An inspection of the property was made April 18, 1989 by this
office. Several items of deferred maintenance were found such as
worn carpeting, older kitchen cabinets, etc., that we do not
recognize in our valuation process. Some structure items were
found to be bad, such as flooring in the kitchen and some damage
to the concrete floor in the garage. These items are recognized.
The assessor's office recommends a reduction in the 1989 value as
originally submitted from $79,200 to 578,000.

The Regular Meeting of the Fridley City Council was called to order
at 7:35 p.m. by Mayor Nee.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of Allegiance
to the Flag.

PRESENTATION OF AWARDS AND PROCLAMATIONS:
PRESENTATION OF PLAOUE - DANIEL ALLEN. PARKS & RECREATION
COMMISSION•
Mayor Nee stated members of the various City Commissions spend a
great deal of time serving the community, and the City Council
appreciated their contributions.
He stated Daniel Allen has served on the Parks and Recreation
Commission from 1980 to 1989 and the City Council wished to present
him with this plaque in appreciation for his services as a member
of this Commission.
Mayor Nee read the inscription on the plaque and presented it to
Mr. Allen. He and the members of the Council expressed their
thanks and appreciation to Daniel Allen for his service to the
community.
FOREIGN EXCHANGE STUDENTS DAY. APRIL 17, 1989:
Mr. Hunt, Assistant to the City Manager, introduced Sue Davis,
representative for the American Field Service. Ms. Davis stated
there are four foreign exchange students in Fridley, two attend
Fridley High School and two attend Totino-Grace High School.
Miss Yelitza Bonilla, Cagua, Venezuela; Mr. Ugo Caminol, Verona,
Italy; Mr. Jorge Del Camp, Bogota, Columbia; and Mr. Olivier Van
der Moren, Waterloo, Belgium introduced themselves and their host
families to the Council. All the students stated they were happy
to be in Fridley and the community was very friendly.

Mayor Nee presented each student with a proclamation and the
Fridley VFW Post 363 presented the students with an American flag.
ADMINISTRATION OF OATH OF OFFICE - MAUREEN MEISNER PATROL
OFFICER•
Mr. Hill, Public Safety Director, administered the Oath of Office
to Maureen Meisner, the newly appointed Patrol Officer.
Mr. Hill stated Ms. Meisner is from Inver Grove Heights where she
was a member of the National Honor Society in high school. He
stated she has received a Bachelor of Arts degree in Political
Science from the University of Minnesota and an AAS degree from
Inver Hills Community College as a Paralegal. Mr. Hill stated Ms.
Meisner speaks and understands some Spanish and sign language. He
stated she was previously employed by the McLeod County Attorney�s
Office and a St. Paul law firm.
Mayor Nee and the members of the City Council extended their
congratulations to Ms. Meisner and welcomed her to the City of
Fridley.
APPROVAL OF MINUTES:
CITY COUNCIL MEETING. APRIL 3 1989•
MOTION by Councilman Fitzpatrick to approve the minutes as
presented. Seconded by Councilwoman Jorgenson. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.
BOARD OF REVIEW MEETING. APRIL 10 1989•
The Council requested these minutes be submitted after the final
meeting of the Board of Review.
ADOPTION OF AGENDA:
MOTION by Councilman Schneider to adopt the agenda as submitted.
Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
OPEN FORUM, VISITORS:
Mr. Loren Mayer, 7523 Tempo Terrace, stated he was before the
Council in 1986 and his concerns are somewhat related to the 1986
incident. He stated over the last several years, he has made some
observations about the community and is concerned with what he has
observed. Mr. Mayer stated the reason he moved into Melody Manor
was he felt the citizens took pride in their community. He stated
he is beginning to see some deterioration with cars parked on lawns
and extension cords running to these vehicles. Mr. Mayer stated

