By this action, the petitioner will expand his side yard from 11 feet to 31 feet, and presumably will enable the construction of a future deck. While the lot split does reduce the size of an aiready non-conforming lot from 8,600 square feet to 7,600 square feet, it is stafis opinion that the reduction does not adversely impact the useable area of 670 Dover Street. AND, RECEIVE BiDS FOR THE IMPROVEMENT OF INTERSTATE HIGHWAY I-694 N E RAMP TO TRUNK HIGHWAY 47 (UNIVERSITY AVENUE), PROJECT NO. ST. 1997-3 (WARD 1): • The City has prepared plans and specifications for the ramp upgrade. Council authorized solicitation of bids for the�project, and staff opened bids on July 18, 1997. The low bid . ,,was submitted by Forest Lake Construction at $453,496.01. In addition� receiving and awarding the bid, Council is being asked to approve an agreement with MnDOT. This agreement establishes that the City administers the project while the State provides funds and inspects the project. Staff recommends that Council approve the agreement with MnDOT, receive the bids, and award the contract for the construction of the I-694/TH47 ramp improvements to Forest Lake Construction for $453,496.01. RESOLUTiON IN SUPPORT OF AN APPLICATION FOR A MiNNESOTA LAWFUL GAMBLING PREMISE PERMIT TO CLiMB THEATRE COMPANY _ (MAPLE LANES, 6310 AiGHW�AY 65 N E)(WARD 2)• CLIMB Theatre Company would replace Totino-Grace High School as the holder of the lawful gambling premise permit for Maple Lanes. CLIMB is a nonprofit theater company that provides instruction to elementary and secondary school audiences. Topics include violence prevention, substance abuse and addiction, sexual harassment, and conservation (recycling). They are located in St. Paul, and have done work in the Fridley, Anoka- Hennepin, Spring Lake Park and Brooklyn Center School Districts. This fall, they are doing a five-day workshop on acceptance at Woodcrest Elementary. They expect to benefit Fridley residents by providing their children with effective programming. OPEN FORUM, VISTTORS: �� Anoka Countv Sheriff, Larry Podany _.,s� _,,.,,�, :�.w,� � _ - . - � . _ ;;�"= •� ;�. _, . Sheriff Podany addressed Council by providing a review of the Anoka County Sherif�s Department and its support role for area cities. Services include a crime lab cunently available 16 ' hours a day. The crime lab responded 49 times in the Fridley area last year and 20 times to date in 1997. The Multi-Agency Drug Taskforce has seized cash, weapons and vehicles in 36 cases this year. The Anoka County Detention Facilities processes about 10,000 people a year, including 800 persons from the Fridley Police Department last year. Anoka County Investigators participated in 130 cases in Fridley last year and 47 cases so far in 1997. The Special Weapons . Team responded to a Fridley call last year to assist the police in obtaining a suspect; however the suspect committed suicide. The Drug Enforcement Council works with training and central'�� records to share information. Other programs provided by the Sherif�s Department include a senior program called, "Are You Ok?" C.A.T. (Catch Auto Thieves) and the water safety program which included the construction of boathouses on the Mississippi River and Lake � FRiDLEY CiTY COUNC�L MEETiNG OF JULY 28 1997 PAGE 6 George. The Sheriff's Department has received a grant for an Auto Theft Taskforce, to share information with area enforcement orpanizations to reduce auto theft. Copies of the County newsletter and S�ieriff's Report are�vailable for further information. � �" Councilman Billings asked if an analysis beer�.,done on user services by area/revenue. Sheriff Podany reported that the County is, in the process of conducting this analysis to evaluate if revenue and services are equally distributed. Councilman Barnette inquired about the cost of the proposed communication system. Sheriff Podany explained that the State is looking at utilizing a 800 MHZ communication system for counties and cities to join into at a total cost of $11 million. Anoka County will address this issue during the next eighteen months. The Central Record System Grant will provide a service for all cities to access the databases of Anoka County, thus saving time and providing necessary reports for the courts. Jerrv Johnson, 1298 52nd Avenue; Mike Teske, 1280 52nd Avenue Mr. Johnson addressed Council about the continuing storm sewer runoff problem. Six years ago i�:e a: �a had a prabl�,, in wh;�h a neiv averflow system was ;nstalle�. The ur�erground storm sewers meet in the Johnson and Teske backyards. Mr. Johnson reported that the last work completed