Mr. Flora, Public Works Director, stated this lot is the last lot on
Jackson Street and is a deac�end street with a cul-de-sac. He stated the
petitioner is requesting a special use permit for construction of a second
garage.
Mr. Flora stated the original plan was for the petitioner to convert the
existing garage into living space, however, he now requests the use of
both garages for storage purposes.
Mr. Flora stated the Planning Camnission has recommended aproval of this
special use per�it to allow the construction of a second accessory
builaing.
MO'i'ION by Counclman Schneider to concur with the recommendation of the
Planning Camnission and grant special use permit, SP #82-08 to allow for
the construction of a second accessory building at 6271 Jackson Street.
Seconded by Councilman Barnette. Upon a voice v�ote, all wting aye, Mayor
Nee declared the motion carried unanimously.
Mr. Flora stated, in conjunction with approval of the request for a
special use permit, a variance is requested to reduce the front yard
setback from �he required 35 feet to ll feet.
MOTION by Concilman Schneider to concur with the recommendation of the
Appeals Canmission ar�l grant the variance to reduce the front yard setback
fram the required 35 feet to 11 feet. Seconded by Councilman Barnette.
Upon a voice wte, all voting aye, Mayor Nee declared the motion carried
unanimously.

MOTION by Councilman Hamernik to set the public hearing on this vacation
request for August 16, 1982. Seconded by Councilman Schneider.
A gentleman representing S& R Investment Company stated the variance
doesn't really have anything to do with the building permit. He stated
their plan was to have attached garages, which would have been on part of
the setback, lwt then the City c7ecided they would rather have tuck-under
garages. Ae stated they have changed the plan and will have tuck-under
garages and, therefore, wouldn't be on gart of the setback.
Mr. Flora, Public Works Director, stated a portion of the parking Zot
w�ould be on the property requested to be vacated, therefore, it would be
associated with the bvilding permit.
Mayor Nee stated, if this is the case, they can't preempt this vacation
proceeding. Upon a voice vote on the above motion, all voting aye, Mayor
- Nee declard the motion carried unanimously.

Mr. Flora, Public Works Director, statecl this is a request to reduce the
side yard setback for an attached garage fromthe required five feet to
three feet to allaw the construction of a 22 x 38 foot attachec7 garage at
5312 Altura Road N. E.
Mr. Flora stated, during discussions, it was found there was too much
square footage on the property and, �herefore, the petitioner will remove
part of the existing garage, leaving a 12 x 14 foot storage shed for the
property.
Mr. Flora stated one neighbor objectec] to this variance, as she felt the
roof w�ould be too close to the property line, and result in a devaluation
of her property.
Mr. Flora stated the Appeals Canmission has recommended approval of the
variance with the stipulation that the north wall be a firewall with 5/8
inch type x gypsu�n board and any windows on the north wall be fire safe
steel mesh.
Councilman Fitzpatrick stated the Appeals Commission unanimously
recaranenc7ed approval. of this variance in spite of the objection of the
affected neighbor. He pointec3 out the varianoe is only for two feet and is
prepared to reca�mlendation.
Councilman Fitzpatrick stated he believed the person who objected, and the
petitioner, were both present his evening.
Mrs. Harold Anderson, 5342 Altura Road, stated she felt the roof lines
w�uld be too close together. She furthec stated there would be a problem
with the snaw and a lot of moisture i.n the bas�nent.
Mr. Fora stated the plans indicate a roof averhang of 18 inches beyond the
wall.
Mr. Rishish stated the roof line follaws the existing line so he felt any
_snaw would either go forward or back and wouldn't build up between the
houses.
Councilman Barnette asked Mrs. Anderson if she had problens with drainage.
Mrs. Anclerson stated she had not, but guessed others had problems, and was
sure the houses would be too close and would cause water in the basesnent.
Councilman Barnette stated he felt the drainage could be taken care of so
water wouldn't drain tawards Mrs. Ancierson's house.
Mr. Rishish stated the natural drainage pattern now tends to be to the
back of the lot.
Mr. Nee stated, overall, this looks like a good improvement and this
addition could be built, without a variance, if it was two feet shorter.
Mrs. Anderson stated she was aware of this, but two feet was two feet.
She stated she felt the improvement was an advantage for Mr. Rishish, but
not for them.