some trees are encroaching on their neighboring property owner and
newspapers are dropped at his home after 9 p.m. on Sunday evenings.
Mr. Mayer stated the reason he is bringing this to the Council's
attention is that these same things were occurring in the community
where he previously lived. He stated this tends to progress and
get worse and hoped somehow the City can be a little more visible
in its code enforcement.
Mr. Mayer stated he would like the City to provide some mailings
regarding code enforcement policies. He stated he has contacted
the Code Enforcement Officer only one time since he moved to
Fridley, however, he could make many more calls now.
Mayor Nee stated this is an area the Council has been discussing.
Councilwoman Jorgenson stated she spoke to a lady in Mr. Mayer's
area this morning regarding some of the concerns Mr. Mayer is
addressing. She stated she has asked the City Manager to request
the Code Enforcement Officer to check the area and notify property
owners who are in violation of any codes. Councilwoman Jorgenson
stated the Council has not had an opportunity to discuss the issue
this evening. She felt a systematic plan of code inspection may
have to be implemented.
Mr. Mayer stated he was glad to hear the Council is aware of these
issues and taking steps to correct the situation. He stated this
means a lot to him as a Fridley resident.
OLD BUSINESS:
2. ORDINANCE NO. 922 AMENDING CHAPTER 402.27 OF THE FRIDLEY CITY
CODE PROVIDING FOR THE ESTABLISHMENT OF WATER CONSERVATION
REGULATIONS•
Mr. Hunt, Assistant to the City Manager, stated this is an
amendment of the ordinance regarding water conservation regulations
for the City. He stated this amendment would make it easier for
the Council to respond more quickly to problems relating to water
conservation. Mr. Hunt stated this amendment would allow the
Council to establish, by resolution, water conservation regulations
which may be required, rather than by amendment of the ordinance
itself.
MOTION by Councilman Schneider to waive the reading and adopt
Ordinance No. 922 on second reading and order publication.
Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
3. RESOLUTION NO 38-1989 APPROVING A PLAT P.S. #88-03. GLACIER
PARK COMPANY ADDITION:

Ms. Dacy, Planning Coordinator, stated this resolution authorizes
the signing of this plat for Glacier Park Addition. She stated
this subdivision request for API Supply Company at 5110 Main Street
was approved at the Council's March 6, 1989, meeting with two
stipulations. She stated there was concern, prior to the meeting,
about the bikeway/walkway easement. Ms. Dacy stated, however, Mr.
Hansen of API has advised them that Glacier Park has signed the
plat and has no objection to the bikeway/walkway easement.
Ms. Dacy stated the Planning Commission recommended approval of the
plat with two stipulations attached to this resolution as Exhibit
A.
Councilman Fitzpatrick stated it should be mentioned there is a
problem in this area with the road sometimes under water and the
County came in too late with a request for a wider easement than
the ten feet provided in the plat.
MOTION by Councilman Fitzpatrick to adopt Resolution No. 38-1989
with the two stipulations attached as Exhibit A. Seconded by
Councilman Billings.
Councilman Billings asked who is the fee owner. Ms. Dacy stated
it is Burlington Northern with Glacier Park acting as their agent.
Councilman Billings asked if Glacier Park has signed the plat to
which Ms. Dacy answered in the affirmative.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and
Mayor Nee declared the motion carried unanimously.
4. RECEIVING THE MINUTES OF THE PLANNING COMMISSION MEETING OF
APRIL 5. 1989:
A. RESQLUTION NO. 39-1989 APPROVING LOT SPLIT L S #89-02
TO ALTER THE EXISTING SIDE LOT LINE BETWEEN LOT 5 BLOCK
3. SHOREWOOD ADDITION AND LOT 6 BLOCK 3 SHOREWOOD
ADDITION. IN ORDER FOR LOT 5 TO OBTAIN 20 FEET OF REAR
PROPERTY. THE SAME BEING 6211 AND 6201 CAROL DRIVE N E

Ms. Dacy, Planning Coordinator, stated this lot split involves
property owners swapping a triangular piece of property. She
stated both lots meet the lot area and width requirements under the
new lot line arrangement.
Ms. Dacy stated the Planning Commission recommended approval of
this lot split subject to both property owners combining the legal
descriptions with the new triangular piece.

MOTION by Councilman Schneider to concur with the recommendation
of the Planning Commission and grant this lot split by adoption of
Resolution No. 39-1989. Seconded by Councilman Billings. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.
MOTION by Councilwoman Jorgenson to receive the minutes of the
Planning Coaimission meeting of April 5, 1989. Seconded by
Councilman Billings. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
5. CONSIDERATION OF CHANGE ORDER NO. 7 FOR THE FRIDLEY MUNICIPAL
CENTER IMPROVEMENT PROJECT NO. 189:
Mr. Flora, Public Works Director, stated this change order consists
of 20 Proposal Requests and Works Orders Nos. 1926 through 1931 for
a total cost of $35,457.16 involving plumbing changes, electrical,
extra stone and other miscellaneous items for the Municipal Center,
Fire Station and Parking Ramp. He stated this change order also
includes a contract amendment to Brin Northwestern for $4,735.00.
He stated these funds were included in the original project
authorization as miscellaneous materials.
MOTION by Councilman Schneider to approve Change Order No. 7 for
the Municipal Center Improvement Project No. 189 in the amount of
$35,457.16, and a revised contract amount of $3,614,515.59
Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
6. CONSIDERATION OF RELEASING THE TAX FORFEIT PROPERTIES:
Mr. Flora, Public Works Director, stated there are three properties
in Fridley which recently went tax forfeit. He stated one of the
properties is located on 63rd Way and the other two parcels are on
the boundary between Coon Rapids and Fridley. He stated all of
these properties are unbuildable. Mr. Flora stated staff is
recommending the Council authorize the sale of these three
properties to the adjoining property owners by the County.
MOTION by Councilman Fitzpatrick to notify the County that the lots
are unbuildable and the County should attempt to sell them to the
adjoining property owners. Seconded by Councilman Schneider. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.
7. RECEIVING BIDS AND AWARDING THE CONTRACT FOR WATER. SANITARY
SEWER AND STORM SEWER PROJECT NO. 188:
Mr. Flora, Public Works Director, stated 13 bids were received for
this project.

