RES 1988-46 - 00004403RESOLUTION NO. 46 - 1988 RESOLUTION ORDERING A PUBLIC HEARING ON THE CONSTRUCTION OF CERTAIN IMPROVEMENTS: STREET IMPROVEMENT PROJECT NO. ST. 1988 -4 (EAST RIVER ROAD AND OSBORNE PROJECT) WHEREAS, on November 18, 1985, the City Council by Resolution 102 -1985 supported the Anoka County Improvement Project for the intersection at East River Road and Osborne Road; and WHEREAS, the Anoka County Highway Department conducted a public hearing on the Improvement Project and informed the residents of the project plans on May 10, 1987; and WHEREAS, the City Council approved the Improvement Project by Resolution No. 24 -1988, on March 7, 1988; and WHEREAS, the City Council approved the parking restrictions on East River Road and Osborne Road by Resolution No. 25 -1988 on March 7, 1988; and WHEREAS, the City Council approved the Joint Powers Agreement for the proposed improvements and estimated cost on March 7, 1988. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley as follows: 1. That the City of Fridley has entered into an agreement with Anoka County for the completion of Project 02- 601 -33 and 03- 608 -07 at the intersection of East River Road and Osborne Road. 2. That the City Clerk shall act to ascertain the name and address of all owners of parcels of land directly affected or within the area of lands as may be proposed to be assessed for said improvements, and calculate estimates of assessments as may be proposed relative thereto against each of said lands. 3. That the estimates of assessments of the Clerk shall be available for inspection to the owner of any parcel of land as may be affected thereby at any public hearing held relative thereto, as well as at any prior time reasonable and convenient. 4. That the area proposed to be assessed for said improvements and each of them as noted in said agreements and report of the Clerk are all of the lands and areas as are proposed to be assessed. All of the same to be assessed proportionately according to the benefits received. 5. That the City Clerk is authorized and directed to give notice of such public hearing by publishing a notice thereof in the official newspaper in the City of Fridley and by mailed notices to all the property owners whose property is liable to be assessed with the making of these improvements according to law, such notice to be substantially in form and substance of the notice attached hereto as Exhibit A. That this Council will meet on the 11th day of July, 1988, at 7:30 p.m. at the Community Education Center in the City of Fridley for the purpose of holding a public hearing on the improvement noted in the notice attached hereto and made a part thereof by reference, Exhibit A. NEE - OR IEXHIBIT A NOTICE OF HEARING ON IMPROVEMENTS STREET IMPROVEMENT PROJECT ST. 1988 -4 WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it expedient to receive evidence pertaining to the improvements hereinafter described. NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on the 11th day of July, 1988, at 7:30 p.m., the City Council will meet at the Community Education Center, 6085 Seventh Street N.E., Fridley, MN and will at said time and place hear all parties interested in said improvements in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements to -wit: CONSTRUCTION ITEM: Street improvements, including grading, concrete curb and gutter, stabilized ' base, hot -mix bituminous mat, sanitary and storm sewer, traffic signal, street lighting, landscaping, bike /walk path and other facilities, located as follows: Osborne Road East of East River Road to Main Street $991,543.70 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENTS IS AS FOLLOWS: All of the land abutting upon said streets named above and all lands within, adjacent and abutting thereto. All of said land to be assessed proportionately according to the benefits received by such improvement or agreements made. That should the Council proceed with said improvements, they will consider each separate improvement, except as hereafter otherwise provided by the Council all under the following authority, to -wit: Minnesota Statutes 1961, Chapter 429 and laws amendatory thereof, and in conformity with the City Charter.
