RES 1993-98 - 00003308RESOLUTION NO. 98 - 1993 RESOLUTION REQUESTING VARIANCE FROM MINNESOTA DEPARTMENT OF TRANSPORTATION RULES AND STATE AID OPERATIONS TO ALLOW STREET IMPROVEMENTS WITH 50 FOOT RIGHT -OF -WAY WIDTHS WHEREAS, the City of Fridley desires to improve the following streets: Street Limits Camelot Lane Arthur Street to Squire Drive Squire Drive Rice Creek Road to Camelot Lane using Municipal State Aid Funds; and Existing Right -of -Way 50' 50' 133 WHEREAS, the Minnesota Department of Transportation rules for State Aid operations, Chapter 8820.2500 Subp. 3 requires that urban State Aid streets have a minimum 60 feet of right -of -way; and WHEREAS, the streets in question were platted in 1973 and adjoining residential properties have been totally developed for over 20 years; and WHEREAS, the existing street right -of -ways are functional to their present roadway and right -of -way widths; and satisfy the current required minimum State Aid roadway widths; and WHEREAS, the City of Fridley believes there are other compelling reasons including, but not limited to; legal conforming status, property sales mortgages, trees and shrubbery and landscaping facilities, for maintaining the existing right -of -way widths without affecting safety or traffic conditions. NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Fridley, Anoka County, Minnesota, does hereby request a variance from Minnesota Department of Transportation rules for State Aid operations, Chapter 8820.2500 Subp. 3, urban State Aid street 60 foot minimum right -of -way requirements, to allow for street improvements of the above mentioned streets with their existing right -of -way widths.