appears to need some type of modification, as the result of the recent rain storms as water was holding in their yards (waist deep). It appears that there are a few solutions to address the problem, and the gentlemen wanted to make sure that the problem is addressed in a timely manner. , Councilman Billings reported that Council is looking at alternatives, such as jacking a piece of pipe through the berm located at Bill Levy's property as well as cost factors. The last time this issue was addressed, the City thought it had solved the problem. However, the July storms are not usual and there have been some torrential rain. The City will continue to look at the problem; however, we may not be able to do enough to guarantee that this problem could be completely eliminated. . . • - Mag�ie Nelson, 6090 Woodv Lane Ms. Nelson addressed Council on July 14th regarding storm sewer problems in her yard. She was there again to request a status report. Mr. Flora, Public Works Director, reported that the problem is being investigated. One solution that may work is to lay a second storm. water line prior to repairing the retaining wall. The information will be presented to Council in the next few weeks. Mr. Burns, City Manager said that quotes will be obtained and spending issues will be discussed. FRTDLEY C�TY COUNC(L MEETING OF JULY 28, 1997 PAGE 7 Karl Foster, 8161 East River Road Mr. Foster addressed Council about his unique mail box located on East River Road. He has been informed by Anoka County to remove the Model T mailbox. Therefore, Mr. Foster is . requesting input from the City Council; as he intends to relocate the Model T further back in his . yard and put a mannequin inside it to serve as a tribute to the postal service. Councilman Billings stated that the issue could be interpreted as outdoor storage; and therefore, it is not prohibited. Secondly, this might be a tribute to the U. S. Postal Service, but, at the same time, the reason for the ordinances are to try to maintain a pleasant atmosphere in the city. Other residents may not appreciate the tribute. Mayor Jorgenson suggested that Mr. Foster contact Mr. Hickok for additional information regarding ordinances. 1l. VARiANCE REQUEST BY JOHN AND JOETTE ZEMBAL, TO REDUCE THE _ SETBA�K OF AN ATTACAED GARAGE FROM 4 FEET TO 3 FEET, TO ALLOW THE CONSTRUCTiON OF A 7 FOOT X 38 FOOT ADDiTiON TO AN EXiSTING SiNGLE CAR GARAGE, GENERALLY LOCATED AT_ 6821 SEVENTH STREET N.E. (WARD 1): Mr. Hickok, Planning Coordinator, presented the variance request of John and Joette Zembal requesting a variance be granted to reduce the side yard setback of an attached garage from 4 feet to 3 feet. If the variance is granted the petitioners propose to construct a 7 foot by 38 foot addition to their existing single car garage. .,,; .� • _ �� The property is located on Seventh Street north of Mississippi Street which is zoned R-1, Single Family Residential. A single family dwelling was constructed in 1957 with a single attached garage. The code section wouid typically aliow the expansion of both garages to within 4 feet of the common lot line (8 foot total separation). If variances to both properties were granted, the separation could be reduced to 6 feet (3 foot setbacks) creating a"tunnel" between structures. The Appeals Commission action included comments from two residents who were opposed and two residents who were in favor. The Appeals Commission voted unanimouslq to approve the T�, ,�.re�quest with two stipulations. (that the addition comply with uniform building and fire codes requirements and that the addition be architecturally compatible with the existing dwelling.) Staff recommended that Council concur with the Appeals Commission. Councilman Barnette inquired about the nature of the neighbors' objections. Mr. Hickok reported that the neighbors were concerned that the single family character may not be maintained due to the lack of open space between the units; therefore, the neighborhood would take on a different feel. Councilman Billings requested ciarification that this variance is a request for one foot. Councilman Billings reported that he drove by the p�operty. In taking into consideration the ._ ^_ objections by the neighbor who is one block away from the said property and the maintenance of the surrounding properties, he recommended approving the variance request. RESOLUTION AUTHORiZING APPLICAT�ON FOR TAE LIVABLE COMMUNITIES DEMONSTRATION PROGRAM• AYDE PARK/57TR AVENUE IMPROVEMENT PROJECT (WARDS 1 AND 31• Barbara Dacy, Community Development Director, reported on the resolution authorizing application for the