PIJBLIC HEARIiIGS: THE CITY MAWAGE MayorfVee stated the City ho7ds a hearing, which is bas�cally an admim strative hear�ng,concerm ng the allocation of Revenue Sharing Funds for 1982. He then requested the City P1anager to present the fi gures the Ciiy anticipates they will recieve and how these funds will be allocated. The administrative hearing concerning the expenditure of Revenue Sharing Funds for 1982 was then opened at 7.37 p. in. i�1r. Qureshi, City Manager, stated the amount of Revenue Sharing Funds expected for 1932 is �255,000 and it is proposed to allocate Lhese funds in the following areas: provide financial assistance to community service organizations; improved energy awareness and conservation program, improved communication channels w�th the public, �mproved crime prevention and apprehension of criminals; and better fire suppression and for partial cost of some f�re equipment. Mr. Qureshi stated, in the areas of parks and recreation, funds will be used for community nature interpretation, improving environmental aesthetics of public lands; improving culture and arts; improv�ng services to sem or citizens and teens; and for the annual community clelbration. h1r. Lorbesk�, representing the Senior Citizens, questioned how much was allocated for Senior Citizens, h1r. Quresht stated $10,400 is allocated fo�r sen�or citizens anQ teens for personnel services �nd $6,250 for other expenses, for a total of $16,650. May�r Nee pointed out that most of the programs would also have contributions from the General Fund, and whether the Senior Citizens would have addit�onal funds bec�omes part of the budgetinq process the City goes through in August and September. Mr. Lorbeski pointed out if the Senior Citizens are looking for a drop-in center this would hardly be enough for heat and lights for one year. Mr. Qureshi stated the funds proposed from Revenue Sharing are to susta�n �he programs they already have, and if these funds are not forthcoming, a decision wtll have to be made if the City wants to draw from other funds or discontinue the program. � ' , � I � � � � I� � P � � PUBLIC HEARIYG MEETING OF JULY 1�, 1981 PAGE 2 Mr. Lorbeski stated he understood that Blaine and Coon Rapids received funds for the Senior C�tizens in their corrrmunities. Mr. QureshT explained those funds were received under block grant programs, and not Revenue Sharing. F1r. Lorbeski stated the Counctl has suggested the Senior C�tizens appear before the School Board regarding their proposal for space at Parkview School, and he stated they would try and do this within the next month. Mayor Nee suggested any requests or pro�osal�, to ti�e Council sbculd 6� s���bmitted i� time t� be considered in con�u���aon with the,L�udget hearings �ouncilman Barnette pointed out that 36% of the revenue sharing funds are allocated to nature interpretation programs and he felt it was a lot of money for that one program. He stated $121,000 was �ust allocated to the nature center from the NSP easement and the Sentor Citizens are asking for a much smaller amount and requested the �ustif�cation for the proposed expenditure. Mr. Qureshi stated this is, bas�ically, the trend followed in the previous years and funding for the Naturalist has beer through Revenue Shartng Funds. He pointed out they previously had one Naturalist and �emparary help, and now have two full-time staff persons and also have larger facil�ties to matntain which accounts for the increase in expenses PJo other persons in the aud�ence spoke regarding the proposed allocation of these Revenue Shar�ng Funds. P�tOTION by Councilwoman �4oses to close the public hearing regarding expenditure of Revenue Sharing Funds for 1982. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carr�ed unanimously and the pu6lic hearing closed at 8 p. m I� e Mayor tdee stated the City P1anager felt the Council had as much innut as possible from the previous meetings regarding the proposed ame;�dments to the Zoning CGde, and if there were no further comments of discussion, h� would call for a motion to close the publie hearing. MOTION by Councilman Fitzpatr�ck to close the public hearing on the amendments to the Zoning Code. Seconded 6y Councilman Schneider. Upon a voice vote, a17 voting aye, Mayor Nee declared,the motion carried unanimously and the public hearing closed at 8:03 p. m. hiayor Nee stated two ordinances are before the Council for th^-�r consideration, one to amend Chapter 205 of the C�ty Code concerning double bungalows in the R-T Zone by deleting Sections 205.051-3D and 205.054-2C and