RES 1993-100 - 00003310' RESOLUTION NO. 100 - 1993 RESOLUTION REQUESTING VARIANCE FROM MINNESOTA DEPARTMENT OF TRANSPORTATION DIVISION STATE -AID OPERATIONS RULES, CHAPTER 8820.2800, SUBP. 2. ON NUMEROUS MN /DOT SIGNAL IMPROVEMENTS IN FRIDLEY 135 WHEREAS, plans, specifications and agreements were prepared by MN /DOT for numerous traffic signal improvements along T.H. 47 and T.H. 65 in Fridley noted as follows: using Municipal State Aid and Off- System Funds; and WHEREAS, the City of Fridley was not aware that MN /DOT had not submitted their plans to the State Aid Office for review and approval; and WHEREAS, Minnesota Rules, Chapter 8820.2800, Subp. 2 reads in part "... only those projects for which final plans are approved by the State Aid Engineer before awarding a contract... are eligible for State -Aid Construction Funds. "; and WHEREAS, the City is relying on State Aid Construction Funds to finance the City's total costs of the above mentioned signal improvements, including, but not limited to, interconnects, emergency vehicle pre - emption, internally lit street name signs and lighting; and WHEREAS, the City will be severely economically impacted without the anticipated State Aid funding. NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Fridley, Anoka County, Minnesota, does hereby request a variance from MN /DOT rules for State Aid operations pursuant to Chapter 8820.3300 from said Chapter 8820.2800, Subp. 2 as noted, and requests the above City costs be totally reimbursed to the City of Fridley from the State Aid Construction Fund.
