Chairwoman Schnabel called the April 20, 1983, Planning Ca�mission meeting
to order at 7:30 p.m.

1. ITEM FROM APPEALS COMIMISSION MINUTES OF FEBRUARY 15, 1983
a. Variance for a fence for Ing Siverts, 6850 Siverts Lane (goes back
to City Council)
Ms. Schnabel stated that, as the Planning Ca►mission members were.aware
from reading the March 28th City Council minutes, the City Council
voted to send this item back to the Planning Cortmission, and Mr. Siverts
was to be notified in advance. She stated it was not totally clear in
the City Council minutes why the City Council wanted this to come back
to the Planning Commission.
Ms. Schnabel stated she has ta7ked to Mr. Qureshi, the City Manager,
Mr. Boardman, and a number of other people regarding this, includina
Mr. Siverts. She stated Mr. Siverts was unable to attend this meeting
and he had asked that the Planning Commission postpone any hearing on
this item until the May 4th Planning Catmission meeting. She stated she
6ad told Mr. Siverts she would get back to him after this meeting.
Ms. Schnabel stated that after talking to a number of people, she felt
what happened with this whole problem was that at some point, someone
on City Staff pulled this particular item out of the Appeals Cortnnission
minutes and put it on the Planning Comnission agenda as an item to be
discussed. At the time the item came to the Planning Commission on

March 16. Ms. Gabel questioned why it was on the agenda� No one seemed
to have a very good handle on ►fiy it aas on the agenda so the Planning
Carmission acted on it. It was her opinion that the item should have
been deleted from the agenda at that point. because it is not the
Planning Cortmission's responsibility to hold public hearings on items
t6at have already had public hearings at a member comnission level. The
Planning Comnission's role is to me�ely review the member comnissions'
minutes Nith the idea that if any item would came from a member commission
that might affect another ca�miss�on. the other commission would have the
opportunity to also review it before it went on to City Council., 1t was
her opinion that the Planning Commission acted in error. She thought the
Planning Co�ission should recognize that it was an error and merely
pass on the Appeals Comnission's mi�utes in total to the City Council.
Ms. Schnabel stated that in talking to the City Manager, he seemed to
feel this was probably the best way to handle the situation and that
City Council also wasn't really clear on why the Planning Commission
acted on this item. She thought the Planning �orrmission should just
all the information the Appeals Cortmission had gathered on this item,
pass it on to City Council and let the City Council act on it.

Ms. Gabel stated she was in total agreement with Ms. Schnabel's suggestion.
Mr, Boardman stated there was also some confusion on the part of the
City Council about what the Planning Commission's role was. He stated
he wrote Memo �83-18 on "Planning Coirriission Role on Various Member
Comnission Recommendations to the City Council". This memo has gone to
the City Council as well as to the�Planning Carmission. This is his
u�derstanding, based on the rules and regulations set up� of the process
that should be followed. .
Mr, Boardman stated that because of the way the item was put on the
Planning Cortmission agenda� he could see why it was confusing to the
Planning Comnission, but it should not have been handled the way it was.
He apologized for Staff for that error. He stated that sometimes Staff
does pull out motions made by member commissions that might need action;
otherwise. those motions sometimes get lost in the minutes. He could
not explain why this iten was pulled out and not any other items.
Mr, Ezoardman stated he did not feel the Planning Commission has the
role to over-rule and recontnend differently on an action by a member
tommission unless that recortmendation is based on policy.
Ms. Schnabel stated she had told Mr. Siverts she would get back to him
after this meeting. She had told him that she felt the Planning Comnission
should be doing more housekeeping policy-type decisions. rather than
hearing this specific case again. decause it has been heard by the Appeals
Commission and will be heard again by the City Council. Mr. Siverts

seemed comfortable with this item going to the City Cauncil, so she did
not think there was any problem with the Planning Conmission doing that.
However, if the Planning Comnission members did not feel camfortable
doing this and would prefer to have a public hearing, Mr. Siverts
would come to the next meeting.
Ms. Gabel stated she thought the action recommended by Ms.Schnabel was
appropriate. The only reason she went along with acting on this item
at the March 16th meeting was because she was under the impression that
the City Council wanted the Planning Commission to act on it.
Ms. Schnabel stated that once the City Council reviews Mr. Boardman's
memo, she was sure they would concur with this action.

