WHEREAS, the City of Fridley desires to improve the following streets:

Benjamin Street
Benjamin Street
Fillmore Street
Limits Variance Required
61st Ave to Rice Creek Rd Right -of -way
Gardena Ave to 61st Ave
53rd Ave to Cheri In
Cheri lane 53rd Ave to Fillmore St
using Municipal State Aid Funds; and

and horizontal curves
WHEREAS, the Minnesota Department of Transportation rules for State Aid operations,
Chapters 8820.9935, 8820.9945 and 8820.2500 address the design speed in critical
curve areas and the required 60 foot right -of -way, respectively; and
' WHEREAS, the streets in question were built to their existing grade and right -of-
way widths between 20 and 30 years ago and adjoining properties have been totally
developed for over 20 years; and
WHEREAS, the existing street right -of- ways, grades and alignments are totally
functional to ac= miodate present and projected traffic on the streets in question;
and
WHEREAS, the City of Fridley believes there are other compelling reasons for
maintaining the existing right -of -way width, grades and alignments without affecting
safety or traffic conditions.
NOW, THEREFORE, BE IT RESOLVED THAT, the City of Fridley, Minnesota, does hereby
request variances from Minnesota Department of Transportation rules for State Aid
operations, Chapters 8820.9935, 8820.9945 and 8820.2500, to allow for street
inprovements of the above mentioned streets with their existing right -of -way widths
and approximate same grades and alignments.
