Otteson, Assistant Public Works Director November 15, 2010 I,�JI�[�ai�7i� Receiving Feasibility Report and Calling for a Public Hearing for 2011 Street Rehabilitation Project No. ST2011-01 On September 13, 2010, the City Council approved Resolution 2010-063 directing preparation of a feasibility report for 2011 Street Improvement Project No. ST 2011-01. On September 30, an open house was held after notice to property owners adjacent to and within the construction areas. 306 notices were mailed. There were 24 attendees at the open house, where the planned project and feasibility report were discussed. Staff gave a 20-minute presentation on the City's resurfacing program, provided a project summary, presented the anticipated project schedule, presented the project budget, and outlined the estimated assessments and payment schedule. Following the staff presentation, the meeting was opened to group questions and comments. Several property owners stayed after the meeting to ask individual questions regarding the project. After the meeting, staff resumed final preparation of the feasibility report. The feasibility report includes consideration for public comment and concern received through open house discussion, property survey, and telephone conversations. The feasibility report is divided into Section A(Hyde Park Area) and Section B(North Commercial Area) to allow for distinction. Please refer to the completed feasibility report, which concludes: 1. The project is necessary as included in the City of Fridley's proposed 2011 CIP budget and Street Maintenance Program. 2. The project is cost-effective, and will result in reduced maintenance requirements within the project area and a long-term savings to the City of Fridley. 3. The project is feasible and is funded in the proposed FY2011 budget. After discussions held with the City Council after the project open house, staff does not recommend including Section B(North Commercial Area) in this project. The City Council expressed the significant burden that special assessments, in accordance with policy, would create on many businesses that are struggling due to current economic conditions. Staff performed a vacancy survey and found that there is an unusually high vacancy rate for commercial properties in the North Commercial Area. Staff also received requests from property owners to delay the project. Staff has determined that the roadways in Area B can sustain several more years of use before the pavement deterioration progresses from mill and overlay to requiring full reconstruction. We also expect additional base correction in certain areas if rehabilitation is delayed a few years or more. It should be noted that the deteriorated condition of the streets will require continued maintenance resources in the mean time. Comments from property owners in Hyde Park Area have generally been in support of the project. We have also had requests for general information from Hyde Park Area owners. Staff has received two requests to not complete the project for economic reasons. Staff recommends the City Council approve the attached resolution receiving the Feasibility Report for 2011 Street Rehabilitation Proiect No. ST2011-01 and calling for a public hearing on the proposed improvements on January 24, 2011. If the City Council approves the attached resolution at this meeting, public hearing notices will be received by property owners abutting the project area and the public hearing will be advertised in the official newspaper. Also, letters will be sent to the North Commercial Area properties notifying them that their portion of the street project has been deferred to a future year. Burns, City Manager Jack Kirk, Director of Parks and Recreation November 9, 2010 Resolution Supporting SPRING Project While the Springbrook Nature Center SPRING project has gained a lot of support in St. Paul over the past several years, it has not yet been awarded any funding via a State grant. During the 2010 Legislative session, the project was once again included in the capital bonding bill, but it was line item vetoed out by the Governor. Earlier this year, the Springbrook Nature Center Foundation provided funding for us to hire the services of Hoisington Koegler Architects to divide the SPRING project into several "phases" which could be completed individually as stand alone projects. The architects also determined some more exact costs for the various components of the SPRING project. This information from the architects was presented to the Parks and Recreation Commission at the August 2, 2010 meeting and received very positive support. The phased approach to the SPRING project was also presented to the City Council in a conference session on October 11 and appeared to have City Council support as well. At the Council conference session we talked about the City Council passing a resolution of support for the SPRING project. I am attaching a proposed resolution with this memo for the City Council to consider. Since we have been so close to receiving funding in the past few years and we still have area legislators ready to support this project, I would like to see us submit another application for funding to the State. While the bonding bill may not be as large as in some past years, our project is familiar to the legislators and has been supported in the past. If the proposed resolution meets the approval of the City Council, I recommend that they pass and adopt this resolution of support for the Springbrook Nature