Mr. Hunt, Assistant to the City Manager, stated this change order
is in reference to the design of the A/B switch for monitors at the
Council bench and the design for the retractable screens, recessed
speakers and can-type speakers for a total addition of $600.00.
MOTION by Councilman Schneider to approve Change Order No. 1 to the
Consultant contract for the Technical System for the Municipal
Center with Electronic Interiors in the amount of $600. Seconded
by Councilman Fitzpatrick. Upon a voice vote, all voting aye,

11. CONSIDERATION OF CHANGE ORDER NO. 1 FOR TECHNICAL SYSTEMS

12. CONSIDERATION OF RECEIVING REFERENDUM PETITION NO. 6-1989
AMENDING COUNCIL TERM OF OFFICE, ORDINANCE NO. 919:
Ms. Haapala, City Clerk, stated 305 signatures were obtained on
this petition. She stated 281 were acceptable, two not acceptable,
and 22 persons were not registered voters. She stated in order to
submit this to a referendum vote, 298 signatures are required,
therefore, there is a deficit of 17 signatures.
Councilman Schneider questioned why two signatures were not
acceptable.
Ms. Haapala stated someone signed two names and the other one she
could not read the name and, in checking with the County, nothing
in the records matched so she could not accept it.
MOTION by Councilman Schneider to receive Petition No. 6-1989.
Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
Mr. Herrick, City Attorney, stated the State statute is not really
explicit and gives some discretion to those who are administering
it in that it says certain sections should be followed as closely
as practical. He stated what that means is different persons could
have reasonable interpretations that are not the same.
Mr. Herrick stated Dave Newman gave an opinion that he did not feel
the 10 day extension applied to allow additional time to obtain
signatures. He stated, speaking for himself, and looking strictly
at the wording of the statute, he would agree.
Mr. Herrick stated another City Attorney was asked to give a second
opinion and it was contrary to Mr. Newman's. He felt if you take
a strict interpretation of the statute, you come to one end and
if you take a liberal interpretation and, read into the statute,
you come to a different conclusion. He felt where there is a
question, it probably should be resolved in favor of allowing a
vote. He stated there has not been any court interpretation or
Attorney General's opinion regarding this statute.
He stated when Dave Newman rendered his opinion, he consulted with
the Attorney for the League of Minnesota Cities and received advice
that concurred with his opinion. He stated when Mr. Goodrich
consulted with Mr. Gallagher of the Attorney General's Office, he
received a different opinion.
Mr. Herrick stated he felt, as an attorney interpreting the wording
of the statute, he would probably follow the more conservative

Councilman Schneider stated it was the Council's intent to try and
obtain as much input as possible. He stated if the Council allows
the additional time to obtain the 17 more required signatures, if
this would, in any way, be in violation of the statute.
Mr. Herrick stated if someone questioned the Council's decision,
he felt it was defensible.
MOTION by Councilman Billings to allow the 10 day extension, as
provided by the Statute, to correct the signature deficiencies
and/or obtain the required signatures to place this item on the
ballot. Seconded by Councilman Schneider.
Councilman Billings stated it was the Council's intent to try and
find a vehicle to place this matter before the voters of the City,
however, the State statute provides two alternatives. He stated
one alternative is to approve it unanimously and create an
ordinance or to reject it and send it back to the Charter
Commission. He stated the Council did not have an option to send
this to a referendum vote, the Charter Commission would have to
send it to a referendum vote. He stated the Council heard only
one person speak against this ordinance. He stated there was a
tremendous amount of public relations work on this item. He stated
there was no less than 20 different ways the Council attempted to
obtain public input, not counting the efforts of the individual
Council members. He stated he voted to accept the recommendation,
as it appeared to be a reasonable request from the Charter
Commission, since there was little or no opposition. He stated he
is pleased to see a petition because his original intent was to
send this to the voters for a referendum vote, but because there
was not a vehicle to accomplish this, he voted in favor of the
ordinance. He stated it seems everyone on the Council virtually
agrees with this concept.
Councilman Billings questioned the ten day period and if it is ten
days from when the petition was certified or ten days from when it
was received by the City Clerk.
Mr. Herrick stated the Council is now receiving the petition and
felt it would be ten days from this date and the first day would
begin tomorrow, April 18, 1989.
UPON A VOICE VOTE TAKEN ON THE ABO�IE MOTION, all voted aye, and
Mayor Nee declared the motion carried unanimously.
Mr. Frank van Dan stated he would like to thank the Council for
their kind regards and the manner in which this petition was

