RES 1988-36 - 00004386RESOLUTION NO. 36 - 1988 RESOLUTION RECEIVING THE PRELIMINARY REPORT, RECEIVING CERTAIN PETITIONS TO WAIVE A PUBLIC HEARING ON THE MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVEMENTS AND ORDERING A PUBLIC HEARING ON THE CONSTRUCTION OF CERTAIN IMPROVEMENTS: STREET IMPROVEMENT PROJECT NO. ST. 1988 - 1 AND 2 WHEREAS, the construction of certain improvements is deemed to be in the interest of the City of Fridley and the property owners affected thereby. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley as follows: 1. That the preliminary report submitted by the Public Works Director is hereby received and accepted. 2. That the City of Fridley has entered into an agreement with Anoka County whereby Anoka County has agreed to pay for one -half of the signal improvements at 51st Way and East River Road. 3. The FMC has requested the City to construct certain road improvements on 51st Way which will improve traffic flow into and out of their employee parking area. 4. That FMC has petitioned the City to construct said road improvements and to assess the appropriate share of the cost of the improvements to FMC and that FMC has waived their right to a public hearing which is allowed under the normal procedures set forth in Minnesota Statutes Chapter 429. 5. That the U.S. Navy has indicated they will submit a petition to the City to construct said road improvements and to assess the appropriate share of the cost of the improvements to the U.S. Navy and that the U.S. Navy will waive their right to a public hearing which is allowed under the normal procedures set forth in Minnesota Statutes Chapter 429. 6. That Marfield, Belgarde & Yaffe Companies will petition the City to construct said road improvements and to assess the appropriate share of the cost of the improvements to Marfield, Belgarde & Yaffe Companies and that Marfield, Belgarde & Yaffe Companies will waive their right to a public hearing which is allowed under the normal procedures set forth in Minnesota Statutes Chapter 429. 7. That Rapid Oil Change has petitioned the City to construct said road improvements and to assess the appropriate share of the cost of the improvements to Rapid Oil Change and that Rapid Oil Change has waived their right to a public hearing which is allowed under the normal procedures set forth in Minnesota Statutes Chapter 429. Page 2 - Resolution No. 36 - 1988 ' 8. That the Northwest Racquet, Swim and Health Clubs, Inc., Moore Lake Associates and Shorewood Plaza Partners have petitioned the City to construct said road improvements and to assess the appropriate share of the cost of the improvements to the Northwest Racquet, Swim and Health Clubs, Inc., Moore Lake Associates and Shorewood Plaza Partners and have waived their right to a public hearing which is allowed under the normal procedure set forth in Minnesota Statutes Chapter 429. 9. That the Fridley Housing and Redevelopment Authority (HRA) has requested the City to construct said road improvements and to agree to participate in the costs of the improvements and waive their right to a public hearing which is allowed under the normal procedure set forth in Minnesota Statutes Chapter 429. 10. That the City Clerk shall act to ascertain the name and address of all other owners of parcels of land directly affected or within the area of lands as may be proposed to be assessed for said improvements, and calculate estimates of assessments as may be proposed relative thereto against each of said lands. 11. That the estimates of assessments of the Clerk shall be available for inspection to the owner of any parcel of land as may be affected thereby at any public hearing held relative thereto, as well as at any prior time reasonable and convenient. 13. That the City Clerk is authorized and directed to give notice of such public hearing by publishing a notice thereof in the official newspaper in the City of Fridley and by mailed notices to all the property owners whose property is liable to be assessed with the making of these improvements according to law, such notice to be substantially inform and substance of the notice attached hereto as Exhibit A. 14. That this Council will meet on the 2nd day of May, 1988, at 7:30 p.m. at the City Hall in the City of Fridley for the purpose of holding a public hearing on the improvement noted in the notice attached hereto and made a part thereof by reference, Exhibit A. 12. of That the area proposed to be assessed for said them as noted in said agreements and report of improvements and each the Clerk are all of the lands and areas as are proposed to be assessed. All of the same to be assessed proportionately according to the benefits received. 13. That the City Clerk is authorized and directed to give notice of such public hearing by publishing a notice thereof in the official newspaper in the City of Fridley and by mailed notices to all the property owners whose property is liable to be assessed with the making of these improvements according to law, such notice to be substantially inform and substance of the notice attached hereto as Exhibit A. 14. That this Council will meet on the 2nd day of May, 1988, at 7:30 p.m. at the City Hall in the City of Fridley for the purpose of holding a public hearing on the improvement noted in the notice attached hereto and made a part thereof by reference, Exhibit A. HAAPALA -VCITY CLERK �I EXHIBIT A ' NOTICE OF HEARING ON IMPROVEMENTS STREET IMPROVEMENT PROJECT ST. 1988 - 1 & 2 WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it expedient to receive evidence pertaining to the improvements hereinafter described. NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on the 2nd day of May, 1988 at 7:30 p.m., the City Council will meet at the City Hall, 6431 University Ave., N.E., Fridley, MN, and will at said time and place hear all parties interested in said improvements in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements to -wit: CONSTRUCTION ITEM: Street improvements, including grading, stabilized base, hot -mix bituminous mat, sanitary and storm sewer, traffic signal, street lighting, landscaping, bike /walk path and other facilities, located as follows: 1. 51st Way, N.E.: East River Road to Industrial Blvd. Estimated Cost . . . . . . . . . . . . . . . . .$ 381,050.00 ' 2. Highway 65 Service Drive: 73 1/2 south to 73rd Estimated Cost .$ 10,666,00 3. Satellite Fire Station Parking Lot Estimated Cost . . . . . . . . . . . . . . . . .$ 11,334,00 4. Rice Creek Road: Highway 65 to Central AVe. Estimated Cost . . . . . . . . . . . . . . . . .$1,200,000.00 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENTS IS AS FOLLOWS: All of the land abutting upon said streets named above and all lands within, adjacent and abutting thereto. All of said land to be assessed proportionately according to the benefits received by such improvement or agreements made. That should the Council proceed with said improvements, they will consider each separate improvement, except as hereafter otherwise provided by the Council all under the following authority, to -wit: Minnesota Statutes 1961, Chapter 429 and laws amendatory thereof, and in conformity with the City Charter.