Councilman Fitzpatrick stated he can sympathize with Mrs. Anderson's
objection to having this building close to the property line, however, he
w�azld have to ooncur with the reconmendation of the Appc�als Catmission.
MOTION by Council.�aan Fitzpatrick to concur with the recommendation of the

Counclman Barnette stated he grew up in Minneapolis where the houses were
close together and doesn't reme�nber any problems with drainage.
Mrs. Anderson stated the averhang would be right on top of her fence. Mr.
Flora stated the o�verhang will be 1-1/2 feet inside the property line.
Councilman Schneider asked if Mr. Rishish's contraetor indicated any
- problem with the fence, and Mr. Rishish stated he hadn't noted any
problems.
Councilman Hamernik suggested possibly adding a stipulation that this
addition wouldn't disrupt any cirainage flow that is currently existing.
Mr. Rishish stated this would be satisfactory if they can establish what
is currently existing. He stated he has riever seen water cane to the back
of his house.
Councilman Barnette asked if he ever had water in his basement. Mr.
Rishish stated he has because aE a cracked foundation, which he hopes to
correct, but there was no water in the basement because of the manner in
which the water drains.

Mr. Qureshi, City Manager, stated the development agreement provided by
the Darrel Farr Corporation indicates they had a mortgage co�ranitment prior
to the effective date of the City's ordinance regarding a moratorium on
condaninium vonversions.
Mr. Qureshi stated the staff, with the help of Councilman Schneider,
w�orked with the Farr Corporation to work out certain oonditions which gave
additional consideration to the existing renters.
Councilman Schneider stated that State law on condominium conversions
preempts the City's authority and, as the development agreesnent indicates,
Farr Corporation had obtained a mortgage comnitment prior to the effective
date of the City's ordinance.

Cour►cilman Schneider stated he felt the conditions worked out with the
Farr Corporation have minimized the �civerse effects of this coriversion for
the t�enants. fle stated Farr Corporation is willi.ng to enter into a formal
legal agreesnent to assure these oonditions.
MO't'ION by Councilman Schneider to authorize the City administration to
enter into the development agreement with Darrel Farr Corporation.
Seconded by Councilman Barnette. i�On a voice vote, all voting aye, Mayor
Nee declared the iroton carried unanimously.
Mayor Nee stated he felt both the staff and the Farr Corporation deserve
same oongratulations for working out these conditions to accommodate the
tenants. A representative from Farr Corporation stated they will make
every effort for a canfortable transisition for the tenants.

MOTION by Councilman Barnette to receive the bond bids. Seconded by
Councilman Schneider.
Mr. Ehlers of Ehlers and Associates, Inc. stated the index has gone down
fran mid-November of 1981 so it is naw a favorable market for these bonds.
Mr. Ehlers stated the bids were opened this afternoon, with Mr. Inman,
City Clerk, and Mr. Boardman, City Planner present, and five bids were
received, as listec3 on the bid swnnary sheet.
Mr. Ehlers stated he wishec3 to oamiend the City Council and staff for the
remarkable job of management which results in Fridley having a AA-1 bond
rating.
Mr. Ehlers stated the best bid is from Northern Trust Company at an
interest rate of 10.366$. Ae stated this is less than the 12$ they had
anticipated. Mr. Ehlers stated he thought the bids were very competitive,
�a Wouia recarmend the Council accept the bid of Northern Trust Canpany.
Mr. Ehlers stated one bid was st�bmittec� for both issues, the tax increment
redevelopment bonds and the special assessment fund bonds, but the
resolutions are setup for two separate awards.

