RES 2003-63 - 00002402RESOLUTION NO. 63 -2003 RESOLUTION OF THE CITY OF FRIDLEY, MINNESOTA, APPROVING THE TRANSFER AND EXCHANGE OF CERTAIN PARCELS OF LAND WITH TOM MARCHIAFAVA AND DIANNA MARCHIAFAVA. WHEREAS, Tom Marchiafava and Dianna Marchiafava ( "the Marchiafavas") are the fee owners of Lots 21 & 22, Block 14 Spring Brook, Anoka County, Minnesota; and WHEREAS, the City is the fee owner of Lots 23 & 24, Block 14 Spring Brook Park, Anoka County, Minnesota; and WHEREAS, the two parcels of land are of approximately the same size; and WHEREAS, the Marchiafavas property is unbuildable due to the lots size; and WHEREAS, it is of mutual benefit to the City and the Marchiafavas to exchange portions of these lots to create two buildable lots; and WHEREAS, each of the lots created would have an equal amount of buildable area WHEREAS, the City found and continues to find that the proposed land exchanges are in the best interest of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY: 1. That the City convey to the Marchiafavas that real property described as that part of Lots 23 & 24, Block 14, Spring Brook Park, Anoka County, Minnesota, lying North of the South 107 feet. 2. That the City accept from the Marchiafavas the conveyance of the real property described as the South 107 feet of Lots 21 & 22, Block 14, Spring Brook Park, Anoka County, Minnesota. That the Mayor and City Manager are authorized to execute on behalf of the City any and all such documents and instruments as may be necessary to effect the foregoing on behalf of the City.
