RES 1960-57 - 00012736 (2)RESOLUTION NO. 57 - 1960 A RESOLUTION TRANSFERRING MAIN STREET TO ANOKA COUNTY WHEREAS, located within the City of Fridley is a street known as Main Street which is more accurately described as fol- lows. Beginning at the intersection of Main Street N.E. and 43rd Avenue N.E., which point of intersection is on the East boundary of the City of Fridley and on the West boundary of the City of Columbia Heights and is approximately 1318.02 feet South of the N. E. corner of Section 34, Township 30 N., Range 24 W, on or near the East line of said Section 34, thence continuing northerly along or near the established center line of Main Street N.E. to the intersection of Main Street N.E. and 45th Avenue N.E. which is on or near the S.W. cor- ner of Section 26, Township 30 N., Range 24 W. and which is also the North boundary limits of the City of Columbia Heights at that point, thence continuing northerly along or near the established center line of Main Street N.E. in the City of Fridley to an inter- section of Main Street N.E. and a Service Road adja- cent to Trunk Highway No. 100 right -of -way, said point of intersection being approximately 1400.32 feet North of the S.W. corner Section 23, Township 30 N., Range 24 W., and on or near the West line of said Sec- tion 23, thence Easterly approximately 308.45 feet along or near the established center line of the said Service Road to a connection with Trunk Highway No. 100 and there terminating. and, WHEREAS, this street is a part of the City of Fridley street system, and WHEREAS, it has been a subject of some study as to whether or not this should be a part of the County road sys- tem, and WHEREAS, as a result of this study it is mutually under- stood and agreed between the County of Anoka and the City of Fridley that this street above described is more properly a part of the County road system, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fridley: 1. That as a condition of said transfer, the County of Anoka shall agree to and provide for the establish - ment and maintenance of a service road to be laid out along the easterly side of said street; and further that the County of Anoka shall at all times before making any improvements of a permanent na- ture on said street or service road submit to the City of Fridley the final plans and specifications therefore, and receive the consent and approval thereto of the City of Fridley. 2. That upon acceptance by the County of Anoka of such conditions as noted in Section 1 herein above, the City of Fridley does hereby transfer to the County of Anoka the above described street; and said street is hereby made a part of the County road system; said transfer to be final on the adoption by the Anoka County Board of County Commissioners of a resolution accepting the above described street and conditions imposed. Brunsel { RESOLUTION NO. 58 - 1960 A RESOLUTION AUTHORIZING AND DIRECTING CONDEMNATION PROCEEDINGS BE IT RESOLVED By the Council of the City of Fridley: SECTION 1. That the City of Fridley finds that it has heretofore, by inadvertence and oversight, error in survey, and a belief that the same was under right of easement duly obtained, entered upon certain lands in the City of Fridley for the purpose of establishing various public im- provements therein, including but not limited to sanitary sewer, storm sewer, watermains and street improvements, or upon land immediately adjacent thereto. That the City has hereto- fore attempted to obtain title thereto or easement as necessary in each of said lands but has been unsuccessful therein. Ac- cordingly, to protect the rights and interests of the City of Fridley as well as the rights and interests of the owners of said property, it is desirable and necessary that appropriate proceedings in condemnation be taken. Further, that in the es- tablishment of further public improvements in the City of Frid- ley the City has attempted to obtain additional lands or ease- ments and rights therein as are necessary to the establishment of said improvements and has been unable to acquire the same by gift, purchase or other means short of its exercise of emi- nent domain; and that it is necessary to the establishment of such improvements that the City exercise its right of eminent domain relative thereto. SECTION 2. The City Manager is authorized and directed, with the advice and counsel of the City Attor- ney and the Consulting Engineer of the City to determine the exact legal descriptions of the lands and properties in the City of Fridley necessary to the proper establishment and maintenance of such public improvements and to institute appropriate pro- - ceedings in condemnation under the City's power of eminent domain.
