Skogen, City Clerk Date: Re November 13, 2009 Second Reading of an Ordinance and Summary Ordinance Amending Fridley City Code Chapter 101, Animal Control, Pertaining to Potentially Dangerous and Dangerous Dogs Minnesota State Law, Chapter 347.50 regulates the licensing and registration of potentially dangerous and dangerous dogs. The Fridley City Code regulating vicious animals pertains more to non-domesticated animals. During the past year, there has been an increase of dog bites, and there has been some question as to whether State law or the City Code should be followed. To help clear up this question, staff reviewed the State statute and the City Code and prepared a new ordinance amending the City Code to clarify the procedures and regulations. We have amended the City Code as follows: 2 0 Added the definitions for potentially dangerous dog and dangerous dog; Changed the quarantine period from 14 to 10 days to make it consistent with State law; Added the registration and regulation of potentially dangerous or dangerous dogs as required by State law; and, Changed "vicious" to "prohibited" animals in Section 101.11 in reference to non- domesticated animals. The City Council held the first reading of the ordinance on November 9, 2009. During the discussion, Councilmember Bolkcom requested staff to change the word "and" to "or" between Police Department and animal control officer in Section 101.10.1; and, to clarify Section 101.10.2, defining what "under strict control" meant. Staff made the changes and added a definition for "under strict control," which are shown in bold. Staff recommends Council hold the second reading and adopt the ordinance amending Chapter 101 of the Fridley City Code pertaining to dangerous dogs, and adopt the official title and summary ordinance. AN ORDINANCE AMENDING FRIDLEY CITY CODE CHAPTER 101 ANIMAL CONTROL PERTAINING TO DANGEROUS DOGS The City Council of the City of Fridley hereby finds, after review, examination and recommendation of staff, that the Fridley City Code be hereby amended as follows: Section 1: That Section 101.01 of the Fridley City Code be hereby amended as follows: 101.01 DEFINITIONS 8. Under Strict Control Under strict control refers to a do� or cat and is defined as: (1) The animal mav not leave the propertv; (2) If the animal is let outside, the owner must be present at all times and it must be either inside a fenced in vard or on a leash; (3) The animal mav run free inside the residence; however, the animal must be contained or put into a separate room when visitors are present; (4) The animal's owner must immediatelv notifv the police department if the animal shows anv si�n of illness or a��ression; and 17. �4. Veterinary Hospital 18. �. Wild Animals Section 2: That Section 101.10 of the Fridley City Code be hereby amended as follows: 101.10. ANIMAL BITES, DANGEROUS DOGS, QUARANTINE 1. Any person who has been bitten or has knowled�e �r�g of a human being who has been bitten by a dog, cat, raccoon, skunk or other species susceptible to rabies shall immediately notify the Animal Control Officer or Police Department. Whenever such an animal has bitten any person, the owner or custodian of the animal, after being so notified by the Animal Control Officer or the Police Department, shall immediately cause said animal to be quarantined at the City of Fridley contract animal shelter or at a licensed veterinary hospital or kennel for a period of ten 10 days after such person has been bitten. During the quarantine period, said animal shall be kept under observation to determine its condition and if it is found to be sick or diseased, the operator of the quarantine facility shall immediately report in writing to the Police Department � or the Fridley Animal Control Officer the condition of the animal. The Animal Control Officer shall then take necessary steps to determine if the animal is suffering from rabies. 2. During the quarantine period the animal shall not be removed from the designated quarantine facility except by special written permission from the Minnesota Livestock Sanitary Board and the Fridley Animal Control Officer. The owner of an animal shall be responsible for the cost of quarantine. 3. The quarantine required by this Section shall not be necessary and the requirements shall be waived if the custodian or owner of the animal, immediately upon notification that his or her animal has bitten someone, presents to the Animal Control Officer or Police Department, the certificate of an authorized veterinarian that the animal was vaccinated for rabies on a date not less than two (2) years prior to the date of the biting. Such animal so exempt shall be quarantined on the premises of the owner, under strict control, for a period of ten 10 days for the purpose of observation for symptoms of disease. The Animal Control Officer is authorized to conduct a mid-term and terminal examination of the animal. 