treated and the extra time allowed. He also thanked the City Clerk
and the City Attorney. He stated Shirley Haapala was very kind and
courteous in all respects and spent much time checking this
petition. Mr. van Dan stated this is a testimony to democracy.
He stated most persons signing the petition may have expressed a
willingness to go along with the Charter amendment, but felt there
was an unanimous response by them to have a chance to vote on it.
He stated he would do his best to provide the missing signatures.
13. CLAIMS•
MOTION by Councilwoman Jorgenson to authorize payment of Claims No.
25722 through 25914. Seconded by Councilman Schneider. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.
14. LICENSES:
Mayor Nee stated there was a concern by staff regarding the license
for George's in Fridley. He stated the recommendation is to issue
the license for a six month period, instead of one year.
Mayor Nee stated he wished to compliment Mr. Nicklow for the
progress made at his establishment over the last several months.
Mr. Pribyl, Finance Director, stated the Public Safety Director,
Mr. Hill, was concerned with the number of times his department was
called to this establishment for assistance. He stated Mr. Hill
did meet with the owner and is recommending a six month conditional
license and a review after this time.
Mr. Tony Nicklow stated he had problems at his business from
elements from North Minneapolis. He stated Mr. Hill has been very
helpful in his suggestions to alleviate the problem. Mr. Nicklow
stated they have provided more security and a thorough checking of
identification cards.
Mayor Nee stated if George's in Fridley keeps up their good work,
he felt there would be no problem with the license.
Mr. Nicklow stated it is to his benefit and his customers to run
a qood establishment.
MOTION by Councilman Fitzpatrick to approve the license renewal for
George's in Fridley for a six month period. Seconded by Councilman
Schneider. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
MOTION by Councilman Fitzpatrick to approve the rest of the
licenses as submitted and on file in the License Clerk's Office.

reading of the public hearing notice and to open the public
hearing.

MOTION CARRIED AND THE PIIBLIC HEARING OPEN AT 7540 P.M.
Ms. Dacy stated Fridley Covenant Church is located on the southwest
corner of Satellite Lane and the intersection of T.H. 47. It also
abuts Mercury Drive on the south side. The property is zoned R-1,
single family residential district. Church uses are allowed in R-

1 districts with a special use permit. The proposal to construct
a 37 ft. by 26 ft. addition into the northeast corner of the
church. The addition will contain two levels. The upper level
will be a narthex or foyer area into the existing sanctuary and a
small corner will be used for a library. The lower level is for
a classroom and reconstructed bathroom facilities. The lower level
bathroom area was originally a classroom, and that is being
relocated to the northeast corner.
Ms . Dacy stated that because the narthex area will not have any
fixed seating nor is any additional seating or assembly area
proposed, staff is recommending that no additional parking be
required. However, staff is recommending that the petitioner
install additional landscaping to meet the intent of the Zoning
Code (stipulation #1).
Ms. Dacy stated staff is recommending approval of SP #89-05 subject
to the following two stipulations:
1. The petitioner shall install the following landscaping
materials:
a. 5-8 foot balled and burlapped Black Hills spruce
evergreen trees, 20 feet o.c., 5 feet from the curb
of the north parking area;
b. 3- 2 1/2 caliper inch balled and burlapped Burr oak
tress, 40 feet o.c., 10 feet from the curb, plus 26
Bird's Nest spruce planted 5 feet o.c. with edging
and rock mulch, and an appropriate weed barrier.
2. The petitioner shall combine the existing tax parcels for
the property into one tax parcel.
Mr. Betzold asked if the City had any long range plans for the
elimination of the entrance drive onto University Avenue in front
of Burger King and the church.
Nis. Dacy stated she was not aware of any plans.
Mr. Eldon Morrison stated he is the architect working with Fridley
Covenant Church on this proposal. He stated they feel the addition
will be very compatible with the existing building and will look
like an extension of the same building. They feel the addition
will fit the site very nicely and will enhance the function of the
church in that they will now have a larger gathering place before
and after church.
Mr. Morrison stated that after further discussion with his clients,
they have more concern about the landscaping than they did earlier.
Being a church and being located on University Avenue, they do want