Livable Communities Demonstration Program. The Metropolitan Livable Communities Act provides funds for creative and innovative models of compact and effic,ient development. Over the last several months Council has discussed the improvement of _`7th Avenue in the Hyde Park neighborhood. This is a good example of mixed land ' uses with commercial, industrial and mixed densities all in one area. University Avenue is an existing transit corridor with a bus stop at 57th Avenue and University Avenue. RESOLUTION AUTHORIZING �NCLUSION OF STREET LIGHTS IN TAE INTERSECTION IMPROVEMENT PROJECT FOR TRUNK AIGHWAY 65/LAKE POINTE DRiVE/CENTRAL AVENUE (WARDS 1 AND 2): Ms. Dacy reported on the proposal to install 25, 40 foot tall, 400 watt high pressure sodium lights from East Moore Lake Drive to I-694 Interchange along Highway 65 approximately 150 feet apart. The history on this request is that the lights were included in the 1987 approval of ' intersection improvement plans. A 40 foot sharp angled pole with shoe box fixture was approved. _ ; The proposed street lights are commoniy referred to as "Shepard's Hook" design. The light fixture has flat glass, pointed down, with the pole painted black or bronze. The lights installed will add an amenity to an area to identify Fridiey while decorating the highway to improve the City's image. It will also improve driving visibility during the evening. It is most cost effective to install the l:ghts while the intersection is under construciion. The cost is $120,000 with the City and the HRA sharing costs at $60,000 each. The City will be responsible for operating costs of $6,000 to $8,000 annually. The HRA will consider a similar resolution on August 14, 1997 meeting. An ir�fot-mational hearing was held on July 10, 1997 at the Houstng and Redevelopment Authority regular meeting regarding the proposal to install 40 foot tall street lights along Highway 65. Eight persons spoke in opposition to the proposal. There was no testimony in support of the proposal. Councilwoman Bolkcom inquired if the neighborhood was informed that the resolution would be on the agenda this evening. Ms. Dacy reported that the July 28 date was announced at the HRA meeting. Mayor Jorgenson inquired if this is a budgeted item. Councilman Billings replied negatively. He said that it would have to be budgtted for the1998 budget; therefore, it requires three votes. : ,�, Councilman Barnette reported that he attended the July lOth meeting and heard the opposition of the residents. Councilman Barnette expressed his support of the resolution in response to the concern for image as a necessity to market the Fridley area. In 1965 the area was destroyed. Shortly after the tornado Fridley rebuilt very well. During the urban renewal term, an attempt was made to rebuild University Avenue, but it did not happen. Perhaps now is not the right time to proceed with this project since Council does not have the consensus of the community. Therefore, Councilman Billings recommended that the issue be set aside to a later date. Mayor Jorgenson reported that Fridley's image is a topic that does need to be addressed. However, this is a state highway, and the $60,000 along with the $6,000 to $8,000 annual operation costs should come from the state. Councilwoman Bolkcom inquired if the State of Minnesota has been contacted regarding lighting. Ms. Dacy reported that the State provides lighting on interstate highways only. In response to the adoption of the ordinance, staff mailed letters to individuals who were listed as owners of properties without hardsurface driveways. The letter included options for individuals who had indicated an interest in being invo�ved with a Cit�r contract for driveway paving. By July 15, 1997, staff had received 44 requests from individuals interested in the possibility of participating in a bulk contract. The lowest bid was somewhat higher than anticipated; however, these prices are still somewhat lower than if individuals were to privately contract with a driveway installer. The 44 people who had responded have now been asked to indicate their preference as to being assessed, to paying "up fronY' (either cash or a 5% loan), or to pass on the bulk contract at this time. A minimum of 20 driveways will be required to secure the listed prices from our contractor: Seventeen have signed up already, and staff anticipates that there will be a. commitment for at least 20 driveways so that the contract will be able to be awarded on August 11, 1997. This driveway project has been an excellent example of a coordinated effo�t between departments and various