4. It shall be unlawful for any person, other than an Animal Control Officer, to kill or destroy any animal found running at large in the City. No Animal Control Officer or other person shall kill, or cause to be killed any animal suspected of being rabid, except after the animal has been placed in quarantine, and the diagnosis of rabies made. 5. Re�ulation of Potentiallv Dan�erous or Dan�erous Do�. A potentiallv dan�erous or dan�erous do� shall be re�istered and re�ulated as required bv Minnesota Statutes Section 347.50. Any non-domesticated animal not naturally tame or gentle, but is of wild nature or disposition, including any of the following: (1) Any animal or species prohibited by federal or Minnesota Law. (2) Any non-domesticated animal or species, including, but not limited, to the following: (a) Any skunk, whether captured in the wild, domestically raised, de-scented or not de-scented, vaccinated against rabies or not vaccinated against rabies. (b) Any large cat of the family Felidae such as lions, tigers, jaguars, leopards, cougars, and ocelots, except commonly accepted domesticated house cats. (c) Any member of the family Canidae, such as wolves, foxes, coyotes, dingoes and jackals, except commonly accepted domesticated dogs. (d) Any poisonous snake, pit viper or constrictor, such as a rattle snake, coral snake, water moccasin, cobra, boa constrictor or python. (e) Any raccoon. Burns, City Manager Director of Public Safety Donovan Abbott November 10, 2009 2009-2010 Anoka County DUI Nightcap Grant Agreement The Anoka County Sheriff's Office and the Cities of Anoka, Blaine, Centennial Lakes, Columbia Heights, Coon Rapids, Ramsey, Spring Lake Park, Lino Lakes, St. Francis, and Fridley Police Departments are submitting a j oint grant request under the Anoka County DUI Nightcap Grant Program. The State of Minnesota Department of Public Safety uses this program to award funds provided by the Federal Office of Traffic Safety to communities for use in traffic education and enforcement efforts. The Anoka County DUI Nightcap Grant Program is expected to provide funding to each community to fund law enforcement officer's overtime as they participate in joint enforcement efforts. These enforcement efforts will take place on maj or holiday weekends, will coincide with high school graduations in Anoka County, and will occur on selected other weekends. The focus of these enforcement efforts will involve officers from all participating agencies simultaneously and will coincide with similar efforts throughout the State of Minnesota. In addition to the enforcement effort, community education through media advertising, news releases and posters to educate motorists as to the risks and consequences of impaired driving and failure to utilize seatbelts and passenger restraints will be funded. Each enforcement weekend will be augmented by a corresponding advertising campaign. The Blaine Police Department and Lt. VanVoorhis of the Minnesota State Patrol will administer the Anoka County DUI Nightcap grant on behalf of the participating agencies. The Anoka County DUI Nightcap grant will provide reimbursement to the City of Fridley for 350 hours or $19,300.00 for the salary and benefits of our officers assigned to these overtime enforcement shifts. Some additional training is required of our officers and the Anoka County DUI Nightcap grant will provide this training as well. The City of Fridley provides each eligible officer time to attend this training, squad cars, fuel, and related supplies and support to our officers assigned to the enforcement effort. Staff recommends Council's approval. RESOLUTION NO. 2009 - RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT AND PARTICIPATION IN MINNESOTA STATE PATROL FEDERAL PROJECT PROGRAMS WHEREAS, the City of Fridley Police Department shall enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety for Minnesota State Patrol Federal project programs during the period of October 1, 2009, through September 30, 2012; WHEREAS, Director of Public Safety, Donovan Abbott, of the City of Fridley and the Fridley Police Department, or his designee, is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the City of Fridley Police Department; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley that Director of Public Safety, Donovan Abbott, of the City of Fridley and the Fridley Police Department, or his designee, is hereby authorized to be the fiscal agent and administer this grant on behalf of the Fridley Police Department. Burns, City Manager James Kosluchar, Public Works Director November 16, 2009 Approve consultant selection for Project No. 389 SPRING Project PW09-066 In September, the City of Fridley issued a request for proposals for consultant services to develop a feasibility review, implementation plan, and preliminary plans forthe SPRING Project at Springbrook Nature Center. The intent of this project is to develop the Springbrook Nature Center SPRING conceptual plan into constructible phases which can be designed and constructed as funding through the Springbrook Nature Center Foundation and other sources may become available. This project will be funded exclusively by the Springbrook Nature Center Foundation through reimbursement to the City of Fridley. The work, in summary, includes using the SPRING Project conceptual plans to develop a SPRING Architectural Plan. This plan would separate the SPRING Project into phases while preparing a preliminary design for the entire Project. The plan will be used to direct future implementation of the SPRING Project. The