the church to remain visible. The concern is if they do the
landscaping to the extent it is recommended by staff, the church
will be hidden from exposure to passersby. On the north also they
would like to maximize exposure of the building to the public.
There are 36-37 oak trees on the property, and they will be losing
only 2-3 trees with the construction, so they certainly have a lot
of green space and they would like to minimize the additional
landscaping. They are suggesting having low bushes by the parking
lot on the west side, by the service drive on the University Avenue
side, and on Satellite Lane. It has been their experience that
larger evergreen trees tend to block the view of a building.
Mr. Donn Hagman stated he is a meniber of the church and the
building committee. He stated they are on a relatively tight
budget. Their intent in proposing smaller shrubbery is they could
do some of the work themselves and save the project some money
versus having to contract a service to put in larger trees.
Mr. Morrison stated the church parking lot on the side of the
University Avenue Service Road is used only on Sunday and perhaps
one night during the week.
Mr. Curtis Bostrum stated he is also a member of the church and the
building committee. As Mr. Morrison had pointed out, the only time
there are cars on the north side and east side is on Sunday morning
between 8:30 a.m. and 12:00 noon. The main entrance to the church
is in the rear of the church where the majority of the parking is.
The parking area is approximately 6 feet above the street level,
both on Satellite Lane as well as on the University Avenue Service
Road. So, either standing or sitting in a car, a person cannot
even see the parking area. A person can see the fronts of cars and
the church. If they are required to plant 8 foot trees,
proportionately they will not look good, because they are so large
to start with. Then, in 5-10 years, those trees are going to be
20-25 feet tall. Across the street at Burger King, there are
spruce trees there which are very huge. Those spruce trees are
planted farther apart than what is being suggested by staff.
Mr. Bostrum stated they are certainly willing to put in some
screening but do not agree with the type of screening stipulated.
They would like a lower shrub that does not grow so high and is
easier to maintain themselves.
Rev. Neil Bonkoski, member and pastor of the church, stated that
along University Avenue from the corner of Mercury Drive up through
about two-thirds of parking area, there is a screening of bushes
and trees that is already in place right now.
Mr. Bostrum asked who is responsible for maintaining the screening
along University Avenue.

Mr. Dahlberg stated that is the Highway Department's
responsibility.
Mr. Bostrum stated he did not believe that screening is ever
maintained. The church people clean out the debris every spring,
but he never sees anyone do any trimming or maintenance, and it
certainly takes away from the appearance of their property and the
City in general.
Ms. Dacy stated stipulation 1-b was in reaction to Mr. Morrison's
comment that the church wanted to reduce the intensity of the year-
around screening that has been proposed. Staff thought the area
along University Avenue would be the area of main concern so staff
had recommended 3 small single trees and an evergreen shrub that
could be trimmed at 3 feet. Upon the Commission's direction, staff
could work with the petitioner on an alternative landscaping plan.
Stipulation 1-a was based on the type of plantings across the
street at Burger King and thought it would be appropriate for the
site.
Mr. Betzold stated that unless they can come up with an agreeable
alternative landscaping plan at this meeting, Planning Commission
will have to make an incomplete recommendation to City Council.
They want to have a plan that meets the intent of the ordinance and
is attractive to the City, yet is comfortable for the petitioner,
and they certainly do not want landscaping that is going to hide
the church.
Ms. Sherek agreed with the petitioner about the spruce trees. They
do grow too large. She stated the Bird's Nest spruce is not a
tree. It is a shrub that can be maintained at a height of 2 1/2 -
6 feet.
Mr. Bostrum stated that would be acceptable for the north side.
Ms. Dacy stated staff would be comfortable with having stipulation
1-b apply to the whole site.
Mr. Kondrick stated he would agree to 1-b applying to the whole
site.

28, 1989, joint EQC/Energy Commission meeting minutes.

Mr. Saba stated that at their meeting the previous night, the
Commissions voted to recommend that the EQC and Energy Commissions
be combined into one commission. It will be a seven member
commission, not to fall below seven members. He stated this
recommendation will be coming to the Planning Commission and then
to the City Council.
Mr. Betzold stated that when this recommendation for the combining
of the two commissions comes before the Planning Commission, the
members should also be prepared to make recommendations regarding
the structure of the Planning Commission membership.