Mr. Saba asked about the situation with the hardware building.
Mr. Boardman stated the HRA has already taken an unlawfui detainer action
to move them out. The HRA has also started a suit for back rent. He
stated it is ve ry difficult to get top-rated tenants with an 18 month
lease, and,this is sanething the Housing b Redevelopment Authority is going
to have to discuss. He stated unless the HRA is willing to go Kith a 5-yr.
lease with options with the pos5ibility of having to buy out the options if
development goes in, they will not get top-rated tenants.
Ms. Gabel asked about the arrangement with NSP regarding the underground

Mr. Goodspeed stated that at the last Planning Comnission meeting, Mr. Saba
had asked about the E4,000 of CDBG monies requested by the senior citizens
and what it would be used for. Mr. Goodspeed stated that money would be used
to hire a staff person for recreational needs at the senior's drop-in center.
Mr, Goodspeed stated another question asked at the last Planning Carmission
meeting was the difference between public services versus human services.
He stated at the Human Resources Comnission meeting, Mr. Boardman explained
on page 3, paragraph 6, tF�at human services were more of the social service-
trpe related activities such as SACA•-human service organizations that provide
services in the City of Fridley. Examples of public services are the YMCA,
FYSA--other organizations that do not specifically provide a health, welfare-
type of service but deal with recreation or recreational activities. He
stated Staff has asked the Human Resources Ca�mission to come up with some
kind of clarification on hwnan services and what types of things human services
should include. Public services would then be those things not covered under
human services.

Mr. Hill submitted drawings to the Comnission and said that the petitioner has rithdrawn
his request for the south side yard variance, and that 7 feet has been agreed upon by
the parties. Mr. Siverts Nas present for this matter. Ms. Gabel said she spoke with
Mr. Clark and the fence is not structurally sound as it stands now and these plans are
what is necessary to make the fence structurally sound; that the specifications have to
be followed. Mrs. Gerou stated she visited the area and found the fence to be
wobbly, tied with phone wire, that the vertical boards are uneven and do not run in
a straight line and the horiiontal boards are bowed. She also said the angle support
beams are on the neighbor's side of the fence and 3 feet of the fence is above the

support beams. !!s. 6abe1 said. acco�ding to the blueprint, the fence can be made
structurally sound. Mrs. 6erou askeE the petitioner Mhy the angle support beams
are facing the neighbor's and if he takes care of the property on the other side
of the fence. Mr. Stverts said tAe suppo�t beams are on his property and he does
not take care of the property on the other side of the fence. Ms. 6abel noted that
his neiyhbor o6jected to that at the last hearing. Mr.�Barna said he visited the
are• and looked at the walkway at the Medtronics building and he could not see
tAe hardship as stated and said the Commission is looking for a sounder hardship.

Ms. 6abe1 said she visited the area also and that everyone in the neighborhood is
subject to the saroe conditions and if they allowed a 10-foot fence to be put up.

thought the fence would be out of place aesthetically and Ms. Gabel, Mrs. Gerou,
Mr. Barna and Mr. Betzold agreed it aould. He then asked how important the �eighbors
opinions were and Ms. 6abe1 said it is one factor and that is why the public hearin9
notices are sent out and having a definite hardship is another factor. Mr. Barna
said if objections exist either with the neighbors or the commission, then it is
up to the City Council and even if the fence was a joint venture with the neighbors,
there Mould still have to be a hardship. Mr. Siverts presented two letters from
tMO neighbors who had no objection to the fence.

Siverts' neighbors and they both do not object to the fence. UPON A VOICE VOTE.

