William Burns, City Manager, said corrections were made in the minutes to statements made by Ms. Reynolds and Mr. Kosluchar. A copy of the changes was provided to Council prior to the City Council meeting. Staff recommends Council's approval of the minutes as amended. APPROVED MINUTES AS AMENDED. OLD BUSINESS: 1. Second Reading of an Ordinance Amending Chapter 4 of the Fridley City Charter Pertaining to Primary Elections. William Burns, City Manager, stated the proposed Charter change is responsive to both national and state legislation which requires that we allow 45 days for both military and oversees voters to vote by absentee ballot. The state's legislation moves the state primary from September to August. The proposed Charter change establishes primary elections in accordance with Minnesota State Law. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 2 Dr. Burns said the other changes found in Section 4.08 of Chapter 4 pertain to revised dates for canvassing of both primary and general elections. The Charter change was approved by the Charter Commission on March 22, 2010. Council held a public hearing for the Charter change on April 26. Staff recommends Council's approval. WAIVED THE READING OF THE ORDINANCE AND ADOPTED ORDINANCE NO. 1269 ON SECOND READING AND ORDERED PUBLICATION. NEW BUSINESS: 2. Resolution Authorizing Final Changes in Appropriations for the General Fund, Special Revenue Funds, and the Capital Improvement Fund for the Year Ended 2009. William Burns, City Manager, said in the General Fund, $361,640 will be exchanged in property taxes for the same amount of Market Value Homestead credit revenue from Minnesota. In the expenditures for City Council there is a$3,851 overrun for personal services. This is being made up from an under-expenditure of $2,715 from other areas of the Council budget and $1,136 from the emergency reserve budget. The overrun was for un-budgeted secretarial time for taking minutes of the City Council meetings. Dr. Burns said the expenditures for the City Manager's budget there is a$4,541 overrun for personal services. This is being made up from an under-expenditure of $4,541 from other areas of the City Manager's budget. The overrun was for vacation sellback and for un-budgeted annual leave balance. The expenditures for Human Resources have an elimination of $11,316 negative variance for unbudgeted annual leave sellback and un-budgeted annual leave carryover. The amount will be made up from $1,198 in money budgeted for other areas of the Human Resources budget and $10,118 from the emergency reserve budget. Dr. Burns said there was a$438 deficit in expenditures for Elections for personal services and a $10,082 deficit for the special election held for the Charter amendment. Both amounts will be drawn from the emergency reserve. The expenditures for Assessing reflect the elimination of a $7,914 negative variance that is associated with vacation sellback and vacation balance carryover. Of this amount, $694 will be drawn from under-expenditures in other areas of the Assessing budget. The remainder, $7,220, will be drawn from the emergency reserve. Dr. Burns said the Police Department expenditures had a$41,284 over-expenditure for vacation sellback and annual leave carryover. All of this will be drawn from under-spent areas of the Police Department budget. The Fire Department Expenditures had a$33,152 negative variance for rental inspection personal service costs (including $7,658 for vacation sellback and annual leave carryover) and a$326 capital outlay over-run (associated with vehicle graphics for the replacement of the Fire Chief's car) . Unspent money from other areas of the Fire Department budget will be used to cover this cost. Dr. Burns said the Engineering Department expenditures had $2,936 attributable to vacation sellback and annual leave carryover. Of this amount, $1,994 was covered by under-expenditures MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 3 from other areas of the Engineering budget. Another $994 has been drawn from the emergency reserve. The Public Works-Parks Department had $2,720 attributable to vacation sellback and annual leave carryover which was covered from other savings. Dr. Burns said the expenditures for Public Works-Streets had a negative variance of $12,205 that was due to annual leave sellback and vacation balance carry-over. There was also $7,902 in an over-expenditure for a Street Division dump truck All of the over-runs can be covered by unspent money from supplies and charges. The Building Inspection Expenditures had a$1,860 deficit for annual leave sellback and vacation accrual. The amount was covered by unspent appropriations for services and charges. Dr. Burns said there is a$3,285 deficit in Planning expenditures for vacation sellback and vacation accrual. The amount is covered by unspent appropriations for supplies and charges. The non-departmental expenditures exceeded the Unemployment Compensation budget by $3,448. The amount can be covered by under-expenditures in other areas. The Emergency Reserve used $45,744 to cover over-expenditures in the departmental and non-departmental budgets. Overall, we spent $648,685 less than we budgeted for General Fund expenditures in 2009. Dr. Burns said the Cable TV Special Revenue Fund spent $1,431 for a merit step increase for the Media Specialist. The amount was covered by unspent appropriations for supplies and charges. The Grant Management Fund had $64,040 in unbudgeted grant revenue and expenditures. The unexpected revenue and expenditures were for various Police grants, including a Federal Justice Assistant Grant (JAG) and a state Auto Theft Grant. Dr. Burns said the HRA Reimbursement Fund had $26,805 in unexpected revenues and expenditures for HRA items paid for on behalf of the HRA by the City and then reimbursed to the City by the HRA, i.e. municipal liability insurance. The Solid Waste Abatement