RES 1988-75 - 00004470RESOLUTION NO. 75 - 1988 RESOLUTION AUTHORIZING PAYMENTS TO THE ANOKA COUNTY COMMUNICATIONS WORKSHOP TO DEFRAY THE COSTS OF CABLE TELEVISION ACCESS EQUIPMENT WHEREAS, the Anoka County Communications Workshop (ACCW) has been established as the local cable access entity given the responsibilities to educate, train and promote community programming productions for Fridley Cable Television; and WHEREAS, it is in the public interest to preserve and maintain facilities to ensure ongoing community programming in Fridley; and WHEREAS, the City of Fridley recently renewed the Cable Television Franchise for a 15 year period. At the time of acceptance of the franchise the cable operator is required to contribute $60,000.00 to the City to be used to acquire equipment in support of public, educational and government access; and WHEREAS, the cable operator has fulfilled this condition by contributing $60,000.00 to the City of Fridley which has been deposited in the Cable TV Fund; and WHEREAS, the attached agreement "Exhibit A" relating to the purchase of ' equipment in support of public, educational and government access has been worked out by representatives of the City of Fridley and the ACCW. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley that Sixty Thousand Dollars ($60,000.00) from the Cable Television Fund be allocated for the purchase of needed production equipment. BE IT FURTHER RESOLVED that the Mayor and the City Manager be authorized to execute the attached agreement relating to the purchase of cable television equipment by the Anoka County Communication Workshop in accordance with the Cable TV Franchise Agreement. NE MAYOR EXHIBIT A AGREEMENT ' THIS AGREEMENT is made and entered into this 22nd day of August, 1988, by and between the Anoka County Communications Workshop, a Minnesota non - profit corporation, and the City of Fridley, Minnesota. WITNESSETH the Anoka County Communications Workshop (hereinafter the ACCW) has been established as the local cable access entity given the responsibilities to educate, train, and promote community programming productions for Fridley Cable Television; and It is in the public interest to preserve and maintain facilities to insure ongoing community programming in Fridley; and The City of Fridley recently renewed the Cable Television Franchise and the cable television operator has contributed Sixty Thousand Dollars ($60,000.00) to be used by the City for capital costs to be incurred for access facilities; and In consideration of the covenants, conditions, undertakings, and promises contained herein, the parties agree as follows: 1. The City of Fridley shall allocate Sixty Thousand Dollars ($60,000.00) from the cable television fund to the ACCW for the purchase and certain installations of needed production equipment. 3. In the event that the City of Fridley terminates its designation of ACCW as the entity responsible for local cable access, which determination shall be at the sole discretion of the City of Fridley, all equipment purchased in accordance with the terms of this Agreement shall become the property of the City of Fridley. The City of Fridley may exercise any and all legal rights and remedies available to it. This Agreement is accepted and we agree to be bound by all its terms and conditions. No funds shall be expended by the City until such time as the ACCW provides a written receipt of proper purchase order, invoice, or other pertinent written documentation. The City of Fridley reserves the right to refuse payment of unnecessary or unreasonable equipment purchases as determined in the sole discretion of the City of Fridley. 3. In the event that the City of Fridley terminates its designation of ACCW as the entity responsible for local cable access, which determination shall be at the sole discretion of the City of Fridley, all equipment purchased in accordance with the terms of this Agreement shall become the property of the City of Fridley.