staff. Annexation and Detachment Conceming Commissioner Districts 5 and 6 This is in response to your memo dated May 15, 1997, and our conversation on June 2, 1997, regarding the annexation and detachment of certain property from the City of Coon Rapids to the City o,f Fridley. In your memo, you ask whether �he boundaries of Commissioner Districts 5 and 6 can simply be adjusted to reflect the new city boundaries created by the detach�nent and annexation proceedings. In my opinion, such an adjustment of the commissioner districts would amount to a"redistricting plan" as descnbed in Minn. Stat § 375.025 (copy attached). Thus, the county would need to comply with the statutory requirements of a redistricting.plan as set forth in that statute. For example; the county would need to publish tt-►ree weeks notice that it intended to consider a change in the boundaries of the commissioner districts. While there is nothing improper with choosing this. alternative, it may not be the preferable way for your oftice to deai with tne situation create� by t�;e ar.r.exa:ier./c�etachment, particularly in light of the fact that there will be only two more commissioner election years before ihe 2001 federal census is performed again and redistricting will necessarily occur. On �,tuly 14, 1997, the City Council tabled action on the Home Depot special use permit request for an ou#door garden center. The City Council was interested in having Home Depot representatives who were at the meeting coordinate with City staff in preparation of a plan for integrating their ; garden center into the architecture of their site. The City has required other retailers seeking special use permits for outdoor sales to integrate their sales area architecturally. Home Depot was asked to do the same. The City Council also informed the representatives that they should take the City's message of integration of the safes area to their corporate office in Atlanta. � To date, there has been no attempt by either those representatives at the meeting or Home Depot's corporate office in Atlanta to work with the City on a plan for architectural integration of the . reta�ler's addifiional outdoor sales area. ° . The City Council also asked at the July 14, 1997 meeting for the 60 day action deadline date. That deadline is August 16, 1997. Should the City Council decide to approve the request, a list of suggested stipulations is attached. RECOMMENDATION Due to the lack of additional information regarding the plan for architecturat integration of the outdoor sales area into the building, staff recommends that the City Council deny the request for a special use permit. This denial is consistent with the Planning Commission's recommendation "� �` r� regarding the request. - � The City Council should act on this item on August i 1, 1997 due to the agency action deadline. The sales area will be enclosed by chain link fence and will contain live materials, bagged goods, and landscape materials. SUMMARY OF ISSUES ISection 205.15.01.C.(11 j of the Fridley City Code requires that a special use permit for garden centers or nurseries which require outdoor display or storage of inerchandise. When Home Depot was originaJty approved in Fridley, the City approved the project with the original stipulation that no pfar�"t sales were to occur outside of the confines of the garden center: Home Depot agreed to the stipulation. Currently, the petitioner is indicating that "Home Depot has seasonal, parking lot sales, in their stores everywhere else in the Country. Home Depot sees this as an essential part of what they do". The property is approximately 11.6 acres in area and is zoned C-3, General Shopping Center. Located on the property is a 103,550 square foot Home Depot store, a 27,972 square foot garden center, and a 26,600 square foot PetsMart store. The property was replatted in 1995 when Home Depot was constructed. ANALYSIS .,� �. Section 205.15.01.C.