the other ordinance �s to amend Chapter 2-5 of the City Code concerning apartments in the R-1 Zone by adding Paragraph 205.051,5. Upon a voice vote, Counc�lman Schneider, Councilman Barnette, Counc�lman Fitzpatrick, and Mayor itlee voted in favor of the motion, Councilwoman Moses voted against the motion. P•layor Nee declared the motion carried by a 4 to 1 vote. The Council then cons�dered the first reading of an ordinance amending Chapter 2D5 of the Fridley City Code concerning apartments in the R-1 zone by addin9 paragraph 205.051,5. Playor flee stated he has come to the conclusion from past discussions, that it is doubtful whether this ordinance can be worked out to the satisfaction of all the Council members. He felt a vote taken thts evening would probably mean defeat, therefore, he requested a motion to table this item. Mr. Herrick, City Attorney, stated the City does ]icense multi-residential units and does have an inspection k,oFbr�a they are permitted to be rented, which �s substantially the same as a cert�ficate of occupancy, h1r, Qureshi, City Manager, suggested words " single family" could be inserted under Section 206.D5, Item 1, line 1. Mr. Herrick, City Attorney, stated this language was taken from the State statute and pointed out the Council deteri,nnes the conditions of denial after a hearing. , Mr. Herrick suggested under Section 217.02, Item 4, to eliminate the last two words, "or otherw�se". He also suggested under Section 217.04, the last sentence be changed by eliminating the word "of" in the second to the last line, and substituttng the words, "from obtaining", The last sentence would then read as follows: "This sect�on does not exempt the owner from obtaaining th2 annual multiple dwelling license as set forth in Chapter 220'of the Fr�dley City Code" � � s � � [, M9TION by Counctlwoman Moses to waive the reading and approve the ordinance upon first reading. VAN DAN REGARDING vEHICLES ON fiIS PROPERTY: Mr. Van Dan, 6342 Baker Avenue, appeared 6efore the Gounc�l regarding vehicles on his property. He febt the ordinance re9arding ,7unk and inoperable vehicles should be a6olished as it is being used as a tool for harassment by his neighbor. Pir. Van Dan stated he received a letter from the City Inspectton Department re9arding vehicles stored on his pro�erty. Mr. Van Dan was asked if the vehicles cited have valid license plates and he stated they are all licensed except for the one classic car. Counctlman Schne�der asked Mr. Van Dan if he �ntentionally did not abide by the ordinance. Mr. Van Dan stated when he didn't haveithe money to buy plates, he left the vehicles parked in his drive, and bought them when he could. Mayor Nee stated he can sympathize with hrs problem since he has the same situation with a car he owns, but keeps it licensed to comply w�th the ordinance. He pointed out there are some cars that are ,7unkers so staff has asked for something that was easy to define and describe a,7unker. � �� PUBLIC HEARING MEETING OF JULY 13, 1981 PAGE 5 Mr. Van Dan stated there is a difference between a �unker and a classic Mr. Herrick, City Attorney, stated you can purchase a license for a classic car. Mr. Van Dan stated once you obtain collector's plates, you cannot get a regular license to operate the veh�cle. He explained, in his situation, he wants to fix the car so tt can be driven on the streets and highways, and because parts are not available, he will have to make them which will tnvolve some time before �t is operable. Councilman Barnette stated the Council but right now the inspector is abiding complaints when they are received. should probably look at some changes, by the ordinance and investigating Mayor Nee stated what the City is trying to do is descr�be an actual ,7unker and not intending to relate to th�s classic car. Mr. Herrick, City Attorney, stated tf it ts done this way that the vehicle must be licensed, it makes far easier interpretation by the Inspection Department since they may not b� an expert on collector cars or classics. He pointed out what an owner may consider a classic, his ne�ghbor may consider a �unker. Mr. Van Dan felt perhaps when that particular netghbor files a complaint, they should call 'nim in and find out what is his problem, Mayor Nee advised Mr. Van Dan he could solve the problem by keeping a l�cense on the vehicle. Mr. Uan Dan thanked the Council for their time and patience, 6ut felt they were condoning the misuse of the ordinance and City time. � RECEIVING THE CAQLE TELEVISIOP! Councilman Schneider stated in reference to his contacting the owner of Rice Creek Townhouses, he has tried, but has been unable to contact him. RECEIVING COP4MUNICATION FROM FOURMIES, FRANCE REGARDING CONTRACT OF FRIE�JDSHIP: 14ayor Nee stated he Urill be visting Fourmies, France in early September and requested the Council consider approval of this contract of friendship. P10TION by Councilman Schneider to authorize the Mayor to execute the contract of friendship between the City of Fridley and Fourmies, France. Seconded by Counc�lman Fitzpatr�ck. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mayor Nee requested an excerpt of this motion for him to take to Fourmies, France. It was also suggested that staff contact Medtronics to advise them of this contract and the Mayor's planned tr�p. IDERATIO�! OF AN AGREEMENT OF CDOPERATION BETWEEN THE HRA AND nrrii rv _ Counc�lman Fitzpatrick stated the proposal submitted to the Council showed they could pay for this pro,7ect wtth tax increment financing and questioned why tiiey ar,e using block grant funds. 1 � 1 � � 1 PUBLIC HEARIfdG MEETIPdG OF JULY 13, 1981 PAGE 6 Mr. Qureshi, Ctty Manager, explatned certa�n crtteria had to be met for these block grant funds and this pro�ect met these standards because it provides services to lav and moderate income groups. Councilman Fitzpatrick questioned on what the �280,000 in block grant funds would b� spent. ;��•, Qureshi stated it would be used for acquisition of property in the tax �ncrement district for purposes of redeve7opment. He stated ntis hoped, if there ts a full development, it will bring a lot more tax revenue than what they would be spending. Councilman Fitzpatrick stated that evtdently considerations went into this that he wasn't aware of, but he had no ob�ectton to using money tn this way. He stated, however, commurity development block grant funds could be used for things that come up where there are no other funds avail�ble. MOTION by Councilman Fitzpatrick to authorize the HRA to disperse these funds from the comnunity development blook grant program. Seconded by Councilwoman Moses. Mayor Nee questioned �f there was a way these funds could be returned to the City at a future date, when it becomes economically viable. Mr. Qureshi stated he would suggest this item be tabled until they could check into the matter further. MOTION by Councilwoman Moses to table this item for further research by staff. COPdSIDERATION OF CHANGE ORDER N0. 1 FOR MISC EOUS CONCRETE CURB AND Mr. Flora, Public Works Director, stated the concrete slab reconstruction at the intersection of East and West Danube Roads utilized the, ma�ority of the � original contract of $47,757.50 and there still remainsconcrete curb work to be accomplished this year He requested, therefore, the Council consider -- approval of change order No. 1 to the original contract to allow this work to be completed. � MOTION 6y Councilwoman Moses to approve Change Order No. 1 with Halvorson Construction for miscellaneous concrete curb and slab�construction in the amount of �11,925.00, which changes the original contract price from $47,757.50 to a revised contract price of $50,682.50. Mr. Flord� Public Works D�rector, stated he has been in contact with the two property owners involved, Mr. Brickner and P1r. Skinner. Mr. Flora further stated, as of this morning, P1r. Skinner has decided he doesn't want to develop his property, therefore, Mr. Brickneru�ill come to the Council at the next meetiny to present an ad,7ust:�ient to the plat to inove the right-of way of the northern street one foot into the plat. Flora stated P1r. Brickner desires the Ctty to put in the sewer and water tmprovements this fall and to accomplish the street �mprovements next year. Councilman Barnette asked if Mr. Skinner wanted to develop his property several years from now how he would proceed. Mr. Fiora stated he wouid have to purchase some property from Mr. Brickner for access. �1r. Herr�ck, City Attorney, stated the City does have some alternatives. They can put in the improvements, as shown, and make the assessment or could make the assessment against both properties, Mr. Brickner's and Mr. Skiriner's, and defer the assessment on the northern portion. He pointed out the Council doesn't need lOD% petition to put tn a Ctty street and if the right-of-way for the northern street was moved one foot 7nto the plat, it may cause sorne pro6lems in the future for Mr. Skinner's property, as far as the access. Councilman Fitzpatrick asked if it wasn't possible the northern portion m�ght be platted without access from this proposed st reet , to which Mr. Flora stated itwas possible. Mr. Herrick felt the Public Works pepartment should give some thought on what kind of road system they want in that area. f�r. Quresh�, City �4anager, stated they wo��ld recommend the Council consider adoption of the above two resolut�ons and seti the hearing for the improvements and have a choice on,l�ow the assessments are spread at the time of the assessment hear�ng. RESOLUTION NO RESEALING -1981 �RDERING I APPROVAL OF PL,M�S AND SPECIFICATIONS Mr Flora, Public Works Director, stated the City has developed a three year plan for resealing the ,7oints on the concrete streets in the City, and requested Council consider adoption of this resolution to advertise for bids for this pro,7ect. Upon a voice vote, all voting aye, pqayor Nee declared the motton carried unanimously. ��' RESOLUTION iV0 72-1981 ORDERING IMPROVEMENT, APPROVAL OF PLANS AN� SPECIFICATIOPJS Mr. Flora, Public Works Director, stated the storage reservoir located on Johnson Street has a number of exterior cracks requir�ng repair and the tank needs a new coat of paint, and requested Council consider adoption of this resolution to advertise for bids for this pro,7ect. Upon a voice vote, all voting aye, Mayor Nee declared the motion ca1°ried unanimously. , PUBLIC HEARING MEETING OF JULY 13, 1981 Senator pon Frank: PAGE B Senator pon Frank appeared before the Council to answer any questions the Council may have regardin9 the past Legislative session. Senator Frank reviewed the actions taken by the Legislature to help solve the State's deficit. He further stated there is a proposal that all yoverninents be on the same fiscal year as the State, however, he was sure enough warning would be given so local governments could prepare for this � change. Sneator Frank stated the Legislature has begun work on re-appointment and it is the concensus of both houses that they will try to get some bill for the next session. P1r. Qureshi questioned if local aid to cities would be given on the same level as last year. Senator Frank stated, as he recalls, this would be the case, but obviously that is a shortfall because of the inflation. He stated the cost of local services and education is gradually being shifted again to lecal governments and, obviously, the only recourse local government has is to raise the property taxes. Mr. Qureshi, City Manager, pointed out certain cities are actually being penalized for being p�rudent and cost efficient. He further pointed out �he State has put a mandate on Local governments as to how much they can raise taxes. Senator Frank stated he would agree there �s an inequity in this area, however, he felt the coming year will 6e much tougher than what the State �ust went through because they still haven't addressed the total problems, Mayor Nee stated in regard to condominium conversions, the State Legislature has taken away the City's descretion in regulattng. He stated he has asked � the Ci,ty Attorney to draft a proposed amendment to tha condominum statute that would recover the City's power to regular convers�ons. Senator Frank suggested a model ordinance be drafted and per{iaps a bill could be drawn and drafted to cover the City's concerns. Senator Frank also stated, during this last session, the tax on rental property has been reduced by three to four percent. He stated he had many calls from rental owners who stated they cannot afford to keep rental property because of the taxes. He felt the Legislature will have to address this issue further because of the dtfferences in taxes between rental and non-rental property. Senator Frank questioned the completton of the East River Road pro�ect. Councilman Fitzpatrick felt there should be provisions made so that pedestrians could cross the street safely. Mr. Flora, Public Works Director, stated when the widening began, one signal was removed and the one light left tsinoperative. He stated they cannot install new signals until the lanes are completed but he is trying to work with the County for a solution before school begins. Senator Frank stated the Department of Transportation is very close in deciding what route will be taken for the fJorthtown Bridge. Rir. Qureshi stated the C�ty doesn't wish a south exit onto East River Road. Senator Frank stated Representative Simoneau made this point quite explicit in � the nieet�ngs, but he would rather doubt that they would allow cuttin9 off of any access to the bridge. Mayor Nee extended the Council's thanks to Senator Frank for appearing at the meeting and providtng this information.