Fund had a non-budgeted expenditure of $1,868. The amount was used to provide a step increase for the Recycling Coordinator. Dr. Burns said the Drug/Gambling Forfeiture Fund had unexpected revenue from fines and forfeited property of $15,375. The money was used for various equipment allowable under the particular type of forfeiture. The FCC Donations Fund had interest income of $350 and unexpected expenditures of $3,382 for television upgrades at the Zone. Dr. Burns said the Springbrook Nature Center Fund experienced a negative variance of $14,589 for vacation sellback, annual leave carryover, and for un-budgeted PERA. Of this amount $3,202 came from unspent appropriations for supplies and charges. The remainder has been charged to fund balance. The Capital Improvements Fund in several instances had items that were budgeted as Capital Outlay items which were more correctly re-appropriated as repairs and maintenance items in the Capital Improvements Budget. The total cost for these items was $108,800. They included tennis court overlays and parking ramp renovations. Staff recommends Council's approval of all of the above reappropriations for 2009. Resolution Appointing an Absentee Ballot Board for the 2010 Election Cycle. William Burns, City Manager, said on Apri126, Council amended Chapter 4 of the City code to comply with 2010 Minnesota legislation regarding absentee balloting. They followed on May 10 with the first reading of similar legislation amending the Fridley Charter. Following the state legislative action, Anoka County designated Fridley as a location to conduct absentee ballot voting. Council's action of April 26 and May 10 requires Council to appoint the members of a local Absentee Ballot Board, whose members will serve as Deputy County Auditors. Dr. Burns said since the Absentee Ballot Board may consist of staff, we are suggesting that Fridley staff be appointed to this board. Since the vast majority of these duties can be completed during normal City working hours, and since there will be no additional cost for these staff during normal working hours, the appointment of staff will help the City's Elections Division save money. Nearly all of the work of the board members will occur during the week preceding the election. Dr. Burns said staff recommends Council approve the resolution appointing eight staff as members of the City's Absentee Ballot Board. These individuals include: Roberta Collins, City Manager's Office James Erickson, Finance-MIS Rebecca Kiernan, Finance-Accounting Lynn Krachmer, Finance-Assessing Jean Micheals, Finance-Accounting Richard Pribyl, Finance Director Cindy Ruschy, Finance-City Clerk's Office Debra Skogen, City Clerk THIS ITEM WAS REMOVED FROM THE CONSENT AGENDA AND PLACED ON THE REGULAR AGENDA. 4. Resolution to Approve Amendment No. 2 to Joint Powers Agreement Establishing the Northstar Corridor Development Authority. William Burns, City Manager, said with the implementation of Northstar between Minneapolis and Big Lake, the NCDA is now focusing on extending Northstar to St. Cloud. With the change in emphasis, NCDA is looking to restructure in order to operate more efficiently. The proposed changes in the JPA make it easier for those involved directly in the extension of Northstar to St.Cloud to take action more quickly than they can under the existing organizational structure. Dr. Burns said the most significant changes include language in Article V that allows the Executive Committee to approve contracts up to amounts included in the annual budget. Article VI says that the Chair of the NCDA must be a County Commissioner who represents a regional rail authority. It also assigns the Chair of NCDA as the Chair of the Executive Committee and eliminates the current Capital Budgets Committee. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 5 Dr. Burns said the new Article VI redefines Executive Committee membership to include only funding partners who are involved in funding the Big Lake to St. Cloud extension of Northstar. It also expands the duties of the Executive Committee to include the approval of contracts, the approval of the annual administrative budget, as well as all of the former responsibilities of the Capital Budget Committee. Article VII changes the process for approval of the budget from one whereby a quorum of NCDA Board members was required for approval to approval by 2/3 of the Board members who are present and voting. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 6 Councilmember Bolkcom asked about the vacation sell back and if there was any way to budget those expenses. William Burns, City Manager, said the sell back is no longer valid but the vacation carryover balances policy is still in place which has a 30-day limit. This allows employees to carry actual balances earned over to the next year. Councilmember Bolkcom said some businesses are getting away from carrying over vacation hours because sometimes the vacation hours have to be paid out at a higher rate. Dr. Burns said staff has vacation and sick leave together and there is a 30-day maximum carryover. Mayor Lund said this could be discussed in further detail at the budget work session in June. Councilmember Bolkcom asked how the City saved $648,000. Dr. Burns said he did not have the details but will submit them in June. MOTION by Councilmember Bolkcom to adopt Resolution No. 2010-32. Councilmember Bolkcom asked if one of the election judges should be included because of the pay. William Burns, City Manager, said according to Deb Skogen, people will not be spending much time on this and there will not be much overtime. MOTION by Councilmember Bolkcom to adopt Resolution No. 2010-30. Seconded by Councilmember Saefke. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 4. William Burns, City Manager, said Fridley is still in it but would no longer participate on the Executive Board. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 7 Councilmember Barnette said he is currently on the Executive Board. As phase two begins extending to St. Cloud, it is reasonable to let those counties that will be involved have the initial input. Those counties would have authority to approve expenditures that would eventually get down to the Authority. He will remain on the Authority but not on the Executive Board. The counties north of Big Lake were very strong supporters of the Fridley station and he would like to give them the same support as phase two begins. Councilmember Bolkcom said she understands why it is being done. She said another concern she had was with the Executive Board of six members. If only two people show up for a budget meeting, it only takes 2/3 of people present for it to pass. Her concern is that budgets could be passed for expenses that would come back to the City of Fridley. Councilmember Barnette said he recalled only one time that they did not have a quorum. This has not been a problem in the past and he thought it was time to give the people north of Big Lake the authority to make financial decisions. Councilmember Bolkcom asked if they would be spending Fridley funds. Councilmember Barnette answered probably not. Dr. Burns asked if this extension would mandate a third rail. Councilmember Barnette answered no; it has been discussed but not mandated. Councilmember Bolkcom said if the ridership were expanded, it is likely another rail would need to be added. Councilmember Barnette said that is open to discussion and Burlington Northern along with Federal funds and other funds would help pay for those things. There will be additional costs involved as you look ahead. Councilmember Bolkcom asked if the City of Fridley would be obligated for costs that were approved without notice. Councilmember Barnette said the Executive Board makes the final decisions on pending. Councilmember Bolkcom said she does not have a problem with the resolution, but she was concerned about bringing decisions back to the Board and Fridley being obligated for more expenses. Fridley already paid for their station, more than most other stations. Dr. Burns said expenses would have to be approved by the Fridley HRA because typically money has come from that Authority. Scott Hickok, Community Development Director, said he did not recall the HRA talking about a third rail expense; that would be something to debate with the HRA. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 8 Dr. Burns said whether it is an HRA or City expense, it cannot be accessed if the parties are not in agreement. Mayor Lund said the Executive Board cannot ask Fridley to pay expenses without authorization or approval. Councilmember Barnette said this is for phase two and to get the rail up to St. Cloud. St. Cloud is anxious to get this done. Mayor Lund said he has no issues removing Fridley from the Board and did not read in the resolution that by not participating on the Board the City would be given expenses that were not authorized. Fritz Knaak, City Attorney, said that he reviewed the resolution and approved of the language. Governing Board Members have to vote approval of expenses and this is an effective tool for Government action. MOTION by Councilmember Bolkcom to adopt Resolution No. 2010-31. Seconded by Councilmember Saefke. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 7. Informal Status Reports. Councilmember Varichak said she attended the Fridley Flames Spaghetti Dinner. About 100 people attended. She also attended the Open House Sunday for the HRA renovation home. She is excited to see the finished product. Scott Hickok, Community Development Director, said the next open house is on Wednesday, May 26, from 4:30-6:30 pm. at 831 Mississippi Street. He added that over 300 people visited the home at the last open house. Councilmember Bolkcom asked if people were interested in buying the house or seeing what can be done to a house of that age. Mr. Hickok said it was a little bit of everything. Some people are curious to see what can be done to a rambler and others are interested in proj ects on their own home and may implement some of this design into their home. Councilmember Saefke said he attended a Block Captains Meeting last Thursday night and one of the items up for discussion were the two police dogs. The Police Chief informed us that there will be a dog on duty every day and the dogs will be rotated every other day. If anyone is interested in becoming a Block Captain they should contact Myra Harris in the Police Department. MINUTES OF THE FRIDLEY CITY COUNCIL MEETING OF MAY 24, 2010 PAGE 9 Mayor Lund announced two Memorial Day events occurring in Fridley hosted by the VFW and the American Legion. One event is at the Polish Cemetery south of the freeway at 10 a.m. and the other event is at the Islands of Peace parking lot just off East River Road at 11 a.m. There is a fundraiser for the Lee Carlson Center that deals with mental health issues for teens and adults on June 12 at the Fridley High School Auditorium. Entertainment will be "Dancing with the Local Stars." He said he will be dancing the hustle and there will be six different dances and other performances. The event starts at 5:00 p.m. with dancing starting at 7:00 p.m. and the cost is $30 per person. There will also be hors d'oeuvres and a silent auction. William Burns, City Manager, said he received an Award of Excellence from the Minnesota Association of Government and Internal Affairs for the publication of the Fridley newsletter. Stacy Stromberg, Planner, stated the petitioner, SML Electrical, who is representing Amstar Station Store, is requesting a special use permit to allow an electronic gas pricing sign to replace the existing manual gas pricing sign at their property which is located at 7680 Hwy 65. Ms. Stromberg stated according to the numbers submitted by the petitioner, the existing sign is