(11) of the Fridley City Code requires that a special use permit be issued for garden centers or nurseries which require outdoor display or storage of inerchandise. The proposed garden sales area is located in the southeast corner of the Home Depot parking lot. The area is 100' x 220' and would eliminate 88 parking stalls in finro parking aisles for a period of about 10 weeks on an annual basis. The sale area is proposed to be surrounded by a six foot high temporary cyclone fence. Located within the sales area will be a combination of live materials, bagged goods, and landscape materials (timbers, retaining wall blocks, etc.) �.0 ' 9.os Project Summary SP #97-02, by Home Depot USA Page 4 Home Depot received a special use permit in 1995 in order to allow the existing garden center area which is 27,972 square feet in area. This garden center includes hoop houses, house plant enclosures, and racking for other materials. The garden center area is enclosed by a masonry wall with a wrought iron fence at the front. At the time of the original Home Depot approval, a stipulation was placed on the store that there be no outdoor sales of plant material outside of the confines of the garden center. Home Depot agreed to the stipulation, but, has now indicated that parking lot/seasonal sales are an, "essential part of what they do". If outdoor sales is an essential part of what Home Depot does, the use should have been planned for initially as part of the original construction. The act of coming back to the City after the store is complete and after the parking lot circulation routes are planned and installed, places both the City and fhe re�tailer in an awkward position of having ta consider what appears to be a planning after-thought which carries a high, aesthetic and safety price tag. Photos have been included and a video will be made available at the Planning Commission illustrating stores where parking !ot garden centers exist. The proposed sale area doubles the size of the garden center. If Home Depot desires additional garden center area, it should be incorporated into the existing garden center location as was required of Wal-Mart in 1994. This could be accomplished in a number of ways including but not limited to: 1. Expand the existing garden center 148' to the east, reworking the traffic and circulation flow of the existing parking lot. 2. Expand the entire front or easterly facade 445' x 49' of the Home Depot building itself through the use of an atrium type structure which would provide 22,000 square feet of additional retail area which could be dedicated to garden center sales. The difficulty is that the sale area takes up parking spaces that would have been convenient to the store or garden center. The circulation of vehicles in the parking lot remains largely the same, however, patrons will enter and exit the display area directly into traffic, crossing parking aisles and traffic lanes in unanticipated locations. Developments should be completed in a manner to separate pedestrian and vehicle traffic. Placing a garden center display where parking is supposed to be, blurs the distinction between vehicle and pedestrianways, creating a safety concern for pedestrians. Hoses for watering are also required to be dragged across the circulation areas causing another unanticipated interruption. From a security standpoint, anytime merchandise is left outside of the confines of a store, the risk of fheft increases, adding unnecessary burden to the Police Department. , From an aesthetic standpoint, the City has been very careful to insist on quality building materials, landscape materials, lighting standards, and continued maintenance of the 9.07 Project Summary SP #97-02, by Home Depot USA Page 5 development area. Similar requests for outdoor storage and display have either been modified through stipulations placed on a specia! use permit, or denied entirely. --x , �_i_ . In further reviewing Home DepoYs request, staff contacted other communities with Home De ot stores. p To follow is a listing of those communities and the responses regarding their existing and any outdoor sales by Home Depot. Brooklyn Park In Brooklyn Park, no parking lot sales �re��pefmitt�d: Their`�g�rden `cerif�i� i� �7`,��2°��c��uare feet in area. In March, Home Depot requested additional space in the parking lot for pallet storage of bagged materials and other items to be sold. The Planning Cornmission and City Council of Brooklyn Park denied the request for additional sales and storage space in the parking lot, and required Home Depot to confine all garden center sales items to within the existing garden center. They also required Home Depot to remove other items displayed outdoors, such as ya; d sheds, tractors, trailers, etc., inciuding the fence sections which were attached to the front of the building. Maplewood In Maplewood, limited outdoor sales are permitted. The City of Maplewood's Home Depot has an existing garden center of 28,000 square feet. In March, the City of Maplewood also approved a 50' x 50' extension of the garden center which is enclosed by a ten foot high chain link fence. Also approved was a 78' x 108' area in the parking lot which is also enclosed by chain link which allows temporary sales of bagged goods and other items associated with the