RES 2010-90 - 14768RESOLUTION NO. 2010 - 90 A RESOLUTION APPROVING SPECIAL USE PERMIT SP# 10 -12 FOR CSM PROPERTIES INC., GENERALLY LOCATED AT 490 NORTHCO DRIVE NE WHEREAS, Section 205.18.3.C(l)((a)) of Fridley City Code allows an increase in lot coverage for one -story buildings from 40% to 50% of lot area in an M -2, Heavy Industrial zoning district by a special use permit if certain conditions can be met; and WHEREAS, on November 17, 2010, the Fridley Planning Commission held a public hearing to consider a request by CSM Properties Inc., generally located at 490 Northco Drive NE in Fridley, legally described as Lot 2, Block 1, North Central Business Park, for a Special Use Permit SP# 10- 12 to allow an increase in lot coverage from 40% to 43.3 %; and WHEREAS, on December 6, 2010, the Fridley City Council approved the stipulations represented in Exhibit A to this resolution as the conditions on Special Use Permit SP# 10 -12; and WHEREAS, the petitioner, was presented with Exhibit A, the stipulations, at the December 6, 2010 City Council meeting; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that the Special Use Permit SP# 10 -12 and stipulations represented in Exhibit A are hereby adopted by the City Council of the City of Fridley. Generally located at 490 Northco Drive NE, Fridley, MN Stipulations 1. Any future expansion of the building will require special use permit review. 2. Any future expansion of the building will require a new parking analysis. 3. The 60 ft. no -build zone on the east side of the building shall remain free and clear of any storage for necessary fire protection. 4. Per Section 205 of the Fridley City Code, this Special Use Permit will become null and void one year after the City Council approval date if work has not commenced or if the Petitioner has not petitioned the City Council for an extension.