approximately 94 square feet which is over the 80 square foot maximum requirement for this business. The petitioner is proposing to reface the entire sign on the existing pole and install an electronic gas pricing sign. The size of the sign after the reface will be 78 square feet, which will meet code requirements. Ms. Stromberg stated the subject property is located on the southwest corner of Osborne Road and Hwy 65. The property is zoned G2, General Business. The original service station was constructed in 1960. At that time, the property was zoned M-1, Light Industrial. While modern code standards require a special use permit to be obtained for motor vehicle fuel and oil dispensing services in a commercial zoning district, the 1955 zoning code allowed gasoline service stations and repair garages as a permitted use in the M-1 zoning district. As a result, the existing use as an automotive service station is conforming. Ms. Stromberg stated this properiy and the VFW located to the west were rezoned from M-1, Light Industrial to G2, General Business in 1990. At the same time several variances were approved to reduce the side yard setback where a driveway is to be provided from 30 feet to 4 feet; to reduce the lot area required for one main building from 3/4 acre to 2/3 acre; to reduce the parking and hard surface setback from any street right-of-way from 20 feet to 10 feet and 5 feet, to allow the construction of an attached car wash and new pump layout on the subject property. A special use permit was also approved to allow a motor vehicle wash establishment. Ms. Stromberg stated the free-standing sign has been modified several times over the years. Though there are no variances on file allowing a larger than 80 square foot sign, building permit records indicate that the sign is over the 80 square foot size requirement. Ms. Stromberg stated electronic changeable signs are an approved special use in any zoning district, except residential, provided the message does not change more often than once every 45 seconds. The sign also needs to be in conformance with the sign requirements for the zoning district, in which the property is located. The subject property is zoned, G2 General Business, which requires that free standing signage cannot exceed 80 square feet in size. The new sign modifications and the replacement of the manual gas pricing sign with the electronic sign will comply with the 80 square foot size limit. The electronic gas pricing sign will be 8 square feet of the tota178 square foot sign. Ms. Stromberg stated the free-standing sign meets all other sign code requirements, including but not limited to size, setbacks, and height. City staff has not heard from any neighboring property owners. Ms. Stromberg stated City Staff recommends approval of the special use permit as electronic changeable signs are an approved special use in the commercial zoning district, provided the sign complies with Code requirements, subject to stipulations. Ms. Stromberg stated City Staff recommends that if the special use permit is granted, the following stipulations be attached: 1. The petitioner shall obtain sign permit and current sign erector license prior to installing any signage on site. 2. Message on L.E.D. sign shall 214.07 ofthe Fridley City Code. 3. The property is zoned C-2, General Business. The original service station was constructed in 1960. At that time, the property was zoned M-1, Light Industrial. While modern code standards require a special use permit to be obtained for motor vehicle fuel and oil dispensing services in a commercial zoning district, the 1955 zoning code allowed gasoline service stations and repair garages as a permitted use in the M-1 zoning district. As a result, the existing use as a automotive service station is conforming. This property and the VFW located to the west were rezoned from M-1, Light Industrial to C-2, General Business in 1990. At the same time several variances were approved to reduce the side yard setback where a driveway is to be provided from 30 ft. to 4 ft.; to reduce the lot area required for one main building from % acre to 2/3 acre; to reduce the parking and hard surface setback from any street right-of-way from 20 ft. to 10 ft. and 5 ft., to allow the construction of an attached car wash and new pump layout on the subject property. A special use permit was also approved to allow a motor vehicle wash establishment. The free-standing sign has been modified several times over the years. Though there are no variances on file allowing a larger than 80 sq. ft. sign, building permit records indicate that the sign is over the 80 sq. ft. size requirement. CODE REQUIREMENTS Electronic changeable signs are an approved special use in any zoning district, except residential, provided the message doesn't change more often than once every 45 seconds. The sign also needs to be in conformance with the sign requirements for the zoning district, in which the property is located. The subject property is zoned, C-2 General Business, which requires that free standing signage can not exceed 80 square feet in size. The new sign modifications and the replacement of the manual gas pricing sign with the electronic sign will comply with the 80 sq. ft. size limit. The electronic gas pricing sign will be 8 sq. ft. of the total 78 sq. ft. sign. The free standing sign meets all other sign code requirements, including but not limited to size, setbacks, and height. City staff hasn't heard from any neighboring property owners. Staff recommends not only having Council hold the public hearing, but also recommends after the public hearing; that Council approve a resolution to authorize staff to commence the statutory process toward demolition. If Council so concurs, that resolution will appear on the legislative portion of the agenda on June 2gtn ELEMENTS At the Public Hearing, Council will be advised of the property conditions