RES 1992-17 - 0000338151 RESOLUTION NO. 17 - 1992 ' A RESOLUTION IN SUPPORT OF SPECIAL LEGISLATION FACILITATING THE CREATION OF A NULTI- JURISDICTIONAL SENIOR CENTER WHEREAS, the cities of Fridley, New Brighton, Spring Lake Park and Mounds View have investigated the feasibility of creating a Multi - City Senior Center; and WHEREAS, the joint cities have found that they can provide for senior services on a cost effective basis, by joining together and consolidating services; and WHEREAS, the cities have determined that special legislation is required to facilitate the organization and operation of the Senior Center; and WHEREAS, the four cities recognize that a joint powers agreement will be developed and executed to define the obligations and operations of the Senior Center; and WHEREAS, the four cities find that it is their best interest to pursue the special legislation to create an opportunity to provide a cost effective means for senior programming. ' NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fridley supports the attached special legislation contained in Exhibit A, to provide for a Multi -City Senior Center. PALA - CrTY CLERK LI Page 2 -- Resolution No. 17 - 1992 EXHIBIT A A bill for an act relating to certain cities; authorizing the cities of Fridley, Mounds View, New Brighton, and Spring Lake Park to participate jointly or cooperatively in the establishment and operation of a senior citizen activity and recreation center and related facilities; authorizing the issuance of bonds; authorizing tax levies. 52 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. (DEFINITIONS.) Subdivision 1 For the purposes of sections 2 to 5, the following terms have the meaning given them. Subd 2 "Agreements" means any of the agreements described in section 2. ' Subd 3 "Bonds" means of the obligations described in section 3 to finance the senior center in whole or in part. Subd 4 "Cities" means any two or more of the following cities: the city of Fridley, the city of Mounds View, the city of New Brighton and the city of Spring Lake Park. Subd 5 "City" means any one of the cities. Subd 6 "Current senior levy" means for each city. the aggregate of current expenditures by that city for senior activities and programs specifically, $70.750 for Fridley, $12,700 for Mounds View, $58.000 for New Brighton and $2,257 for Sprina Lake Park. Subd 7 "Senior center" means a building and related improvements and facilities designed for senior citizen /mature ' adult programs activities and services. I� 53 Page 3 -- Resolution No. 17 - 1992 Sec. 2. (AUTHORIZATION.) The cities may iointly undertake the acquisition, construction eauiPRing furnishing financing operation and maintenance of a senior center and enter into agreements related thereto including without limitation agreements of the kind described in or contemplated by sections 471.16 and 471.59 or other law. Sec. 3. (BONDS.) The cities or a city may issue general obligation bonds or other obligations in one or more series to finance the costs of the senior center including allowance for capitalized interest, issuance costs debt service reserves, and similar costs. The bonds if general obligation bonds must be issued under Minnesota Statutes chapter 475 except as otherwise provided in this section Notwithstanding any contrary city charter provision or general or special law, the bonds may be issued and sold without submission of the question of their issuance to the voters of the cities or city. The bonds shall not be included in the net debt of any city and shall not be subiect to other statutory or home rule charter limitations or indebtedness. All obligations made or undertaken by any city in the agreements shall be valid and binding obligations of that city and shall constitute "obligations" of that city within the meaning of Minnesota Statutes, section 475.51, subdivision 3 for which no referendum of similar election approval shall be required. n 54 Page 4 -- Resolution No. 17 - 1992 Sec. 4. (TAX LEVIES.) Each city may impose yearly ad valorem tax levies on the taxable property within its jurisdiction to nay its obligations under the agreements including without limitation debt service on bonds and all other expenses associated with the completion._ operation, and maintenance of the senior center. Each city's levies (a) made for debt service on bonds or (b) made M under the agreements for purposes other than debt service on bonds. or (ii) for other senior activities or programs (but on1V to the extent that the sum of (i) and (ii) exceeds that city's current senior levy) shall not be subject to any limitation on tax levies or similar statutory or home rule charter levy limits, and shall be deemed to be special levies under Minnesota Statutes. section 275.50. subdivisions 5 and 5a, and shall not be subject to any limitation under section 275.51 or 275.56 or other levy limitation. Sec. 5. (POWERS; LIMITATIONS.) The powers granted in sections 2 to 4 shall not be limited in procedure or substance by any home rule charter provision otherwise applicable. Sec. 6 (EFFECTIVE DATE.) This act is effective for each city the day after compliance by that city's governing body with Minnesota Statutes, section 645.021. subdivision 3.
