RES 1983-63 - 0000574512'7 RESOLUTION NO. 63 - 1983 RESOLUTION VACATING THE CITY OF FRIDLEY'S TEMPORARY OONSTRUCPION EASEMENTS OVER CERTAIN REAL PROPERTY WITHIN THE CITY OF FRIDLEY WHEREAS, the City of Fridley obtained Temporary Construction Easements over certain real property within the City of Fridley for purposes of the ' construction and installation of storm sewer improvements, known as Storm Sewer Project No. 12; and WHEREAS, the storm sewer improvements have been made and the City no longer requires these Temporary Construction Easements and wishes to relieve its interest therein to allow the free alienation of the real property heretofore subject to said Temporary Construction Easements; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley as follows: 1. That the interest and right of the City of Fridley to Temporary Construction Easements over the following described real property be and hereby is vacated and that said property is hereinafter released from such Temporary Easements. 2. That the real property released from these Temporary Construction Easements is as follows: North 125 feet of the South 185 feet of Lot 8, Auditor's Subdivision No. 79, Anoka County, Minnesota, lying East of the Easterly right -of -way line of the Minneapolis, Anoka, and Cuyuna Range Railway Company, and lying West of the Westerly right -of -way line of the Great Northern Railway Company. North 125 feet of the South 185 feet of Lot 1, Auditor's Subdivision No. 79, Anoka County, Minnesota, except therefrom that part lying West of a ' line parallel to and 541 feet Easterly of the center line of the main track of the Northern Pacific Railway Co., as the same is now laid out and constructed, measured at right angles thereto. West 105 feet of the East 125 feet of the North 1135 feet of the South 1320 feet of Lot If Auditor's Subdivision No. 79, Anoka County, Minnesota. South 40 feet and the North 125 feet of the South 195 feet of Lot 11, Auditor's Subdivision No. 79, Anoka County, Minnesota, except East River Road (County State Aid Highway No. 1). North 25 feet of Lot 1, Block 12, Plymouth, City of Fridley, County of Anoka, Minnesota. North 25 feet of Lot 30, Block 12, Plymouth, City of Fridley, County of Anoka, Minnesota. East 15 feet of that part of Lot 18, Auditors Subdivision No. 39, Anoka County, Minnesota, lying North of 44th Avenue Northeast. A temporary construction easement described as the North 125 feet of the South 185 feet of the following described properties: beginning at a point on the South line of Lot 1, 511 feet East measured at right angles from the center line of the main track of the Northern Pacific Railway Company as the same is now laid out and constructed; thence North parallel with the center line of said main track 250 feet; thence East parallel with the South line of said Lot 1 a distance of 30.07 feet, more or less, to a point distant 30 feet East at right angles from the last described course; thence South parallel with the center line of said main track a distance of 250 feet to the South line of said Lot 1; thence West along the South line of said Lot 1 a distance of 30.07 feet, more or less, to the point of beginning; and that part of Lot 1, Auditors Subdivision No. 79, Anoka County, Minnesota, described as follows: commencing at a point on the South line of said Lot 11 distant 511 feet Easterly of, measured at a right angle from the center line of the main track of the Northern Pacific Railway Company right -of -way as now constructed and operated through said Lot 1; thence Westerly along the South line of said Lot 1 a distance of 100.24 feet, more or less, to its intersection with a line drawn parallel with and 10 feet Easterly of, measured at right angles, to a line which bears N 13056' E from a point on the South line of said Lot 1, distant 401 feet Easterly of, measured at right angles to said center line of the main track of the Northern Pacific Railway Company right -of -way; then N 16056, E a distance of 495.6 feet, more or less, to its intersection with a line drawn from the point of beginning and parallel with said center line of the main track of the Northern Pacific Railway Company right -of -way; thence Southerly along said parallel line, as drawn, a distance of 478.5 feet, more or less, to the point of beginning. 128 Page 3 - Resolution No. 63 - 1983 129 PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 25TH DAY OF JULY, 1983.