and will be asked to act to officially deem the property hazardous, by resolution, and to authorize staff to begin the statutory process and commence toward demolition. State Statute 463 defines a process by which the demolition proceedings must move forward if the City is to proceed with the demolition. Essential structural items of this home such as floors and walls have been compromised by a fire that occurred in early April, 2010. The fire began in the garage however, it spread into the home. Anyone now entering the home at this juncture may be in danger of injury or death. The homeowners have failed to respond to any attempts City staff has made to communicate the dangers of this structural compromise that has occurred. For that reason the home must be demolished to eliminate the attractive nuisance and eliminate risk to those who may enter. CONCLUSION Staff recommends Council set the public hearing and receive public comment on June 28, 2010. ELEMENTS Periodically, the City of Fridley and the Metropolitan Council must renew its contractual agreement for provision of Section 8 Administrative services. The current contract expiration date is June 30, 2010. On May 26, 2010, the Metropolitan Council approved the attached contract for services. There have been only a couple minor changes and these changes amount to added pay for added services to clients that our Section 8 Housing Coordinator can and will provide (specifically Section 3.01(b), Administration fees for Enhanced VoucherAssistance Services — if these services are required a requisite fee is paid to the City). The city currently is performing some of Enhanced Services and receives additional fees when intake is completed for new Section 8 Project Based tenants moving into Brandes Place. So the contract change now matches current practice. Negotiations for a new contract occurred between the Metropolitan Council and City staff in the first quarter of this year. Budget concerns nationwide have caused authorities to need additional time to work out the terms of the contracts between the fund distribution agencies and the administrators who deliver the services. Attached for your convenience is the contract that has been provided by the Metropolitan Council and is recommended for approval by our staff. Kosluchar, Public Works Director June 10, 2010 i����`��a�xi� SUBJECT: Approve Cooperative Project Agreement for Water Main Rehabilitation The 2010 Capital Improvement Budget allocates funding identified for improvements to our water distribution system. The attached agreement relates to the second project in 2010 to complete these repairs. A 12" watermain on North Innsbruck Drive has a poor break history. In the last two years, there have been three main breaks on the segment. Water main breaks on this segment are especially difficult and costly to repair, due to the line size, number of services interrupted during repair, and the need to repair the concrete street after work is completed. The location of this segment is shown in the attached map as Area E, and is approximately 2200' in length. Engineering staff has evaluated several alternatives for repairing this main on North Innsbruck Drive from Matterhorn Drive to Meister Road to determine the most cost-effective method to rehabilitate the main. Conventional open cut installation, directional drilling installation, pipe bursting installation, and cured-in-place lining of the existing main were compared and evaluated. Engineering staff recommends bidding the work for rehabilitation of the 12" main by the installation of a cured-in-place structural liner (CIPP). The main savings with a cured-in-place liner over other trenchless technologies is that no excavation is required to connect water services. The construction of a CIPP liner is similar to lining of sanitary sewer main, which the City of Fridley performs annually. New products and processes have been developed to enable lining of pressure pipe in recent years. We recommend installation of a fully structural liner for water main. This means that if the strength of the existing (host) pipe is reduced, or even if the host pipe is removed, the liner will not fracture and is able to provide the same performance as a new water main. The CIPP liner meets standards established for the control of potential adverse human health effects from products that contact drinking water. While CIPP lining of water main is more common in other areas of the country and overseas, especially in major metropolitan areas where utility conflicts are a major problem with open cut construction, CIPP lining of water main is a relatively new process in Minnesota. When considering this rehabilitation method, we recognized that development of a cooperative project would allow the design to be developed with additional resources, and additional quantity of this construction would reduce costs. Engineering staff discussed the benefits of a cooperative project with several other cities interested in CIPP lining of their water mains. The Cities of Golden Valley and Hutchinson had also selected this rehabilitation method for some of their water main rehabilitation work in 2010. They agreed that a cooperative project between cities is feasible and benefits all parties. A cooperative project agreement has been drafted that has been reviewed by staff of the three cities to enable a cooperative project to go forward. This agreement is attached for your review and approval. It includes the following provisions: The City of Fridley will prepare a design for work in Fridley. Short, Elliot, and Hendrickson (SEH), will prepare design documents for Golden Valley and Hutchinson. 2. Each city will provide its own construction management. 3. The City of Golden Valley will be the lead agency for the project, and will administer bid advertisement and award. 