WHEREAS, the community problem of domestic violence has become a critical public health and
welfare concern in Anoka County; and
WHEREAS, domestic violence is a crime, the commission of which will not be tolerated in Anoka
County, and perpetrators of said crime are subject to prosecution and conviction in accordance with the
law; and
WHEREAS, thousands of women and children have and will continue to access assistance from
Alexandra House, Inc., a domestic violence service provider; and
WHEREAS, domestic violence will be eliminated through community partnerships of concerned
individuals and organizations working together to prevent abuse while at the same time promoting social
and legal change; and
WHEREAS, October is National Domestic Violence Awareness Month; and
WHEREAS, during National Domestic Violence Awareness Month, Anoka County organizations will
inform area residents about domestic violence, its prevalence, consequences, and what we, as a
concerned community, can do to eliminate its existence.
NOW THEREFORE, BE IT RESOLVED, thatl, Scott J. Lund, Mayor for the City of Fridley, do hereby
proclaim the month of October, 2010, to be:

Proclamation
Fire Prevention Week
October 3 - 9, 2010
WHEREAS, the City of Fridley is committed to ensuring the safety and security of all those living in and visiting our city; and
WHEREAS, fire is a serious public safety concern locally and nationally, and homes are where people are at greatest risk to fire; and
WHEREAS, nearly 3,000 people die each years as a result of home fires each year; and
WHEREAS, roughly two-thirds of home fire deaths resulted from home fires in which no smoke alarms or no working smoke alarms
were present; and
WHEREAS, working smoke alarms cut the chance of dying in a reported fire in half• and
WHEREAS, the National Fire Protection Association recommends at least one smoke alarm on every level of the home (induding the
basement) outside all sleeping areas, and in all bedrooms; and
WHEREAS, informing the public about the importance of smoke alarm installation and maintenance serves an essential step toward
increasing the public's safety from home fires; and
WHEREAS, the Fridley Fire Department is dedicated to reducing the occurrence of home fires and home fire deaths and injuries
through prevention and proper education; and
WHEREAS, Fridley's residents are responsive to public education measures and are able to take personal responsibility to increase
their safety from fire, especially in their homes; and
WHEREAS, the Fire Prevention Week 2010, October 3-9 theme, "Smoke Alarms: A Sound You Can Live With!" actively works to
motivate Fridley residents to implement smoke alarm recommendations in their homes;
NOW THEREFORE, BE IT RESOLVED, that I, Scott J. Lund, Mayor for the City of Fridley, do hereby prodaim October 3-9,
2010, as
Fire Prevention Week
in the City of Fridley. I urge all people of Fridley to protect their homes and families by heeding the potentially life-saving messages of
Fire Prevention Week 2010, and supporting the many activities and efforts of Fridley's fire and emergency services.

PREPARATION OF PROPOSED ASSESSMENT FOR THE
STREET IMPROVEMENT PROJECT NO. ST 2008-01 (Siverts Lane)
WHEREAS, the costs for the Street Improvement Project No. ST. 2008-1 (Siverts Lane) have been
estimated to be $55,793.00 for the contract price for such improvement and $ 2,790.00 for
expenses incurred in the making of such improvement so that the total estimated cost of the
improvement is $ 58,582.65.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY,
MINNESOTA:
The portion of the cost of such improvement to be paid by the City is hereby estimated to be $
50,707.67 and the portion of the cost to be assessed against benefited property owners is
estimated to be $ 7,874.98.
Assessments shall be payable in equal installments extending over a period of 10 years, the first
of the installments to be payable on or before the first Monday in January, 2011 and shall bear
interest at the rate of 6.5 percent per annum from the date of the adoption of the assessment
resolution.
The Acting Finance Director, with the assistance of the City Engineer, shall forthwith calculate
the proper amount to be specially assessed for such improvement against every assessable lot,
piece or parcel of land within the district affected, without regard to cash valuation, as provided
by law, and he shall file a copy of such proposed assessment in his office for public inspection.
The Acting Finance Director shall upon the completion of such proposed assessment, notify the
Council thereof.

WHEREAS, by resolution passed by the Council on September 20, 2010, the Acting Finance
Director was directed to prepare a proposed assessment of the Street Improvement Project No.
ST 2008-01 (Siverts Lane),
AND WHEREAS, the Acting Finance Director has notified the council that such proposed
assessment has been completed and filed by his office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY,
MINNESOTA:
A hearing shall be held on the 25th day of October, 2010 in the City Hall at 730 p.m. to pass
upon such proposed assessment and at such time and place all persons owning property affected
by such improvement will be given an opportunity to be heard with reference to such assessment.
The Acting Finance Director is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to the hearing
and he shall state in the notice the total cost of the improvement. He shall also cause mailed
notice to be given to the owner of each parcel described in the assessment roll not less than two
weeks prior to the hearings.
The owner of any property so assessed may, at any time prior to certification of the assessment to
the county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City of Fridley, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of the assessment. He may at any time thereafter, pay to
the City of Fridley the entire amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the succeeding year.