Consideration of Special Use Permit, SP #89-05,

Attached is the staff report for the special use permit request for
an addition to the Fridley Covenant Church at 6390 University
Avenue N.E. Staff recommends the City Council approve the special
use permit request as recommended by the Planning Commission, with
the following stipulations:

The petitioner, Fridley Covenant Church, is proposing to add a 37
foot x 36 foot addition to the existing building, located on Lots
1 through 4 and Lots 10 through 12, Sylvan Hills Plat 4, the same
being 6390 University Avenue N.E. The property is zoned R-1,
Single Family Dwelling. The R-1 district requires a special use
permit for churches.
SITE
The site is located at the southwest corner of Satellite Lane N.E.
and the University Avenue Service Road intersection. Mercury Drive
N.E. abuts the south side of the property. Burger King is located
to the north, single family homes abut the property to the west and
across Mercury Drive to the south. The site is wooded with mature
oak trees and has little or no additional landscaping.
ANALYSIS
The proposed addition consists of a narthex and library on the
upper level and a 24 foot x 22 foot classroom on the lower level.
The expansion also includes the installation of an elevator, the
upgrade of existing bathrooms on the upper level and the addition
of a bathroom on the lower level. The addition is architecturally
compatible with the existing building.

building. The current parking areas located on the north and east
side are not screened from the public right-of-way. Because
mature trees will be removed and because parking lot screening is
required by ordinance (Section 205.16.6), staff recommends the

stipulation #1).

the property be combined into one parcel.

The rezoning application for the former Cub Foods site at 250
Osborne Road N.E. will be presented to the Planning Commission on
May 3, 1989. The developers are requesting that the public
hearing before the City Council be held on May 15, 1989, in order
to receive initial Council approval prior to June l, 1989, the
closing date of the property sale. Mr. Farrell understands that
the City Council will need to have two readings of the ordinance
on the rezoning, but wanted to gain Council reaction after the
public hearing on May 15, 1989. Staff recommends the City Council
establish May 15, 1989, as the public hearing date.

Enclosed is a proposed animal control contract between the City
and the Greater Anoka County Humane Society for council consideration.
It is my recommendation that council approve the contact for
a term from June 1, 1989 through December 31, 1990. Cost to
be $9974.24 per year paid in monthly installments of $831.18.
In 1986 the City of Fridley pledged $15,000 (.50G per capita
per MSS 343.11) for the Humane Society's capital development
project. All other cities in Anoka County also pledged per capita
funding except the City of Anoka who operates their own service.
The City of Fridley unlike all other communities served by the
society, has not had a formal contract with the society for services
rendered. We have been paying on an animal by animal basis for
an average of $70 per month. In contract, other cities cost
were; Columbia Heights $416/mo, Spring Lake Park $225/mo, Blaine
$833/mo, Coon Rapids $1083/mo. Smaller communities such as Bethel,
Centerville, Lexington, Ramsey are paying 50� to 62� per capita.
Our special rates were the result of an agreement between myself
and the executive director at the time the city pledged the initial
$15,000. The intent of the agreement was for the city to recover
some of the capital development pledge. Estimates indicate that
we have recovered our investment through reduced service cost
compared to other cities.
The Humane Society is attempting to provide a fair formula for
all cities by standardizing cost per capita.
The proposed contract appears to be a reasonable request. The
$9974.24 is $1197.76 below what the city paid a private contractor,
$11,172, in 1985.

Cities can choose from one of two options:
1. Bring the Animal to the Shelter
or
2. Cage and hold uninjured Animals� to be picked
up by the Humane Society the following
day.(Holding cages may be purchased througli the
Humane Society at cost.)
After normal Business hours� any in�ured
Animals, that are in a life threaten condition
may be transported� by the City to
AFF'ILIATED EMERGENCY VETERINARY SERVICES,
(see attached sheet)�for medical
treatment, at no additional cost to the City.
The Humane Society will then pick up the�
Animal the following day� after treatment, or
as soon there after as possible.
B. Additional Services
1. Boarding more than five days.
2. Transportation services to the University of
Minnesota for rabies examination.
3. Patrol

The Humane Society shall retain all reclaimed
fees. License fees shall be returned t� the
Municipality.
D. One-twelfth of the total contract amount for the
basic services, plus charges for additional
services, shall be paid monthly, on or about the
last day of the month� or within thirty (30) days
after submission of the monthly claims. by the
Humane Society to the Municipality.
IV. COMPLIANCE WITH LAWS.
In providing all services pursuant to this Contract� the
Numane Society shall abide by all statutes. ordinances, rules
and regulations pertaining to or regvlating the provision of
such services� including those now in effect and hereafter
adopted.
V. AUDIT DISCLOSURE AND RETEN'TION OF' RECORDS.
The Humane Society agrees to make available to dc�ly
authorized representatives of the Municipality and either the
legislative auditor or the state auditor for the purpose of
audit examination pursc.cant to Minn. Stat. 16B.06� any books,
documents, papers, and recerds of �he Humane Society that are
pertinent to the Humane Society's provision of services
hereunder. The Humane Society further agrees to maintain all
such required records for �three years after receipt of final
payment and the closing of�all other related matters.
VI.
INSURANCE.
The Humane Society shall purchase� maintain in full
force and effect dtrring the term of this Contract, and
provide proof of the following insurance coverage:
A. Workers' Compensation: Coverage at statutory
limits as provided by the State of Minnesota.
B. COMPREHENSIVE GEN�2AL LIABILITY: Coverage shall
have minimum limits of t1,000�000 per occurrence,
Combined Single Limit for Bodily Inj�ary Liability
and Property Damage Liability.
C. Business Auto Liability: Coverage shall have
minimcsm limits of t500,000 per occurrence,
Combined Single limit for Bodily Injury Liability
and Property Damage Liability. This shall include
Owned Vehicles. Hired and Non-Owned Vehicles and
Employee Non Ownership.

