RES 2004-27 - 00002267RESOLUTION NO. 2004 - 27 RESOLUTION RECEIVING FINAL PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS: WOODSIDE COURT STREET IMPROVEMENT PROJECT NO. ST. 2004 - 2 WHEREAS, Resolution No. 68 - 2003 ordered the preliminary plans, specifications and estimates of the costs thereof for the improvements in this project, and WHEREAS, the City Council of the City of Fridley approved on October 27, 2003 a Developers Agreement between the City of Fridley and Theodore Theilman, property owner of records, and Jeffrey Cruz, developer (hereinafter collectively called the "Developer ") in which the Developer waives any and all procedural and substantive objections to the installation of the public improvements and the special assessments, including but not limited to hearing requirements and any claim that the assessments exceed the benefit to the property, and WHEREAS, the City Council has reviewed the preliminary report and declares the improvement feasible, and WHEREAS, Resolution No. 69 - 2003 received the preliminary engineering report and set a public hearing for the improvements in this project, and NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Fridley, Anoka County, Minnesota, as follows: 1. That the final plans and specifications submitted by Jon H. Haukaas, Director of Public Works, is hereby received and accepted. 2. That the following improvements proposed by Council Resolution 68 -2003 are hereby ordered to be advertised for bids as soon as reasonably possible, to -wit: Street improvements including grading, stabilized base, hot -mix bituminous mat, concrete curb and gutter, sanitary sewer mainline extension, sanitary sewer services, watermain and services, storm sewer, landscaping and other facilities. 3. That the work be incorporated in the 2004 street improvement project as ST. 2004 — 2. 4. The plans and specifications prepared by the Public Works Department for such improvements and each of them pursuant to the Council resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part thereof, are hereby approved and shall be filed with City Clerk. Resolution No. 2004 -27 Page 2 The Director of Public Works shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such improvements under such approved plans and specifications. The advertisement shall be published for three (3) weeks (at least 21 days), and shall specify the work to be done and will state the bids will be opened and considered in the Council Chambers of the Fridley Municipal Center and that no bids will be considered unless sealed and filed with the Director of Public Works and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for Woodside Court Street Improvement Project No. ST. 2004 — 2 shall be substantially in the standard form.
