DECK INTO A DRAINAGE EASEMENT
OF A

WHEREAS, Kenneth P. Schultz and Holly M. Schultz desire to
construct an open deck at 11 Rice Creek Way N.E., legally described
as Tract B, Registered Land Survey 442 (PIN 15- 30- 24 -11- 0030),
Anoka County, Minnesota; and
WHEREAS, the proposed deck will extend into the ten foot drainage
easement approximately two feet; and
WHEREAS, the City is willing to allow the construction provided
that it is released from liability for such construction.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Fridley:
1. That the owners, their successors, heirs, assigns, and all
subsequent owners of the property herein described, hereby
agree to indemnify and hold harmless the City of Fridley for
any and all liability caused by the construction of the deck
on Tract B, Registered Land Survey #42, Anoka County,
Minnesota; and
2. That an executed copy of this agreement shall be filed with
the Anoka County Recorder's office and made a part of and be
binding upon the above described property.