CABLE TELEVISION RE�'RANQiISIl�1G:
Mayor Nee stated the C,able Television Camnission recamnended the formation
of a negotiating a�nunittee oanprising two members of the Cable Television
CaRUnission, two n�embers of the Council, or� menber of staff, and the legal
counsel to the Cable Canunission.
Mayor Nee stated the Cable �elevision Ca�miission reccmmended the Chairman
and Vice Chairman of their body serve on this cm�mittee, however, Mr.
Peterson has declined, as he feels he is not able to put in the time, and
Mr. Weaver is uncertain. Mayor Nee stated there are three other members
of the Camnission who could be considered to serve on the committee, and
it was the concensus of the Council that the Cable Television Commission
should select their own me�nbers.
MOTION by Councilman Fitzpatrick to naminate Mr. Adrian Aerbst, legal
counsel to the Cable Television Commission and Clyde Moravetz, staff
representative to the Cable Television Catnnission, as two of the members
of this negotiating varnnittee. Seconded by councilman Schneider. Upon a
voice vote, all voting aye Mayor Nee declared the motion carried .

MDTION by Councilman Schneider to nominate Mayor Nee to serve on this
negotiating oarunittee. Seconded by councilman Barnette. Upon a voice
vote, all voting aye Mayor Nee declared the motion carried unanimously.
MOTION by councilman Barnette to naninate Councilman Schneider to serve on
this negotiating oanmittee. Seconded by Councliman Fitzpatrick. Upon a
voice vote, all voting aye Mayor Nee declared the motion carried
unanimously.
Mayor Nee felt they would have to ease up on their schedule as he didn't
£eel they can accanplish the necessary w�ork in the next several weelcs.
Mayor Nee stated there is a possibility of Federal legislation that
substantially changes the desirability of a f ive year extension of the
franchise.
Counci]man Fitzptrick askecl if the refranchising is oanpletecl, before this
2egislation takes effect, ho�w it would affect the franchise they are now
negotiating.
Mayor Nee stated it affects all aspects and the most critical is the City
is almost required, in the future, to re-issue the franchise to the
holder.

Mayor Nee stated the original discussions ha�l been the City would go with
the present franchise far a five year period, with some slight
impravement, and then after this time, would be in a better position to
examine the whole question. He stated, if the legislation becomes law,
this would not be possibleanc3 the franchise you now have my be the one you
have in the future.
Mayor Nee stated the Council may recall that Mr. Herbst had a ooncept that
was generally agreeable to Northern to remove a number of concerns f rom
the Federal jurisdiction by making a side aontract. He stated whether or
not that side contract would be enforceable, if the Federal stature
preempted it, he didn't know.
Mr. Aerrick, City Attorney, stated it probably is the kind of question you
don't have answers for until the bill is passed and has been tried in
vourt and several decisions handed cbwn.

Concilman Schneider. Upon a voioe vote, all voti.ng aye Mayor Nee declared
the motion carried unani.mously and the Regular Meeting of the Fridley City

distir�guishes human beings fran all oth�r cceatures; and
WHERFAS, The art of clawning, which transmits joy and love to persons
of all ages, desires appropriate recagnition for the happiness ft
brings to our communities; and such c3eserved admiration has been
forthcaning in the form of a Proclamation for National Clown Week and
International Clown Week; and
W�RFAS, These masters of mirth and merriment, known as clowns, have
clonated much time, effort and energy to entertaining so many of our
less fortunate citizens in orphanages, c�ildren's hospitals, hospitals,
homes for the elderly anci the retar3ec7.
WHERFAS, In these troubled times, which �eride peo�ple, it is heartening
to pay tribute to clowns, especially those in our community, who by
virtue of their special talents, draw pe�ple together in the universal

In April 1982 I applied tor a vacant aeat on the Appeals
Coauxission and subsequently xas appointed to that com-
xission in May 1982. Since the appointaaent I have bees
able to attend one aeeting of the co�nission. Since
- saking the application to sit on the coneo.issioa I have
_ bad a change ia � dutiea at iqr placa of �raployment.
This has caused �a�e to have to bs out of t�e city t�ree
of the evenings Lhat the appeala Conma.iesion has net
�_ ia tbe past three nont�ha. The reat ot the tiae I havQ
- been a�ay due to vacatioa and one aight to attend a
achool honors banquet in tihich � eoa xas a participant.
Because of the chaage in n�y Work a�signiaents at a�r place
of emplo�►ment I�ill continue to need ta be out of toxn
periodically. I s+ill not be able to be in attendance
on a regular ba�ia and therefore I must submii my resig-
aation from t�he lppeals Conuaisaio�.
