RES 1993-49 - 0000323363 RESOLUTION NO. 49 - 1993 RESOLUTION DETERMINING THE NECESSITY FOR AND AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTIES BY PROCEEDINGS IN THE EMINENT DOMAIN WHEREAS, the City of Fridley in joint agreement with the City of New Brighton and the Department of the Army has agreed to construct a municipal water interconnection line, and WHEREAS, this interconnection requires the construction of a booster station for receipt and dispersal of water, and WHEREAS, Outlot B of the Shorewood Plaza Plat has been identified as the best site for the booster station, and WHEREAS, the City has attempted to negotiate the purchase of this parcel with Quality Growth, Inc., and WHEREAS, Quality Growth, Inc. has not accepted the City's offers, and WHEREAS, the City Council has heretofore determined that time is of the essence to acquire this vacant property for the placement of a watermain booster station. NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Fridley, Anoka County, Minnesota, as follows: ' 1. Acquisition by the City of the following described property is necessary for the purpose of constructing a booster station in conjunction with a 20- inch watermain improvement project: Outlot B, Shorewood Plaza 2. Acquisition of the above described real estate has been attempted unsuccessfully through negotiations and the City Attorney is hereby authorized and directed on behalf of the City to exercise the power of eminent domain pursuant to Minnesota Statutes, Chapter 117, and is specifically authorized to notify the owners of intent to take the earliest possible possession pursuant to Minnesota Statutes, Section 117.042. The City Attorney is further authorized to take all actions necessary and desirable to carry out the purpose of this resolution. 3. That the expenditure of $12,500 is hereby authorized and approved as an appraisal of damages to the subject property and represents the City's approved appraisal of value.