Mr. Siverts said there is a constant humning sound coming from somewhere and Mr.
Barna said that it was the re fl ection of sound of tires off Highway 65. Mr. Siverts
felt the fence aould be a protecto� from he sound and in some placed a 7 foot fence
would not be adequate because of the elevat-ion of the terrain in the area.
MOTION by Mr. Barna, seconded by Mr. Betzold, to close the public hearing. UPON A.
YOICE VOTE, ALL YOTING AYE, CHAIRPERSON GABEL DECLARED THE PUBLIC HEARING CLOSED
AT 8:00 P.M.
Mr. Betzold said he has risited the area during the daytime and evening and he is
not convinced of the hardship. Mr. Plemel said the Siverts' home is in a unique
setting and did not see w�ere the fence would be readily visible by others. Mrs.
Gerou felt the fence is an eyesore and Nas not convinced of the hardship. Ms. Gabel
said she was not convinced of the hardship either.

to the City Council, through the Planning Commission. denial of the variance request

Mr. Deblon stated it was his understanding that there was a motion on Item �1
that needed action by the Planning Corm�ission. The City Council had requested
a recommendation on this from the Planning Ca*mission.
Ms. Gabel stated this was a surprise to her. She hadn't realized a recommenda-
tion was needed by the Planning Cocmission.
Ms. Gabel stated this was a variance request by Mr. & Mrs. Ing Siverts, 6850
Siverts Lane, to increase the maximum height of a fence from 7 to 10 feet in
the rear yard and side yards. She stated there is absoiutely nothing about the
fence that is aesthetically pleasing. The Appeals Comnission felt there was no
hardship, and that whatever lights or noise there realistically is, a 10 ft.
fence will not take care of the problem.
Ms. Gabel stated the petitioner had asked if he needed to be at the Planning
Cor.mission meeting, and she had told him that the Planning Commission would only
be receiving the Appeals Commission minutes. She was unaware that any action
would be required by the Planning Comnission, and Lhis had co�cie as a totel sur-
prise to her.
Mr. Goodspeed stated that since the petitioner had not been notified about any
Planning Corrxnission action, he felt they should table any action until the next
meeting when the petitioner could be in attendance.
Ms. Gabel stated she did not feel any new or different information would come
to light if they were to continue this discussion at another meeting. The
information is already here, and it is just a matter of concurring or not con-
curring with the Appeals Commission.

Mr. Deblon stated that regarding Item �Y2, the City Council had alre y approved
a variance request for the Fridley Medical Center. but the appro was based on
approval by the Planning Commission.
Ms. Gabel stated that at the City Council meeting, she ha questioned why
Planning Commission approval was needed when the Plannin Corrmission just receives
the Appeals Commission's minutes. Generally, the Plan ng Commission makes a
recomr!�endation on an item only when it somethinQ that stands out and Planning
Cormission input is requested by the Appeals Commis on. She saw the variance
request by the Fridley Medical Center as just a ro ine matter.
Mr. Oquist stated this is one more example of h the subcommissions are n�t
being utilized. All of a sudden the Planning mnission has to concur with the
Appeals Commission's motions. The charter of the Appeals Commission is that
its motions go directly to City Council. If the City Council didn't want to
rule on this item, they should have tabled t and asked for the Planning
Commission's recanmendation. If action i always needed by the Planning
Cormission, then there is no need for a Appeals Comnission.

There has been a question raised about the function of the Planning Commission in reviewing
the minutes of the member cortmissions prior to submission to the City Council. (Specifically
with regard to the minutes of the Appeals Commission).
The process that we set up was merely a review process so that additional imput concerning
parks, energy, environmental, human resources and planning policy could be added if the
Planning Commission felt is was necessary in the review of the comnission actions to
the City Council. It was NOT set up for the purpose of hearing and overturning actions
of the Comnissions. Recommendations from the P�anning Commission are then sent along
with the member commission recommendation for the City Council action.
The Planning Commission in no case is re uired or obligated to make recomnendations
on any of the items being recommended by the member Commission. The only action that
is important is the receiving of the minutes so that we have record that the Planning
Commission is aware of the actions of the member comnissions, and that if those actions
affect any other comnission, the Planning Comnission can recommend that another
commission has the opportunity to comnent.
In the past, we have highlighted specific motions of the member commission in the
Agenda outlines so that they are specifically aware of motions. This has not been
done consistently and only on an issue that may be controversial or have direct
concern for the Planning Commission. This highlighting does not mean that the
Planning Comnission must take direct action.
T can see where there may have been some confusion on this and will take steps to
be consistent on all future agendas. We will highlight all comnission motions for
easy reference to the commission minutes. This will not require specific Planning
Commission action on any item.

