RES 2010-98 - 14781RESOLUTION NO. 2010 - 98 A RESOLUTION APPROVING AND AS NEEDED SCHEDULE FOR THE BRANDES PLACE ADVISORY COMMITTEE, RATHER THAN A SET SCHEDULE, FOR BRANDES PLACE GENERALLY LOCATED AT 6124 5TH STREET WHEREAS, On July 24, 2003, The Tenth Judicial District Published the Settlement between the Brandes Place Partnership and the City of Fridley; and WHEREAS, One of the requirements of the Settlement Agreement was that there be a Committee to oversee matters that may arise in conjunction with the Brandes Place Development; and WHEREAS, That Committee was a requirement of the City for protection against issues that might otherwise exist without review and correction if necessary. WHEREAS, The Brandes Place Partnership was then formed to meet this requirement; and WHEREAS, The Committed was formed as required and has met on a regular basis, in order to keep a regular schedule; and WHEREAS, the group reports they are now and have been meeting over the last year and a half to 2 years without matters of substance to discuss; and WHEREAS, staff has sought the advice of Counsel as well as internal staff and those consulted agree, the committee should stay formed, but does not need a regular scheduled calendar, but instead one that will have the group meet if matters arise warranting review, otherwise the group will not meet; and WHEREAS, The Committee volunteers are interested and appreciative of an "as needed" scheduling, rather than a regular schedule. NOW THEREFORE BE IT RESOLVED, That the City Council of the City of Fridley does recommend that the Brandes Place Advisory Committee stay formed and ready to convene if necessary, but that the City will not require quarterly, or other more formal meeting schedules, simply to be meeting. Council understands, however, that any member of the Advisory Committee may request a meeting. Council also understands that the City's Community Development Director will be advised of any vacancies on the Committee.