Center SPRING project. We would then include this in our application to the State of Minnesota for a Capital Budget Grant. RESOLUTION NO. Otteson, Assistant Public Works Director November 15, 2010 PW10-051 Street Rehabilitation Project No. ST2010-1 Estimate and Progress Update This memorandum is to provide an update to the current status and address the pay estimate that was tabled on October 25tn Currently, the project is complete except for addressing the pavement finish, longitudinal joints, pavement height along the curbline and other workmanship related issues. Staff performed a thorough inspection of the project and identified items requiring correction. It should be noted that during the project, the City performed material testing and found all tests meeting or exceeding specifications. On November 10t", Jim and I reviewed the project with the State Bituminous Engineer (MNDOT) and his staff inembers during the morning prior to the meeting with the Contractor. We toured several streets over the course of 1'/ hours. MNDOT agrees with our assessment with respect to the workmanship of the paving. During the afternoon of November 10t", I met with the Contractor to review the east side street problems. I spent nearly 2'/ hours with the Contractor reviewing the project and discussing the outstanding requirements of the contract. I informed the Contractor that no further payment will be approved until we have a written agreement pertaining to what, how, and when they will complete corrections in accordance with the contract, or through alternative methods of correction approved by staff. I advised the Contractor that certain corrections need to be performed prior to winter. I received assurance they would schedule the work immediately. The Contractor was not able to provide the written agreement addressing the corrective actions by November 12t". I recommend Council to remove the estimate from consideration for approval. Staff will submit a revised estimate at a later date, subject to staff's satisfaction with the on-going corrections and correction agreement with the Contractor. INTRODUCTION Michael Schifsky, who is representing Ashland Inc., is requesting to rezone the property at 7315 Hwy 65 from M-1, Light Industrial to C-2, General Business to allow the redevelopment of this site with a retail user. Staff determined that in order to avoid spot zoning and create a contiguous commercial zoning district in this area the properties to the south should also be rezoned. These properties are 7299 Hwy 65, which is currently a Super America gas station and the vacant parcel to the south of Super America, which is addressed 7201 Hwy 65. The gas station use most closely fits in a commercial zoning district. The City has notified the owners of the Super America, who are also the owners of the vacant lot south that their properties are involved in this rezoning process. They appeared at the Planning Commission meeting to state they had no problem with their properties being rezoned to C-2, General Business. PAST COUNCIL ACTION At the November 8, 2010, City Council meeting, a public hearing was held for ZOA #10-02. The City Council evaluated the proposal and requested that a 60-day action letter be sent to the petitioner. Staff has sent the letter as requested. PLANNING COMMISSION RECOMMENDATION At the October 20, 210, Planning Commission meeting, a public hearing was held for ZOA #10-02. After some discussion, the Planning Commission recommended approval of rezoning, ZOA #10-02. THE MOTION CARRIED UNANIMOUSLY. PLANNING STAFF RECOMMENDATION City Staff recommends concurrence with the Planning Commission. Staff is open to considering a consolidation of drop-off services in order to serve our residents with less funding. RESOLUTION NO. 2010 - A RESOLUTION ENCOURAGING ANOKA COUNTY INTEGRATED WASTE MANAGEMENT TO WORK WITH ALL OF ITS LOCAL GOVERNMENT UNITS TO EXPLORE OPERATING A YEAR-ROUND, COUNTY-WIDE, CENTRALLY LOCATED RECYCLING DROP-OFF WHEREAS, Fridley staff received a letter with invitation from County Commissioner Jim Kordiak to participate in a telephone survey to evaluate Anoka County Drop-off programs; and WHEREAS, Fridley residents are committed to recycling items that are typically recycled at "Recycling Drop-off Days" such as electronics, major appliances, tires, fluorescent bulbs, scrap metal and vehicle and rechargeable batteries, as frequently as possible as proof by their willingness to wait in long lines and pay fees for service; and WHEREAS, the City of Fridley supports efficiency in service delivery and convenient recycling services that promote waste reduction; and WHEREAS, residents in Fridley have asked for a more convenient county-wide recycling drop- off center like ones available to residents of Hennepin, Ramsey, and Dakota Counties; and WHERAS, Fridley is open to considering consolidation of drop-off services in order to serve our residents with less funding; and WHEREAS, the Anoka County Integrated Waste Management Department provides a household hazardous waste site and yard waste sites; and WHEREAS, Anoka County Integrated Waste Management does not offer a year-round county- wide recycling drop-off for household items that are typically recycled at "Recycling Drop-off Days." NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fridley encourages Anoka County Integrated Waste Management to work with all of its local government units to explore the option operating a year-round, county-wide, centrally located recycling drop-off.