SPRING Design Committee, which includes representatives from the City Council, Parks and Recreation Board, Springbrook Nature Center Foundation, and staff, reviewed the eight proposals received. Proposals were evaluated based on responses, including understanding of the project scope, proposed deliverables, approach to developing SPRING Project funding, experience with comparable projects, cost, schedule, and references. The committee was pleased with the quality of the proposals. Four teams were selected for presentations and interviews, as follows: Bonestroo, Hoisington Koegler Group, LHB, and SEH. After presentations were held, the committee discussed qualifications of these shortlisted firms at some length. While all four of these firms were well qualified to provide services for the project, the committee recommended selection of the team led by Hoisington Koegler Group. The team led by Hoisington Koegler Group was selected largely due to their project understanding and creative approach, related project experience, and cost within available budget. Ana Nelson of Hoisington Koegler Group, who will be the project manager, developed the SPRING conceptual plan in 2003 when she was with Bonestroo. The Hoisington Koegler Group is teaming with Partners & Sirney Architects, who have solid experience with this type of project. Both firms come very highly recommended by their references. Staff recommends the City Council moves to approve selection of Hoisington Koegler Group, Inc., to provide professional services for the SPRING Project (City Project No. 389). Upon this approval, staff will negotiate a contract for professional services for the design work. GIS Rangers has provided GIS services including data entry and mapping to enable the City of Fridley to analyze and manage data and associated attributes which are spatially referenced. The proposed 2010 contract is reduced in hours by approximately half those included in our 2009 contract, due to budget reductions in 2010. In addition, we requested that GIS Rangers provide no rate increase for 2010 over 2009 rates, which they have provided in this contract. We can accommodate this increase in our proposed 2010 budget. We have received excellent service and value in the past with this contract. Pribyl, Finance Director November 12, 2009 Resolution Authorizing the Call of Outstanding Taxable General Obligation Tax Increment Refunding Bonds, Series 2004B Attached you will find a resolution that was prepared for city staff by our Bond Counsel, Briggs and Morgan. The resolution approves the call of the outstanding General Obligation Tax Increment Refunding Bonds, Series 2004B. Based on the terms of the bond issue, it provides for the redemption of the remaining maturities after the February 1, 2010 regular payment. The three Tax Increment Districts that pledged tax increment revenues for this bond issue now carry a balance of approximately $3,000,000 which is sufficient to pay the remaining principle and interest on these bonds. Staff has reviewed the interest rates associated with the remaining maturities and finds the interest rates vary from 3.75 % to 4.35% yet we are only earning approximately 1.5% on these funds. By carrying these bonds any further, the HRA would lose some of the accumulated tax increment. Staff has reviewed this action with the Fridley Housing Redevelopment Authority and they too have found in favor of bringing this action before the City Council for their approval. Staff recommends approval of the resolution authorizing the call of outstanding taxable general obligation tax increment refunding bonds, series 2004B. RESOLUTION NO. 2009 - RESOLUTION AUTHORIZING THE CALL OF OUTSTANDING TAXABLE GENERAL OBLIGATION TAX INCREMENT REFUNDING BONDS, SERIES 2004B A. WHEREAS, the City has issued $3,920,000 Taxable General Obligation Tax Increment Refunding Bonds, Series 2004B, dated March 23, 2004 (the "Bonds") to refund the Taxable General Obligation Tax Increment Bonds, Series 1998B, dated October 1, 1998; and B. WHEREAS, in connection with the issuance of the Bonds the City established a Taxable General Obligation Tax Increment Refunding Bonds, Series 2004B Fund (the "Debt Service Account"); and C. WHEREAS, as of November 16, 2009, the cash balance in the Debt Service Account was $3,000,000 and the City anticipates an additional $1,175,000 to be deposited in the Debt Service Account by February 1, 2010. The remaining outstanding balance of principal and interest due on the Bonds is $580,062.50, which includes the regularly scheduled February 1, 2010 interest and principal payment. Consequently, the balance in the Debt Service Account will be not less than the remaining outstanding principal and interest requirements of the Bonds on February 1, 2010; and D. WHEREAS, the Bonds maturing in the years 2011 and 2012, aggregating $1,175,000 in principal amount are subj ect to redemption on February 1, 2010, and on any interest payment date thereafter, at a price of par plus accrued interest. NOW, THEREFORE, be it resolved by the City Council of the City of Fridley, Minnesota, as follows: 1. The Council hereby determines that there will be sufficient money in the Debt Service Account established by the resolution duly adopted by the Council on February 23, 2004, to prepay on February 1, 2010, $1,175,000 aggregate principal amount of Bonds maturing in the years 2011 and 2012. 