Any material alterations. modifications or variations of the
terms of this Contract shall be valid and enforceable only
when f.hey have been reduced to writing as an amendment and
signed by the parties.
IX. ENTIRE AGREalENT.
It is understood and agreed by the parties that the
entire agreements of the parties is contafned herein and that
khe Contract supercedes all oral agreements and negotiations
betWeen the parties relating to the subject matter hereof as
aell as any previous agreements presently in effect between
the Humane Society and Ehe Municfpality relating to the
sub�ect matter hereof. The parties heceto revoke any prior

The City of Fridley has recently entered into a Joint Powers
Agreement with Anoka County. The Agreement calls for a-50 percent
split of the signal improvement costs.
Attached is a resolution requesting "offsystem" State Aid funds for
the Fridley portion anticipated to be $54,000.
Request the City Council approve the attached Resolution at their
May 1, 1989, meeting.

REVISION PROJECT (S.A.P. 127-020-08)
IPHEREAB, it has been deemed advisable and necessary for the City
of Fridley to participate in the cost of signal improvement project
located on C.S.A.H. No. 1(East River Road) within the limits of
said municipality, and
WHEREAS, said construction project has been identified and recorded
as S.A.P. 02-601-34, and
WHEREAB, the project has been agreed to by the County of Anoka and
the City of Fridley with a 50 percent/50 percent cost participation
arrangement. The anticipated City share is $54,000.
NOW, THEREFORE, BE IT RESOLPED, that the City of fridley hereby i
appropriates from our Municipal State Aid Funds the sum of �-68954,piO
dollars to apply toward the construction of said signal improvement
project and request the Commissioner of the Department of
Transportation to approve this authorization.

I have been informed by the Anoka County Highway Department that
they have received a quote to replace the existing median on East
River Road from the north side of Mississippi Street to the Rice
Creek Bridge Project with red brick consistent with the City
standards at an additional cost of $33,252.87. This cost is
consistent with the figures we have been receiving to date.
Recommend the City Council concur with this addition to the Anoka
County Rice Creek Road Improvement Project so that it can be
accomplished now as they are completing the Rice Creek Road bridge.

Dear Mr. Flora:
Please find enclosed a copy of the quantity listing for a
proposed Supplemental Agreement to the above referenced
project. This Supplemental Agreement includes removal of the
existing bituminous median between Mississippi Street and Rice
Creek Wayand replacement of the bituminous median with a brick
median similar to the median included on the Rice Creek Bridge
Project. Also included is the traffic control for lane
closures during the work.
I understand that you have a Council Meeting on Monday night,
April 24, 1989, at which time you will be considering this
work. Please advise them that the County will be sending to
you, an amendment to the existing Joint Powers Agreement
whereby the City of Fridley will pay all of the costs shown on
this Supplemental Agreement request, of $30,789.70, plus 8�
percent for construction engineering. Engineering amounts to
$2,463.17 making it a total of $33,252.87. I anticipate that
we will want to begin this work within the next two weeks and
would hope that your Council will act on approval of this
matter on Monday night so that all that is remaining is the
formal signing of the Joint Powers Agreement. Beoause of the
time constraints we are operating under in this case, I will
begin to initiate a formal Supplemental Agreement to Contract
Number 88004, immediately. Said Supplemental Agreement will
not be effective until signed by Anoka County, which I expect
could happen by Wednesday or Thursday of next week.
Please contact me Tuesday morning after the City Council
Meeting and inform me as to the outcome of their decision on
the red brick.

