RES 1990-81 - 00003982196 RESOLUTION NO. 81 — 1990 RESOLUTION APPROVING A CORRECTED LEGAL DESCRIPTION FOR A SUBDIVISION, LOT SPLIT, L.S. #89-01, TO CREATE A SEPARATE PARCEL FOR A SINGLE FAMILY HOUSE, GENERALLY LOCATED AT 1501 RICE CREEK ROAD N.E. WHEREAS, the City 1990 meeting; and Exhibit A; and Council approved a lot split at the February 12, the Planning Commission stipulations attached as WHEREAS, Resolution No. 12 -1990 identified legal descriptions for Parcel A and Parcel B as was submitted in the Certificate of Survey prepared by Bolton and Menk, Inc. dated January 24, 1990; and WHEREAS, the petitioner has determined that the legal descriptions must be corrected in order to record the lot split; and WHEREAS, the City has received a revised Certificate of Survey from the petitioner; and WHEREAS, the corrected legal descriptions are as follows: Parcel A: The West 132 feet of the South 152 feet of the Northeast Quarter of the Southeast Quarter, Section 13, Township 30, Range 24, Anoka County, Minnesota, also being the Qest 132 feet of the South 152 feet of Lot 4, Auditor's Subdivison No. 22, according to the map or plat thereof on file and of record in the office of the County Recorder in and for Anoka County, Minnesota. Parcel B: The West 132 feet of the South Half of the South Half of the West Half of the Northeast Quarter of the Southeast Quarter, Anoka County, Minnesota, except the South 152 feet thereof; also being the West 132 feet of the South Half of Lot 4, Auditor's Subdivision No. 22, according to the map or plat thereof on file and of record in the office of the County Recorder in and for Anoka County, Minnesota, except the South 152 feet thereof. WHEREAS, approval of this resolution will create the two separate parcels as authorized in the L.S. #89 -01 case. 197 Page 2 -- Resolution No. 81 - 1990 1 NOW, THEREFORE, BE IT RESOLVED, that the City Council directs the petitioner to record this lot split at Anoka County within six (6) months of this approval or else such approval shall be null and void. The certificate of survey shall indicate a suitable building elevation for connection to the city sewer. The elevation shall be reviewed and approved by the Public Works Department prior to issuance of a building permit. 2. A grading and drainage plan shall be submitted with the building permit application for approval by the Public Works Department prior to issuance of a building permit. 3. The driveway location must be approved by the Public Works Department prior to issuance of a building permit. 4. The petitioner shall execute appropriate utility easements as requested by the City or by the Cable TV company. 1.98