2. The feasibility report will address two general areas. The first area is the Harris Lake, Spring Valley, and Benjamin/Briardale neighborhoods. The length of pavement resurfacing is estimated at 2.65 miles. All streets have concrete curbing in place and the work will likely be a combination of mill / overlay and utility spot repairs. The project includes resurfacing on Mississippi Street and Rice Creek Road, both of which are Anoka County Roads. We are continuing to work with Anoka County on a reimbursement agreement for these segments. Please refer to the attached Figure A. The second area is the River's Edge Way neighborhood. The length of pavement resurfacing is estimated at 0.82 miles. All streets have concrete curbing in place and the workwill likely be a combination of mill / overlay and utility spot repairs. A large number of streets in this neighborhood have been reconstructed or resurfaced in the last three years. We will be evaluating the remaining streets. Please refer to the attached Figure B. The segments were selected based upon the year of previous pavement reconstruction, as well as the Pavement Condition Rating which indicates pavement structural and ride quality on a scale of 5(worst) to 35 (best). Preparation of the feasibility report will allow staff to determine what construction can take place within the CIP budget. The feasibility report will provide a recommendation to the City Council on what construction should take place in 2010. In a slight modification to our project development process, we intend to prepare the draft feasibility report, and then move ahead with project open houses. With this sequence, we can obtain feedback from residents on candidate project segments and incorporate any concerns into the feasibility report before it is presented to the City Council. We intend to hold these Open Houses in December or January as our schedule may allow. The City Council will be notified of these meetings when scheduled. The attached resolution orders the preparation of a feasibility report and preliminary plans for the project. The scope of the proposed report will address pavement, street improvements, water main, sanitary sewer, and storm sewer replacement. Staff recommends the City Council moves to adopt the attached resolution for the 2010 Street Rehabilitation Project No. ST 2010-01. The letting was held on November 12, 2009. Ten bids were received as shown in the attached tabulation. This project is intended to repair a large trunk storm sewer outfall that serves both Fridley and Columbia Heights had collapsed near the river, and sloughing of the bank had occurred. Approximately 60 feet of the 96" corrugated metal (CMP) storm sewer pipe has failed, and a remaining 60-foot section of corrugated metal pipe just upstream was inspected and found deteriorated beyond a point of repair. The project involves restoring the original pipe segment and the remaining metal (CMP) pipe segment using concrete (RCP). The work will also include excavating the sloughed materials out of the river backwater and settling basin (constructed in 1965) for use in the slope restoration. Due to the immediacy of the repairs and the limited construction season remaining, we had previously requested quotes from seven different contractors. Unfortunately, the quotes are much higher than the Engineer's Estimate, and above the threshold requiring competitive bidding. Staff requests that the City Council moves to receive the attached bids for the 45th Avenue Storm Sewer Outfall Repair (City of Fridley Project 390), and award the project to G. L. Contracting, Inc. of Medina, MN, in the amount of $116,829.05. This change order includes additional work outside of the original contract. The amount of this change order is $9,293.48. Since this is a federally funded project, 80% of this change order is eligible using Federal funds and the $1,858.70 would be paid from the City's MSA account. This work has been approved by MN/DOT for use of Federal funds. The kiosk area is considered to be the focal point of the trail. The concrete pavement in the kiosk area is patterned and multi-colored. The proposed thickness of the concrete was originally designed to be 4" thick. During excavation, staff found the water table high and the existing soils to be susceptible to frost heave and differential settling. Staff determined the existing soil conditions may increase the likelihood of cracking the decorative walk This would likely result in accelerated deterioration and high maintenance costs. Staff considered two options. The first option involved performing a deep soil correction and likely cause severe impacts to surrounding oak trees and private utilities (including a fiber optic cable). The selected option required the Contractor to install iron rebar 18" on center, increase thickness from 4" to 6", and add micro-fiber reinforcement in the concrete mix. Staff recommends the City Council approve Change Order No.4 to Colt Construction Co. in the amount of $9,293.48. The revised contract amount shall be increased to $872,705.89.
