RES 1995-43 - 0000289165 RESOLUTION NO, 43 - 1995 A RESOLUTION APPROVING THE SPECIAL LAWS AUTHORIZING THE CREATION AND IMPLEMENTATION OF A HOUSING REPLACEMENT PROGRAM WHEREAS, 1995 Minnesota Laws, Chapter 264, Article 5, Sections 44 through 47 (the "Special Laws ") were enacted by the Legislature of the State of Minnesota and signed into law by Governor Arne Carlson on June 1, 1995 and relate to the creation and implementation of a housing replacement program within the City of Fridley, Minnesota (the "City "); and WHEREAS, Minnesota Statutes, Section 645.021, subd. 2, provides that special laws shall not be effective without approval of the local governmental unit; and WHEREAS, Minnesota Statutes, Section 645.02 provides that a special law is required to be approved by the local governmental unit affected before it becomes effective and, upon approval by the affected local government unit, will be effective the day following the date on which the certificate of approval required under Minnesota Statutes, Section 645.021, subd. 3, is filed with the Secretary of State, unless a later date is specified in the Act; and WHEREAS, the Special Laws do not provide for an effective date which is later than the day following the date on which the certificate of approval is filed with the Secretary of State. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley, Minnesota, as follows: 1. The Special Laws are hereby approved. 2. The City Clerk is hereby directed to file certificates of approval for each of the Special Laws with the Secretary of State, including a certified copy of this resolution with each certificate. 3. The Special Laws are effective the day after the date of the certificates of approval are filed with the Secretary of State.