garden center. Plymouth _ The City of Plymouth's Home Depot will not open until July 4, 1997; however, the built garden center area is 17,955 square feet in area. They wi11 be allowed outdoor safes if a special use permit is approved. Within their existing ga�den center area, they are not utilizing hoop structures; however, items are covered by greenhouse shade cloth. Coon Rapids Coon Rapids Code does not specify by code what is, or is not permitted related to parking lot sales. The Home Depot in the City of Coon Rapids includes a built garden center of 18,223 square feet surrounded by chain link fencing. Within the garden center area are hoop structures and storage buildings are currently being displayed on the sidewalk in front of �the +�Y building. If unauthorized sales occur, a 24 hour notice is given to clean up the parking lot. If sales occur again within a 3 month period, a $1,000 per day fine is paid to the City from the escrow account without �further notice. Home Depot is then required to replenish tfiat accounf �so that the escrow �balance remains at $20,000. St. Louis Park No sales in the St. Louis Park Home Depot parking lot have occurred. Their garden center is 18,000 square feet in area. The garden center is completely screened by a brick bollard and ornamental metal fence such that only the top of the hoop structures can be seen from the parking lot or the adjacent public right-of-way. _ FRIDLEY COMMERCIAL AREA IMPROVEMENTS The City has recently seen an increase in commercial development in the 57th Avenue corridor. This commercial development includes Home Depot constructed in 1995, the proposed reuse of the Dick's Tire'and V1fi�reel store at 251 - 57'h Avenue, and the proposed 8,000 square foot retail center proposed to be located in the northwest corner of 5th Avenue and Main Street. If the proposed commercial developments occur along the north side of 57�' Avenue, the City intends to complete a 57th Avenue street improvement project in 1998. This improve"�nent projecf will include a widened 57`h Avenue medians, new street lighting, and new landscaping. Outdoor sales and display in a manner such as proposed by Home Depot could be considered contrary to the intent of the 57`h Avenue improvement project. STAFF RECOMMENDATION TO THE PLANNING COMMISSION The proposed garden center is contrary to the intent of the original special use permit, occupies a significant amount of the parking area, and creates tra�c conflicts with pedestrians. We asked for two separate bids: one for seven machines in the Municipal Center, City Garage, and Nature Center to be paid for out of the General Fund; and another for two machines in the Liquor Stores to be paid for out of the Liquor Fund. The bidders were to offer a price which included the trade-in of current machines. The new copy machines were to be guaranteed for five years, and the maintenance and supply agreement was to be firm for four years. An employee committee worked with a vendor to analyze needs and develop specifications. Another vendor challenged a number of the specifications as not really necessary or directed to one particular product line. We deleted all of those challenged specifications. GENERAL FUND (Seven Machines) We sent out requests for bids to thirteen (13) vendors and received seven responses. Copy Sales offered a bid on replacement of machines but did not indicate the cost of maintenance and supplies. Also their bid proposal amved one half hour after the published deadline for submittal of bids. Gestetner, Konica, and Stringer submitted bids which failed to meet one or more of the specifications. Using our current per copy rate for paper, machines, and maintenance, we estimated a total amount for acquisition of machines and four years of servicelmaintenance to be $91,384 for the seven copiers. CDP Imaging Systems' bid of $85,697.90 amounts to 93.8 percent of that figure. As a result, the City Council could receive the other three bids and award the contract to CDP Imaging Systems as the lowest qualified bidder. However, upon analysis of the i�ids submitted, it appears that by revising the specifications to eliminate some of the helpful but lesser used features on the two larger copy machines in the Copy Center and the Recreation Department the City could save as much as $17,000 over a four year period. Accordingly, I recommend that the City Council receive and reject all the bids and instruct staff to readvertise using the revised specifications. 10.01 Memorandum to William W. Our original estimate for two machines and four years of service and maintenance was about $5,260.