4. Each city has the ability to decline an award independently of the other cities. Upon approval of the agreement, design documents will be prepared for the cooperative project, and bidding will commence in early July. A recommendation on awarding the project will be brought to the City Council after bids are received, tentatively scheduled for August 9t". Construction would commence in September and be completed in November. Recommend the City Council approve the attached Cooperative Project Agreement for Water Main Rehabilitation. RECITALS WHEREAS, Minnesota statute § 471.59, et. seq., authorizes cities to enter into cooperative project agreement; and WHEREAS, The City of Golden Valley wishes to rehabilitate a portion of their watermain by means of a Class IV fully structural, pressure rated, cured-in-place pipe (CIPP) (hereinafter "Golden Valley Project"); and WHEREAS, The City of Hutchinson wishes to rehabilitate a portion of their watermain by means of a Class IV fully structural, pressure rated, CIPP, (hereinafter "Hutchinson Project"); and WHEREAS, The City of Fridley wishes to rehabilitate a portion of their watermain by means of a Class IV fully structural, pressure rated, CIPP, (hereinafter "Fridley Project") (all three Projects taken together hereinafter "the Project"); and WHEREAS, the Cities will prepare and submit one bid document including plans and specifications for one construction contractor ("Contractor") to complete work in all three municipalities; and WHEREAS, the City of Golden Valley will be the Contracting Authority. NOW, THEREFORE, in consideration of the mutual covenants herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, Golden Valley, Hutchinson, and Fridley hereby agree as follows: Plans and Specifications. Short Elliot Hendrickson (hereinafter SEH) shall be responsible for the design and preparation of plans and specifications for construction of the Golden Valley and Hutchinson Projects. The City of Fridley is responsible for the design and preparation of plans and specifications for construction of the Fridley Project. The City of Fridley will submit a design and plans and specifications to SEH to be included with the others. The plans and specifications shall be certified by a professional engineer licensed in the State of Minnesota. 2. Advertisement for Bids and Construction. The City of Golden Valley will advertise for bids and award contracts in accordance with the laws of the State of Minnesota. The City of Golden Valley will award the contract to the contractor who is the lowest responsible bidder in accordance with law and City policy. Each City is responsible for providing construction management, observation, and inspection in connection with the work being completed within its City. 3. Warrantv. The bid specifications shall require that the Contractor provide a 1 year warranty on workmanship and materials. The warranty shall run directly to each City for the work and materials provided on each City's respective Project and bind the Contractor and all material suppliers to each respective City for each City's respective Project. 4. Insurance Requirements. The Contractor shall be responsible for any claims arising out of the construction of the Project. The Contractor shall provide proof of insurance providing coverage to meet statutory requirements. The proof of insurance must list each City as additionally insured. The contractor must also agree to indemnify and save harmless each City and all of its officers, agents, and servants against any claim or liability arising from its work on the Project. 5. Opt Out Clause. The Cities will have the option to opt out of the Cooperative Project Agreement at any time prior to award of the contract by the City of Golden Valley. The City of Golden Valley will wait a minimum of twelve (12) calendar days to award the contract after receiving the bids. Should any City or Cities withdraw from the Project, all Project costs associated with that City or Cities shall remain the responsibility of the respective City. If the City of Golden Valley withdraws from the Project, the remaining cities may continue with the Project, award the contract and designate one of them to operate as Contracting Authority hereunder. 6. Easements. The Golden Valley Project is entirely within property owned by Golden Valley and no easements are necessary. The Cities of Hutchinson and Fridley shall obtain, at their own cost, any temporary or permanent easements deemed necessary for their respective Projects. Hutchinson and Fridley shall obtain the required easements prior to advertisement for bids in accordance with the schedule developed for the Project. 7. Construction Access. The Cities agree to provide the Contractor access to perform the work in their respective Project areas. 8. Permits. The Cities shall obtain all construction permits and/or any other permits that may be required in connection with the construction of their respective Projects. 9. Communications. Each City will be responsible for project communication between all project stakeholders within their City. This includes all communication relating to construction meetings, resident notification, and any/all Project specific requirements. The City of Golden Valley will maintain the communication with SEH with the assistance of Hutchinson and Fridley for any contractual communication that is required. 