilman Fitzpatrick to waive the permit fee for the Riverwood ComnuniLy Center sign. G1� REGULAR MEETING OF AUGUST 3, 1981 PAGE 4 c� RECEIVING BIDS AND ANARDING CONTRACT FQR 1981 C�NCRETE PAVEMENT AND CRACK SEALING •� � PROJECT BIDS OPENED 7 19 81 : � Mr. Flora, Public Works Director, stated bids for this project were opened on July 29 and 14 contractors had indicated an interest, with seven bids received ranging from $12,127 to �34,554. Mr. Flora stated Boda Construction was the low bidder with a bid of $12,127.50. He stated this was substantially lower than what was anticipated and would recortmend this bi.d be accepted and to authorize the addition of 25% to the project, for a total cosic of $15,159.38. I�tr. Flora stated since tfiis was such a favorable bid, they would like to extend the crack sealing project down Trollhagen Drive and this is the reason for the request to authorize a 25� increase to the project. Seconded by Councilman Schneider. upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 4 RECEIVIN6 BIDS AND AWARDING CONTRACT FOR MAINTENANCE ON 1.5 MILLION GAILON RESERVOIR BIOS OPENED 7 29 81 : Mr. Flora, Public Works Director, stated the bids for the maintenance on•the .. 1.5 million gallon reservior on Johnson Street were opened on July 29. He stated part of the project will ! include the placement of a sidewalk on the south section of the road between Osborne Road and Old Central Avenue. He stated the City currently has easements from University Avenue to, and including, the old Frosttop Drive-In Property, but have not been sucessful in obtaining an easement for the remaini�g portion of tlre sidewalk to Old Central Avenue. �12 RE6ULAR MEETING OF AUGUST 3, 1981 PAGE 6 Mr. Flora stated the resolution would call for the City Attorney to acquire the easements necessary for the sidewalk construction. Mr. Qureshi, City Manager, said it is hoped the property owners would give them the easement and they would not be assessed for this-easement cost. If they do not, however, then the City would acquire the easement and assess them the easement cost also. Mr. Herrick asked if the owners were agreeable to donate the easement for the sidewalk and, in turn, have an agreement they wouldn't be assessed for the sidewalk and the amount of land donated for a sidewalk be considered towards their space requirement when it comes to asking for a buildmg permit, if this would be agreeable as far as the Council is concerned. Mr. Qureshi stated if they give the easement, they would only be assessed their proportionate cost of the imptovement. Mr. Herrick stated he was not sure this would be agreeable. Mr. Herrick stated he wouldn't feel comfortable handling an eminent domain case because of his association wfth the property owner andfif these proceedings were necessary, he felt the matter should be turned over to his associate. During the platting and rezoning actions of the City Council, Gerald Paschke presented an over-all drainage plan encompassing Lots 1, 2, 3, 9 and 10, B1ock 3, that he was developing; and Mr. Harris presented the City Council with an agreement to individuaily handle storm water on all other parcels in the plat. Since construction was started by Gerald Paschke, a substantial amount of ground water in the area has required the original drainage plan to be nadi.fied. In order to accommodate the site, Mr. Harris has provided Lots 5 and 6, Block 4,to Mr. Paschke to develop for storm water detention for his parcels and all the remaining lots in the plat. This change accomplishes the City's original position for storm water con- trol within the University Industrial Park Plats as storm water considera- tion was an inherent. part of the plat and zoning, which approvals recom- mend the City Council receive the letter of agreement and approve the establishment of a central panding area for the University Industrial Park Plat. At the time this plat was approved, engineers for the developers and the city reached an agreement regarding storm water detention on individual lots. This approach was attempted on the property that is presently being developed by Gerald Paschke. '1'he results presented certain problems because of the high water table. Because of these problems, the developer and Mr. Paschke have agreed on an alternate solution. Mr. Paschke agreed with the developers to purchase Lots Five (5) and 5ix (6), Block Four (4), University lndustrial Park. A portion of these lots will be devoted to storm water detention for the entire University lndustrial Park Plat. It is my understanding that the consulting engineers and the engineers representing the city have agreed that a detention area of approximately Two and one-half (2�) acre feet will be adequate for this purpose. It is agreed by the parties that Mr. Paschke will construct this detention pond on the above property; the location of which will be at Mr. Paschke's discretion. WHEREAS, the City Clerk of the City of Fridley has reported that four candidates have filed with his office for election to the Office of Councilmember for the Third Ward. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the Charter of the City of Fridley (Chapter 4, Section 4.03), the Council hereby provides for and calls the Primary Election of the City of Fridley to be in the City of Fridiey on Tuesday, the 15th day of September 1981, at which election, electors of the City shall vote and cast a ballot with respect to the office of Councilmember for the Third Ward, and thereafter the two candidates receiving the highest number of votes for such office at such election, shall be deemed the candidates for the office to be voted upon at the regular forthcoming General Election to be held on November 3, 1981. QURESHI, CITY MANAGER FROM: SID INMAN, DIRECTOR OF CENTRAL SERVICES/CITY CLERK SUBJECT: ELECTION JUDGES DATE: AUGUST 13, 1981 We have increased the judges salary because the legislature passed a law requiring that election judges be paid the minimum wage. The increase for the regular judges is $.35 per hour, or a total of $3.35 per hour. Since the head judges were being paid $1.00 more than the regular judges, we also increased their wages by the same amount making their total hourly wage $4.35. Additionally, we lost our head judge in Ward 3, Precinct 2. Since the present judges in Ward 3, Precinct Z have not had enough experience or knowledge regarding election pro�edures or the counting center procedures to assume the head judge position, we will be taking a head judge from another precinct to act as the head judge.
