RESOLUTION NO. 23 - 1995
RESOLUTION APPROVING MINNESOTA DEPARTMENT OF TRANSPORTATION
LIMITED USE PERMIT FOR THE UNIVERSITY AVENUE BIKE PATH FROM 73RD
AVENUE NORTH TO 85TH AVENUE
WHEREAS, on February 27, 1995 the City Council approved the submission of
Minnesota Department of Transportation (MnDOT) permit application for the
referenced bike path project, and
WHEREAS, The City has received ISTEA funds for 508 of the cost of the project
not -to- exceed $60,000.00, and
WHEREAS, Resolution No. 44 -1993 authorized the use of Municipal State Aid
Funds for this municipal off system bike path project, and
WHEREAS, the City Council authorized the preparation of plans and
specifications for the above mentioned bike path with the award pending
Federal Funding of the project, and
WHEREAS, the pathway is proposed to be constructed on MnDOT right -of -way on
the west side between 73rd Avenue and 85th Avenue, and
WHEREAS, MnDOT requires a Limited Use Permit for all new facilities to be
located within its rights -of -way, and
' WHEREAS, MnDOT will advertise the improvement and award the contract for this
work, and
WHEREAS, the City will be responsible for inspecting the construction and its
share of the improvement costs.
NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Fridley,
Anoka County, Minnesota, approves MnDOT's Limited Use Permit for the
construction of the University Avenue bike pathway.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 10TH DAY OF
APRIL. 1995.