10. Pavment. The Cities of Hutchinson and Fridley shall, within 30 days of receipt of invoice, submit partial payment to the City of Golden Valley in the amount of ninety- five percent (95%) of the engineer's estimated cost for their respective Projects. It is agreed that the total cost estimate provided by SEH is only an estimate of the total costs for the work contemplated by this Agreement. In addition, the unit prices set forth in the contract with the successful bidder(s), and the final quantities as measured by SEH, shall govern in computing the total final contract construction cost and the related apportionment between the Cities as contemplated by this Agreement. Partial payments will be made by the City of Golden Valley to the Contractor on a monthly basis for work completed as part of this Project. At the completion of the Project, SEH shall submit a cost breakdown for each City including engineering and project administration costs for review and approval. If any City disagrees with SEH's submittal for its Project costs, it shall have 14 days to notify the City of Golden Valley and resolve the issue. If they cannot resolve it within such 14 days, SEH's submittal shall be final for all purposes. Upon final agreement or resolution of Project cost issues, Hutchinson and Fridley shall reimburse the City of Golden Valley for the remainder of their costs, as determined by SEH, within 30 days of an invoice from Golden Valley. Record drawings shall be provided by the Contractor to the Cities for their respective Projects within 90 days of Golden Valley's final payment to the contractor(s) contracted for the work. Detailed requirements for the submittal of these record drawings can be found in the Project Standard Details supplied by SEH. 11. Examination of Books, Records, etc. As provided by Minn. Stat. Section 16C.05, Subd. 5, the books records, documents, and accounting procedures and practices of the Cities relevant to the Project are subject to examination by all parties, and either the legislative auditor or the state auditor as appropriate, for a minimum of six years from final payment. 12. Workers Compensation Claims. It is agreed that any and all employees of each City and all other persons engaged by that City in the performance of any work or services required or provided as contemplated by this Agreement shall not be considered employees of any other City, and that any and all claims that may or might arise under the Worker's Compensation Act or the Unemployment Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said employees while so engaged on any of the work or services provided as contemplated by this Agreement shall in no way be the obligation or responsibility of any other City. 13. Indemnification. Each City mutually agrees to indemnify and hold harmless the others from any claims, losses, costs, expenses, or damages resulting from the acts or omissions of its respective officers, agents, or employees relating to activities conducted by them under this Agreement. 14.Authorized Aaents. The City of Golden Valley's Authorized Agent for the purpose of administration of this agreement is Jeannine Clancy, Director of Public Works, or her successor or assign. The City of Hutchinson's Authorized Agent for the purpose of administration of this agreement is Kent Exner, Director of Public Works/City Engineer, or his successor or assign. The City of Fridley's Authorized Agent for the purpose of administration of this agreement is James Kosluchar, Director of Public Works/City Engineer, or his successor or assign. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns, provided, however, that neither Golden Valley, Hutchinson, nor Fridley shall have the right to assign its rights, obligations, and interests in or under this Agreement to any other party without the prior written consent of the other parties hereto. 16.Amendment, Modification or Waiver. No amendment, modification, or waiver of any condition, provision, or term of this Agreement shall be valid or of any effect unless made in writing and signed by the party or parties to be bound, or its duly authorized representative(s). Any waiver by a party shall be effective only with respect to the subject matter thereof and the particular occurrence described therein, and shall not affect the rights of any other party with respect to any similar or dissimilar occurrences in the future. 17.Savina Provision. If any provision of this Agreement shall be found invalid or unenforceable with respect to any entity or in any jurisdiction, the remaining provisions of this Agreement shall not be affected thereby, and such provisions found to be unlawful or unenforceable shall not be affected as to their enforcement or lawfulness as to any other entity or in any other jurisdiction, and to such extent the terms and provisions of this Agreement are intended to be severable. 18. Notices. Pribyl, Finance Director Debra Skogen, City Clerk June 9, 2010 First Reading of an Ordinance Amending Fridley City Code Chapters 30 and 603 Pertaining to Lawful Gambling Due to concerns raised by Fridley organizations and at the request of the City Council, staff conducted a survey at the beginning of the year pertaining to lawful gambling. The survey consisted of eight of the cities within the trade area. Of those eight cities: 1. Six cities required the organization to have a principal business or operation within that City. (Since the survey was completed, the City of New Brighton repealed it's ordinance and no longer has this requirement.) 2. One city provided a waiver to an organization with significant community involvement. 