RESOLUTION DIRECTING PUBLICATION OF THE HEARING ON THE
PROPOSED ASSESSMENT FOR THE STREET IMPROVEMENT
PROJECT NO. ST. 2010-01
WHEREAS, by resolution passed by the Council on September 20, 2010, the Acting Finance
Director was directed to prepare a proposed assessment of the Street Improvement Project No.
ST 2010-01,
AND WHEREAS, the Acting Finance Director has notified the council that such proposed
assessment has been completed and filed by his office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY,
MINNESOTA:
A hearing shall be held on the 25th day of October, 2010 in the City Hall at 730 p.m. to pass
upon such proposed assessment and at such time and place all persons owning property affected
by such improvement will be given an opportunity to be heard with reference to such assessment.
The Acting Finance Director is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to the hearing
and he shall state in the notice the total cost of the improvement. He shall also cause mailed
notice to be given to the owner of each parcel described in the assessment roll not less than two
weeks prior to the hearings.
The owner of any property so assessed may, at any time prior to certification of the assessment to
the county, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City of Fridley, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of the assessment. He may at any time thereafter, pay to
the City of Fridley the entire amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the succeeding year.

Resolutions Appointing Additional Election Judges for the 2010 Two Year Election
Cycle
September 15, 2010
The attached resolution appoints additional election judges for the 2010 two-year election cycle.
The additional election judges are needed to help fill in additional vacancies during the general
election. Due to our high voter turnout, we want to ensure each precinct has a minimum number of
9 judges per precinct. These individuals are being appointed now, as we received their applications
after July 12th and state law requires them to be appointed no later than October 8, 2010.
The election judges are being appointed without precinct assignments at this time to allow the city
more flexibility in determining precinct assignments. Election judges receive training which
qualifies them to serve a two year term as an election judge.
Staff recommends adoption of the attached resolution.

Ronald Shigeru Igarashi, Officer of Apple Minnesota LLC has applied for an on-sale intoxicating liquor
license to operate Applebee's Neighborhood Grill & Bar located at 6490 Central Avenue NE, Fridley,
Minnesota. All of the Applebee's in Minnesota have been changed from corporate stores to franchise
stores. The other officers of the franchise are Gregory Grant Flynn of California, Lorin Miguel Cortina
of California and Daniel Victor Krebsbach of Washington.
Section 603 of the Fridley City Code requires that a public hearing be held to consider the approval of
an Intoxicating Liquor License. The City Code also requires that the license can not be approved during
the same meeting. The Notice of Public Hearing, Attachment A, was mailed to the applicant and
published in the September 2, 2010 edition of the Fridley Sun Focus.
The Police Department has conducted a background investigation on all four officers and has found no
reason to deny the application at this time. The final approval of the license will be scheduled for
October 11, 2010, in conjunction with the sale of the business.
Staff recommends holding a public hearing for an intoxicating liquor license.

Subject: Second Reading for Text Amendment Request, TA #10-01, Voigt Bus Service
THE REQUEST
The petitioner, Mr. Voigt, of Voigt's School Bus Service, Inc., is seeking a text amendment to add
language to the M-1, Light Industrial zoning district and the M-2, Heavy Industrial zoning district; that
would allow parking of fleet vehicles as an accessory to the principal use on a lot, provided specific code
requirements can be met.
Of particular importance when considering a text amendment is determining if the proposed use would
be consistent with the purpose and intent of the zoning district in which it would become allowable, and
whether or not the proposed use would be compatible with other accessory uses within the district.
Accessory uses, are just that, accessory to the principal use of the property. Off-street parking is
considered an accessory use, as is off-street loading facilities and business signs for uses permitted. Staff
would consider the parking of fleet vehicles an extension of the off-street parking accessory use as long
as the conditions we've laid out in the attached ordinance can be met. This type of accessory use; would
be considered reasonable to be allowed in the M-1 and M-2 zoning districts, without causing disruption
to the neighboring properties and uses.
PREVIOUS CITY COUNCIL ACTION
The City Council held the first reading of the ordinance for TA #10-01 on September 13, 2010.
The City Council held a public hearing for TA #10-01 on August 9, 2010 and continued it to the August 23,
2010 Council meeting so additional information could be provided.
PLANNING COMMISSION RECOMMENDATION
At the July 21, 2010, Planning Commission meeting, a public hearing was held for TA #10-01. After a
brief discussion, the Planning Commission recommended approval of TA #10-01. No stipulations are
attached.
THE MOTION CARRIED UNANIMOUSLY.
PLANNING STAFF RECOMMENDATION
City Staff recommends the City Council hold the second and final reading on the attached ordinance to
allow parking of fleet vehicles as an accessory use in the M-1, Light Industrial and M-2, Heavy Industrial
zoning districts.

FLEET VEHICLES" AS AN ACCESSORY USE 1N THE M-1, LIGHT INDUSTRIAL AND
M-2, HEAVY INDUSTRIAL ZONING DISTRICTS
The Fridley City Council hereby finds after review, examination and recommendation of staff
that Chapter 205 related to creation of a definition for "fleet vehicle" and allowing the "overnight
parking of fleet vehicles" as an accessory use in the M-1, Light Industrial zoning district and M-
2, Heavy Industrial zoning district be amended as follows:
SECTION 1.
That Section 205.17 be hereby amended as follows:
205.17 M-1, LIGHT INDUSTRIAL DISTRICT REGULATIONS
USES PERMITTED
B. Accessory Uses
(1) Off-street parking facilities, directiv related to the principal use.
(a) Includin� the business' fleet vehicles
((1)) Vehicles shall be licensed and street operable.
((2)) Vehicles shall be parked on an a�roved hard surface.
((3)) Vehicles shall be parked in the side or rear vard onl�
((4)) Vehicles shall be under a�ross vehicle wei�ht of 26, 000
lbs.
((5)) The parkin� stalls dedicated for the parkin� of fleet
vehicles shall be in addition to what code would require for
parkin� stalls on the site.
((6)) The parkin� area shall be properlv lit, with shielded and