There were some technical amendments to the minutes of February 17, 1983, which
were done by Bill Hunt.
MOTION by Mr. Stouffer, seconded by Mr. van Dan, to approve the minutes as amended.

ELECTION OF OFFICERS:
The following commission members were nominated and elected to their respective
positions (there being no other candidates):

CHARTER COMMISSION BY-LAWS DISCUSSION:
Chairman Starwalt said he had no changes to recomnend. Ms. Jackson said the by-laws
were reviewed and discussed thoroughly and they have had no problems during the
past year. It was the feeling of the members present that there was no need for
any changes at this time.

ISCUSSION OF CHANGES TO AN ORDINANCE AMENDING SECTIONS 2.03, 2.05, 6.01
.04, 8.04 and 8.05 OF THE_FRIDLEY CITY CHARTER:
Mr, Nelson stated the the mayor and the council were uncomfortable with the change
regarding the city manager and dismissal. It was suggested to submit the changes
in the Charter except for Section 6.
MOTION by Ms. Jackson, seconded 6y Mr. Stouffer, that the Charter Comnission shall
re-submit and recomnend the changes in the Fridley City Charter, Sections 2.03,
2.05, 8.04 and 8.05. UPON A YOICE YOTE, ALL VOTING AYE, CHAIRMAN STARWALT DELCARED
THE MOTION CARRIED UNANIMOUSLY. "
Discussion of 6.01 and 6.02:
Ms. Jackson noted that one of the objections by the mayor and the council was the
removal of the public hearing regarding the dismissal of the city manager and that
it was noted by the commission that there is no guarantee of a public hearing pre-
sently in the charter which was brought to the attention of the mayor and the council
and there has been no response.
Mr. Nelson said the council tends to move more towards opposing on the grounds that
it would be possible f�r a minority to support the city manager rather than a
�ajority of the council. Mr. Hunt said the council likes the way it is presently
stated. Mr. van Dan felt the situation was paradoxical. Ms. Jackson tfie change
to four members was to prevent the city manager from frivolous dismissal. She also
stated they should take out the public hearing as it is the manager's choice and
is not there to protect the public. (Section 6.01)
MOTION by Ms. Jackson, seconded by Mr. Stouffer, that the Charter Cortmission is
�ecommending that Section 6.01 of the Fridley City Charter shall be amended to
read as follows:
Section 6.01. THE CITY MANAGER. The city manager shall be the chief
administrative officer of the city. He shall be chosen by the council
solely on t�e 6asis of his training, experience and administrative
qualifications. The choice shall not 6e limited to inhabitants of the
city or state 6ut he shall 6e a citizen of the United States. The city
manager shall be appointed for an indefinite period and he shall be
removable by the council at any regu�arly scheduled meeting provided that
at least three members of the council vote for that removal.
Discussion on Motion: Mr. Hunt said t�e city manager has no objection to three
as opposed to four. Ms. Jackson felt it was important that the council be aware
that they are not removing a public hearing 6ecause it does not exist; only at
the city manager's request. Mr. Nelson stated a cover letter s�ould be sent to
explain this.

UNANIMOUSLY.
Regarding Section 6.02 (b), Mr. Stouffer said the change here is to get approval
for the position only, not the person. Mr. Nelson felt it would remove the politics
from this situation. Mr. Treuenfels felt this section was a protection for the
employee in case of a dismissal; that t6e city manager and the council would have
to concur.

Three councilmen shall be elected for terms of three years each from three

councilman for Ward No. 2 under this Charter, shall be the couneflman having
one year of Lerm yet to serve, and shall be considered councilman for his
Ward 2 for a one year term to expire in 1958• The councilman from Wards 1
and 3 shall be elected this year, 1957, each Por terms of three years.
Upon adoption of this Charter the city is divided into three separate Wards
as folloWS:
(a) Yard No. 1 ahall be the area comprising all of election distriet
No. 1. Refer to Page 4-5 of "Voting Procedures" adopLed by Village
Council.
(b) Ward No. 2 shall be the area comprising all of election district
No. 2.
(c) Nard No. 3 shall be the area comprising all of election district
No. 3.
The eouncilman from a Ward must be a resident of such ward and his ceasing to
be a resident thereof shall cause a vacancy in the office of councilman from
auch ward; provided that a change in Ward boundaries during his term of
oPfice shall aot disqualii�r him from serving out his term.
The Lerm of mayor and of each councilman shall begin on the firat official
business day in the month of January next following his election and shall
end xhen his successor has been duly elected and has qualified. The first
order of business at the first official council meeting in January shall be
the sWearing in of the neWly elected members of the council. The council