3. That organizations were required to spend it's lawful expenditures was between 60% to 85%. Staff provided the information to the City Council for discussion purposes. The City Council requested that an ordinance be drafted amending the city code pertaining to lawful gambling. An ordinance was drafted and the first reading was held on March 29, 2010. At that time individuals from the Knights of Columbus, the Fridley School Foundation, Fridley 49er Days and the Fridley Flames all spoke in favor of the ordinance. After the meeting, staff mailed letters to the local establishments and organizations currently conducting lawful gambling notifying them of the second reading for their review. A second reading was held on April 12, 2010. Additional information was provided by the public. The Spring Lake Park Lions provided a letter opposing the ordinance due to its past donations made that benefited the citizens of Fridley without being an organization that conducted lawful gambling within the City. Spring Lake Park Youth Hockey said 10% of their membership came from the City of Fridley, as it is an older community with fewer young people. Their association donates to the Fridley and Spring Lake Park High School hockey programs. They had just signed a lease with Broadway Pizza and were concerned they would be asked to leave. The owner of Broadway Pizza, Mike Schrauth, said he had just recently interviewed several organizations to bring in a new organization into his establishment. He said there was no rush from Fridley organizations showing their interest. He chose SLP Youth Hockey because they had a membership that lived within 3 to 5 miles of his establishment and could bring in more business. Robert McNeal from the Fridley American Legion was concerned with the new requirement that 75% of their proceeds be spent within the trade area and was concerned that they would not be able to continue to make contributions to their fellow veterans outside of the trade area. After further discussion, the ordinance was tabled. The ordinance was removed from the table and discussed again at length by the City Council on Apri126, 2010. The Council discussed whether or not the City could limit lawful gambling to local organizations or the City's ability to allow a non-city organization to conduct lawful gambling. The City Attorney said the City had the ability through it's liquor licensing code to place restrictions. He said the City could state its preference for Fridley organizations. If there were a situation of having no Fridley organizations, the establishment owner would understand the Council might authorize an outside organization until a Fridley organization would come forward. The American Legion and the Veteran's of Foreign Wars (VFW) both spoke against increasing the expenditures in the trade from 50% to 75%. After further discussion, the ordinance was tabled. On May 10, 2010, the ordinance was removed from the table. A review of the status was completed and amendments had been prepared by staff to address some of the concerns from the last meeting. Mayor Lund said he had contacted the state gambling board and understood that the City could not regulate lawful gambling. The City Attorney said while the state regulates lawful gambling, the city regulates liquor licensing and that is how the City could regulate it. Members of the VFW and the American Legion again spoke against the increase of funds staying in the trade area. Amendments to the ordinance were briefly discussed. The city attorney said any amendments to the ordinance would have to be unanimous, unless they wanted to go back to a first reading. He said the ordinance could be redrafted and brought back to the City Council for a first reading. The Council moved to revert back to the first reading for staff to rewrite the ordinance based on the discussion and direction of the City Council. Staff inet with the City Council briefly at a pre-city council meeting on May 24th to discuss what amendments the Council would like to see. The ordinance was redrafted with those changes and is now up for the first reading. The new ordinance continues to define what a local organization is, removes the 75% expenditure to the trade area and ties it to the liquor license. Staff recommends holding the first reading of an Ordinance Amending Fridley City Code Chapters 30 and 603 Pertaining to Lawful Gambling. ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 30 LAWFUL GAMBLING AND CHAPTER 603 1NTOXICATING LIQUOR OF THE FRIDLEY CITY CODE DEFINING LICENSED ORGANIZATIONS TO CONDUCT LAWFUL GANIBLING The City Council of the City of Fridley hereby finds, after review, examination and recommendation of staff, that the Fridley City Code be hereby amended as follows: SECTION 1. That Chapter 30 of the Fridley City Code be amended as follows. CHAPTER 30. LAWFUL GAMBLING 30.01 STATEMENT OF POLICY The City of Fridley deems it desirable to regulate lawful gambling within its jurisdiction as authorized by Minnesota Statutes Section 349.213. The Citv finds that, for the purposes of �reater supervision and access of information, a more restrictive requirement for the location of licensed or�anizations to those located within the Citv is in the interest of the health and safetv of the citizens of the Citv of Fridle� 30.02 DEFINITIONS The definitions in Minnesota State Statutes Chapter 349 are adopted by reference in this chapter. Licensed organizations in the City of Fridley may be permitted to conduct lawful gambling or use any gambling device allowable by Chapter 349. Licensed Or�anizations In order to be eli�ible for a premises permit, an or�anization must meet the following requirements: A. The activities of the or�anization directiv or primarilv benefit the citizens of Fridle� B. One-third of the or�anization's members reside in the Citv of Fridlev. The or�anization must file a list containin� the names and addresses of all current members with each new application for a premises permit; and annuallv thereafter with the citv clerk; or the or�anization must have had a principal business or operations location in the Citv of Fridlev for a continuous period of at least one vear immediatelv precedin� the permit request and must maintain such a location to conduct business as lon� as the or�anization operates lawful �amblin� activities in the citv. Or�anizations that meet one of these conditions shall be considered a qualifving or�anization. 30.03. REGULATIONS Licensed organizations conducting lawful gambling within the City of Fridley shall expend fifty percent (50%) of its expenditures for lawful purposes conducted or located within the City of Fridley trade area. The Fridley trade area is limited to the City of Fridley and each city contiguous to the City of Fridley. 2.