On Thursday, April 20, 1989, bids were opened for the Street
Improvement Project No. ST. 1989 - 1& 2. This project covers the
following:
A. Curb, gutter and paving - Northco Drive
B. Curb, gutter and paving - University Ave. Service Road,
83rd Ave. to 500' north
C. Curb, gutter, paving & storm sewer - Commerce Lane, 73rd
Ave. to Osborne Rd.
D. Intersection improvements & signal - East River Road &
51st Way
Twenty (20) potential bidders reviewed the plans and specifications
and ten (10) bids were received. The low bidder was Gammon Bros.,
Znc. of Rogers, MN, with a bid of $670,628.34. The low bidder's
background was checked and found to be acceptable.
Recommend the City Council award the contract for Street
Improvement Project No. ST. 1989 - 1& 2 to Gammon Bros., Inc.
$670,628.34, conditioned on State approval of offsystem monies for
the City's 50 percent share of the cost for the signal installation
at East River Road and 51st Way. (Refer to relating resolution
appropriating M.S.A.S. funds).

BIIBJECT: DICTATION RESOLIITION
Attached is a resolution to be signed by the Mayor and the City
Council authorizing advertising for bids for Municipal Center
dictation system.
Do to an oversight, we failed to secure prior authorization from
the Council to advertise for bids. The advertisement was placed
in the Fridley Focus of April 19 and 26, 1989. Bids will be opened
May 11 and presented to the Council on May 15, 1989.
I regret any inconvenience caused by this omission of a required
step in the bidding process.

RESOLIITION TO ADVERTISE FOR BIDS FOR
MIINICIPAL CLAiTER DZCTATION EQIIIPMENT
BE IT RESOLVED by the City Council of the City of Fridley as
follows:
1. That it is in the interest of the City to award bid
contracts for the following items or materials:
ONE (1) MUNICIPAL CENTER DICTATION EQUIPMENT
2. A copy of the specifications for the above-described
items and materials, together with a proposal for
the method of purchase and the payment thereof have
been presented to the Council by the City Manager
and the same are hereby approved and adopted as the
plans and specifications, and the method of
acquisition and payment to be required by the City
with respect to the acquisition of said items and
materials.
3. The purchase of said items and materials as
described above shall be effected by sealed bids to
be received and opened by the City of Fridley on the
11th day of May, 1989. The City Manager is directed
and authorized to advertise for the purchase of said
items and materials by sealed bid proposals under
notice as provided by law and the Charter of the
City of Fridley, the notice to be substantially in
fona as that shown by Exhibit "A" attached hereto
and made a part of by reference. Said notice shall
be published at least twice in the official
newspaper of the City of Fridley.

55432 (tel. 571-3450) on Thursday, the iith day oi Kay, 1989, at
11:00 a.m., for the furnishing of MUNICIPAL CENTER DICTATION
EQUIPMENT :
All in accordance with the dictatinq equipment specifications
prepared by William Burns, City Manager, 6401 University Ave., NE.,
Fridley, Minnesota, 55432 (tel. 571-3450).
The dictating system specifications may be examined at the office
of the City Manager and copies may be obtained for the Contractor's
individual use by applying to Terrance Kucera, Media Specialist.
Bids must be made on the basis of cash payment for work, and
accompanied by a cash deposit, certified check (on a responsible
bank in the State of Minnesota) or a bidder's bond made payable
without conditicn to the City of Fridley, Minnesota, in an amount
of not less than five percent (5�) of the total amount of the bid.
The City Council reserves the right to reject any and all bids and
to waive any informalities in any bids received without
explanation.
All bids must be submitted in sealed envelopes and plainly marked
on the outside with BID OPENING FOR 1�IDNICIPAL CENTER DICTATION
EOIIIPMENT.
No bid may be withdrawn for a period of sixty (60) days.

N., Minneapolis, MN, 55443.
We have viewed the work under contract for the construction of
Commons Fark Filtration Plant Project No. 164 and find the same is
substantially complete in accordance with the contract documents.
I recommend that final payment be made upon acceptance of the work
by your Honorable Body and that the two-year contractual
maintenance bond commence on the date listed above.

This is to certify that items of the work shown in the statement
of work certified herein have been actually furnished and done for
the above-mentioned projects in accordance with the plans and
specifications heretofore approved. The final contract cost is
$1,421,671.00 and the final payment of $6,570.00 for the
improvement project would cover in full, the contractor's claims
against the City for all labor, materials and other work down by
the contractor under this project.

We, the undersigned, have inspected the above-mentioned project and
find that the work required by the contract is substantially
complete in conformity with the plans and specifications of the
project.
All deficiencies have been corrected by the contractor. Also, the
work for which the City feels the contractor should receive a
reduced price has been agreed upon by the contractor.
So, therefore, we recommend to you that the City approve the
attached FINAL ESTIMATE for the contractor and the two-year
maintenance bond, starting from the day of the final inspection
that being April 14 198 .