Section 8.04 LOCAL I?�ROY�Ii? R�GQLATIOAS. After this charter takes effect,
all local improvements shall eontinue for the time being to be made under the
laks and ordinances applicable thereto. The City Council may prepare and
adopt a comprehensive ordinance, prescribing the procedure Which ahall
determine all matters pertaining to the making of local improvements
thereafter, and such ordinanee ahall supplant all other provisioas of laW on
the aame subject and maq be amended only by �� affirmative vote of at least
tour tdl�f�titxii�/i�xE/dt/xKE members of the council. Such ordinance shall
provide Por such notice and hearing in the ordering of improvements and th e
aaicing of assess�ments therefore as ahall be necessarq to meet constitutional
requirments. Such ordinance shall also require a petition of a majority in
number and interest of the owners of property to be assessed Por such
improvement. or improvements, for the initiation thereof; provided that the
City Council may proceed upon its own initiative hereunder and under such

the City Council after proper notice and hearing.
Section 8.05 P'QBLIC iiORSS; 8W PBRFORNBD. Public �lork including all local
improvements, may be constructed, extended, repaired or maintained either by
contract or, if the estimated cost is less than one thousand dollars,
directly by day labor. Before receiving Dids the City Manager ahall� under
the direction of the City Council, have suitable plans and specifications
prepared for the proposed material or project and the estimate of the eost
thereof in detail. The aWard of any contract amounting to more than ten
thousand dollars shall require an affirmative vote of at least four members
x1lE/tbrltZYi,�titxit�/ydx� of the City Council. When the best interests of
the city xill be served thereby, the City Council may organize a construction
department under competent supervision and provided with suitable equipment.
The right is reserved to the City Council, upon the recommendation of an
engineer, acting through the construetion department to bid on any Work to be
let by contract. Al1 contracts shall be let to the lowest responsible
bidder, but the term "loWest responsible bidder" shall be interpreted as
giving the City Council the right to accept any bid Which is determined to be
most advar.tageous to the City. The City Council shall reserve the right to
reject any or all bids. Detailed proceedings governing the advertisement for
bids and the execution of the contract shall be prescribed by ordinance. The
City shall require contractors to furnish proper bonds for the protection of
the City, the employees and material men.

After reviewing the base bids and adjusting for the alternate
bid, Nordquist Sign Co., Inc. is the low bidder for this sign
contract at $21,480.00.

Moore Lake Restoration Project
The City Council has accepted the U.S. EPA and State MPCA grant
addition to improve the water quality of Moore Lake, Phase II.
The grant increase was for $556,800 with the City participating
50b Of the CoSt.
Nickok & Associates, Inc. has submitted an amendment to our
agreement executed with Phase I of the Moore Lake Restoration
Project. This amendment adds $94,830 or 17� of the Phase II
amount. The original agreement was 26z% of the Phase I amount.
The City wi11 cont1nue to participate in this work by inspecting
the construction and providing survey and other ancillary work.
Recommend the C�ty Council authorize the Mayor and you to execute
Amendment No. 1 to the Hickok & Associates, Inc. Moore Lake
Restoration Froject.

