'Aa.thori:ty X The City Council discussed the Phase II office project at their March 29, 1982 conference meeting. They discussed the options that they have in regard to the use of City property for this development. (See attached memo dated March 26, 1982). The City Council concurred with the Phase II project and is requesting that the HRA take the following steps when final commitment is given by the office partnership. 1. That the HRA purchase that property owned by the City on which the building is located at a value consistent with the area (9,310 sq. ft. @ $2.00 per sq. ft. - $18,620.00.) 2. That the HRA purchase that property associated with the required parking for the office buildin at a value consistent with the area (30,100 sq. ft. @$2.00 per sq. ft. _�60,200.00). This purchase will be conditioned with the lease as being proposed by the office building and will extend to the termination of the Redevelopment District (Maximum date of November, 2009). At that time the HRA would deed the property back to the City Council for $1.00. ihe Council would then continue the lease for the term of the lease contract. This would mean that the HRA would have an initial expenditure of approximately $78,800.00 and would in return receive lease payments on the parking in the amount of $800.00 per month for the life of the district. In the Center City district, the Columbia Park Clinic and Office projects are very close to final contract commitment with the HRA. We expect to make these commitments by April 8, 1982. There are several issues that have to be discussed with the City Council relative to these projects so that the HRA can have a good understanding by that meeting. CITY PROPERTY The proposed projects that are being developed would require the use of some of the City's property around City Hall. The options that are available to the HRA are as follows: ' � The office project as proposed will acquire approximately 10,000 sq.ft. of land from the City for the building location. This:. property will be deeded to the office structure and paid over a ten year period. The parking will be a joil1t parking arrange- ment with the City Hall by which the office will lease parking for 31 years with option of purchase after that period. These terms have been reviewed by the HRA who have given tentative approval based on discussion with the City Council. The options as we see them are as follows: 1. The HRA will purchase the land under the building (10,000 sq. ft.) directly from the City at $2.00 per sq. ft. so it can be deeded to the office building, with the following parking options: A. The HRA purchase that portion of property to be used for parking by the : the office and r10 the necessary improvements. They will then lease that parking to the office for the full term of the mortgage (31 years), at which time it would sellthe property to the office for a set purchase price. B. The City retain the property and to the parking lot improvements and lease the paricing for 31 years at which time it would sell the property to the office for a set purchase price. C. The HRA would purchase the property from the City, would do the necessary improvements and would lease the parking for the life of the Center City . After 31 years the office would purchase the property for a set purchase price 2. The City would sell the property under the office directly to the office developer, with the payment over ten years as stated above with the options on parking as noted above. ' EISENHOWER SQUARE MONUMENT We have discussed this item briefly with the V.F.W. who are willing to work with us in the relocation of the monument. We have been looking at the following options and would like some direction from the Council. 1. Locating the monument in a spec.ial area in Commons Park or the Community Park. 2. FROM CITY Fridley's Charter appears to deal with the sale of real estate by the city and therefore govern this situation. But research of this question has located a Minnesota Statute which appears to be directly on point. Minnesota Statute 465.035 states that, "Any county, town, city, or other public corporation may lease or convey its lands for a nominal consideration, without consideration or for such consideratioa as may be agreed upon to the state or to any govermnent subdivision...another public corporation...for public use when authorized by its governing body." This statute has been interpreted as providing authority for a city to convey property owned in fee simple to a local redevelopment agency for the purpose of redevelopment. Op. Atty. Gen. 471-f, March 20, 1963. It is my opinion that the specific grant of power given by this statute overrules the City's charter provision and allows the sale of land to the H.R.A. in accordance with the statute. Therefore, it is not necessary to comply with Fridley's Charter to accomplish this sale. ACTIONI INFO• The Major items remaining are the construction of the BASFU and culvert mouth dredging. ' The biological soil filtration unit (BASFU) is the detention pond and marsh filter,originally planned for the area behind the homes along Lynde Drive. Two alternate sites were addressed, but have been eliminated from considera- tion. The proposal now is to construct the BASFU in the original location conforming to the amount of easement available, plus the purchase of those portions of the lots fronting Polk Street, within the amount of funds avail- abie. When I receive the plans for this work, we will be ab]e io delineate the land requirements and attempt to schedule a starting date. The dredging of the silt by the abandoned culverts is temporarily deferred until a decision has been made on Phase II of the East Moore Lake Restora- tion Project (removal of approximately one foot of material from the entire bottom and replacement with plastic screen and sand). As backup information, you may recall that we developed several pond-filtration unit alternatives at the original Iwen Terrace Additions. The various alternatives were developed in conjunction with a proposed apartment complex located south of the Iwen Terrace Addition. A11 of the alternatives were "shelved" because the apartment complex died. The intent of the pond-soil filtration unit was to integrate the pond necessary for the biological soil filtration unit with the storage pond that would be required if the apartment complex were constructed. In view of the uncertainty of the apartment complex we turned our attention to alternative sites. Two sites were selected as potential sites. One site was located in the ditch south of the 76 Station between Polk Street and the service drive. This site was eliminated because it was of inadequate size and the fact that the existing 42 inch storm sewer on Lynde Urive would need to be rerouted north on Polk Street and westward to the ditch. In addition, piping would be needed from the ditch westward to the existing 36 inch storm sewer on the service drive. The other alternative site was located in the triangular area bounded by Nighway 65 and Central Avenue, south of Moore Lake. This site was eliminated because of inadequate size and the fact that a soil filtration unit would not esthetically fit the surrounding area. It appears that the original site (Iwen Terrace Addition) is the site of choice and we are recommending that work proceed on the biological soil filtration unit at this time. A small lift station is required in order to transfer water from the retention pond to the proposed grassland marsh. The retention pond will be designed on the basis of a five-year storm thereby reducing its size. Excess water, representing a storm of more than five year duration, will be diverted inta the existing storm sewer on Polk Street. If in the future the apartment complex is initiated, the developer will need to blend the apartment complex pond into our pond. This should not present any problems. - Unless we hear otherwise we will proced with preliminary plans and specifications for this project. Hickok and Associates presented an outline for the Phase II restoratian activities for the east basin of Moore Lake. Phase II consists of an application for Federal funds from the Clear Lakes Grant Program to remove approximately one foot of bottom sediment from the east basin of Moore Lake; in order to eliminate�the aquatic growth and-result--- - ing phospherous input and then placing plastic screen and sand cover over the entire bottom to preclude future aquatic growth. The current estimates for Phospherous removal after completion of all of the Phase I work, is 21�. The Phase II project should result in a 75� to 84� reduction. This work is currently estimated at $556,8U0. The Federal funds • would cover 50� of the costs. State matching funds are not considered available at this time. I have been informed that the project has been accepted for funding. According- ly, the City will have to determine if they want to complete this project and pay for the 50% portion remaining, or $278,400. Recommend the City Council de- termine which action to take on this project, so when the formal notice is pre- sented to the City, we can accept or deny it at that time. Approval of the Phase II work plan results in a fifty percent (50�) grant from the USEPA which translates into $278,400. The remaining 50� ($278,400) will need to be funded by the City of Fridley in as much as the legislature has not passed a matching fiund bill. This may change, however, it appears very unlikely in vi ew of the fi nanci al stabi 1 i ty of the State of Mi nnesota. I would appreciate your bringing the Phase II work to the attention of the Council so that we may have some input to INr. Tom Sinn during our Tuesday, April 27, 1982 scheduled meeting.