I. NAitRA'I'IVE SUt�1MAKY
Tl,� obj�ctive of the proposed restoration proJect is to t�alt tt�e
eutrupl�ication of idoore Lake and to guarantee its continued use as
a recreational area. Moore Lake can be characterized as a shallow
eutrophic lake in an urban environ►nent. Ti�c: lake is utilized for
boatin�, fishing and swimming, and two parks on the shoreline area
are heavily utilized for otl�er additional outdoor recreational
activities.
�:ffi'ective restoration strategy for Moore Lake reyuires the
elimir�ation of both the external as well as the internal
pl�ospnorus supplies for the lake. All external ph�s�l�orus sources
(or at least a ma.jority) would either have to be diverted or
treated. Because of tl�e flat terrain and urban setting, 'onl;� some
of tr�e storm sewers can be treated or diverted. 'I'he ir,ternal
phos��horus supply can be effectively reduced only by chandind the
characteristics of the sediments.
External phosphorus sources will be eliminated (red�cedj upon
completion of the present Moore Lake Restoration Project
No. S oo555-01, scheduled for completion in late lyti2•
Internal phosphorus sources wer� addressed in the oridii7al �rdnt
application under Section VII, Phase II Hestoration Activities.
As a part of tl�e original grant, a pilot project wds performed in
8n attempt to determine possible mechanisms to control phosFl-,orus
release from t1�e sediments in Moore Lake. This investigative
pilot project was undertaken dur3ng ti�e sumrner and fall of l��i
and is presented in detail as Appendix A.

Ttie pilot project referenced above was inconclus3ve in d�termii�inb
tl�e bast mechanism to control phosphorus rrlease i'ro�n tt�e
sediinents. It appears ti�at sand or Aquascreen by then�selves are
not entirely effective in reducinb phosphorus release. itesearch
by others su�6est5, however, tt�at Aquascreen and sand in
combination are very efi'ective in ti�e control of phosphorus
release provided the aguatic_ve�etation is removed. Aquatic
ve�etation acts as the phos�liorus release mechanism. Therefore,
it is im�erative that the aquatic vegetation be removed prior to
placeroent of Aquescreen and sand.
Assuming a phosptiorus release of 3� mb P��Z of plant bed area; aay
(Lie, 1y76 and 2y77), 7•6tty hectares (ly acres) of plant bed area
acid a growtt� cycle of lUU days, the aquatic plants would release
approximately 23U kb of phos�tiorus per year. A�pendix A
substantiates this estimate.
Implementation of F't�ase II work will greatly reduce the nutrients
in the East Basin of Moore Lake. The resultin� lowered pl�osphorus
loading will change Moore Lake's position on the Vollenweider
phosphorus loading model from a hish eutrophic point to a point
near the lower limit of the eutrophic ran�e. Table 1 illustrates
the phesphorus loading (input) to the �ast Basin — Moore Lake
prior to Phase I wor}:; upon completion of Yhdse I work; and u�on
completion of Phase II work. This data is also illustrated i►i
Figure 1, Vollenweider Phos�horus Loadin� hiodel.

The �ro�osed restoration project will �reatly reduce the nutrients
in tlie �:ast Basin of Moore Lake. The resulting lowered phospl�orus
loading wi11 chan�e Moore Lake's position on tiie Vollenweider
Nhosphorus loadin� model. After restorati�n, the inflow and the
phos�horus enterinb tl�e Bast Basin will be reduced to 2y4,UUU
cubic meters and bit-lUy kg, respectively (Tables 2 and 3)•
2'i�t mean dept�� of the East Basin is 1.�y _m, the volume is 21b,byU mj,
tl�e area is 1U7,650 m2 and the mean depth;i�ydraulic retention
value is 4.4 m/year. The phosphorus loadin� upon com�letion of
tiie Pl�ase I project would be 33tS kb. Tr�is would give a phospt,orus
loadin�/area value of 3•14 gm P/m2/year. The Phase II projecte�i
�hospi�orus loadin� can be calculated usin� two ty�es of application
discusse� in the ori�inal grant ap�lication: 1) �hosphorus
lo3dinb btf kb!year, U.63 gm Pim2/Year; 2) pl�osphorus loading
lutS kb/year, 1.0 �rn/Y/m2/year. Wheii tt�ese points are plotted ori a
Vollenweider �rap2�, it is obvious that an efl'ective Phase II
project is vital to affect any change ir� Ploore Lake. However,
Phase I is just as important because Phase I is removir�� ti,e
external inputs that caused the need for the Pnase II project.
Upon completion of ti,e total project, the resultin� points on the
Vollenweider srapt� are near tl�e lower limit of the eutrophic ranee
(Figure 1}. The resultant lowering of the nutrient levels in �:ast
Moore Lake will alter the biological community of the lake
favorably. It will also greatly slow down tt�e eutrophication
process that is rapidly turning Moore Lake into a marsh.

An on—going lake monitoring pro�ram is essential to establist� a
baseline to jud�e the effectiveness of any restoration prodram.
Sufficient samplin6 is essential before, durinb and after any
resotrdtion proJect so there is quantitative evidence of tt�e
c}�antes in the lake. The monitocing pro�;ram should comrt�ence at
ti,e stdrt of ti�e project and proceed for two years after
completion of coi�,struction for a total of ttiree years.
A sainplinb prodram that will accomplish tl�ese objectives is
outlined.
1. Lake samples would be collected monthly.
2. Three samples would be collected at two locations at a depth
of one meter below the surface; one meter above the lake
bottom; and at the inidpoint.

general reserve bond fund system; housing, commercial and industrial
programs; and a commercial building rehabilitation loan program as authorized
by Minnesota Statutes, 459•31 to 459•3�; and a General Reserve System and
Bond Fund Program to provide additional security for bonds issued by the City
under Minnesota Statutes, Chapter 474 (electively, Lhe "Programs"); and
WHEREAS, The City staff xorking in conjunetion With the la�r firm of 0'Connor
and Hannan and the investment banking firm of Piper, Jaffray � HopWOOd, Inc.
investigated the programs and the use of Lhem to promote and enhance
development in the City of Fridley; and
WHEREAS, The staff has presented the outline and background of these programs
to the City Council;

commercial, industrial and other development goals of the City in an orderly�

act to prevent such economic deterioration.
1.02. Eugene R. Owczarzak and Louise A. Owczarzak,
individuals residing in the State of Minnesota (the "Aor-
rowers") have advised this Council of their desire to
acquire land and an existing building located at 7702
Ranchers Road in the City, acquire and construct an addition
connecting said building to an existing building owned by
the Borrowers and located at 7770 Ranchers Road in the City,
acquire, construct, renovate and remodel both of said build-
ings and acquire and install equipment therein and thereon
(the "Project"), to be owned by the Borrowers, or a partnez-
ship to be formed, and leased to ELO Engineering, Inc., a
Minnesota corporation, to be used as a manufacturing and
warehouse facility, and has requested that the City resolve
to issue its industrial development revenue bonds or notes
or an industrial development revenue note, pursuant to Min-
nesota Statutes, Chapter 474, as amended (the "Act"), in a
principal amount not presently estimated to exceed
52,000,000 to finance, in whole or in part, the cost of the
Project.
1.03. The City is authorized by the Act to issue its
industrial development revenue bonds or notes to finance
capital projects consisting of properties used or useful in
connection with a re�enue producing enterprise, such as tha�
oi tne Borrowers, and the issuance of such revenue obliga-
tions by the City would be a substantial inducement to the
Borrowers to acquire, construct and equip the Project.

Section 2. Public Hearin9.
2.01. Section 474.01, Subdivision 7b of the Act
requires that prior to submission of an application to the
Commissioner of the Department of Energy, Planning and De-
velopment of the State of Minnesota requesting approval of
the Project as required by Section 474..01, Subdivision 7a of
the Act, this Council shall conduct a public hearing on the
proposal to undertake and finance said Project. Puzsuant to
said section, a public hearing on the proposal to undertake
and finance the Project has been called by the City Manager
and shall be held on Monday, May 16, 1983, at 7:30 p.m., at
the City eall, 6431 University Avenue N.E., in the City.
2.02. The City Manager has caused notice of the public
hearing to be published in the official newspaper of the
City and in a newspaper of general circuYation in the City,
both publications to be published at least once not less
than fifteen (15) nor more than thirty (30) days prior to
the date fixed for the hearing, such notice to be published
in substantially the form attached hereto as Exhibit A.
2.03. A draft copy of the proposed application to the
Commissioner of the Department of Energy, Planning and De-
velopment of the State of Minnesota, together with all at-
tachments and exhibits thereto, has been placed on file with
the City Clerk-Treasurer, and the call for a public hearing
is hereby ratified. Such application, attachments and
exhibits are hereby ordered placed on file with the City
Clerk-Treasurer, and shall be available for public inspec-
tion, following the publication of the notice of public
hearing, between the hours of 8:00 a.m. and 5:00 p.m.,
Monday through Friday.
