RES 1962-122 - 00012492 (2)124 EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL.CF THE CITY OF FRIDLEY, OF A REGULAR MEETING HELD SEPTEMBER 4, 1962, AT 8:00 O'CLOCK, P.M. AT THE CITY HALL, CITY OF FRIDLEY, ANOKA COUNTY, MINNESOTA. The matter of the construction of certain improvements, and the hear- ings held heretofore on the same were discussed, and the Cou;icil being fully ad- vised in the matter, Councilman Johanson introduced the following resolution and moved its adoption. RESOLUTION N0. 122 -1962 , A RESOLUTION ORDERING IMPROVEMENT, APPROVAL OF PLANS, AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, the resolutions of the City Council adopted on the 1st day of March, 1960, the 19th day of April, 1960, and the 7th day of March, 1961, set the date for hearing on the proposed improvements, as specifically noted in the several notices of hearing attached hereto for reference as EX??IBITS "A," and, WHEREAS, all the property owners whose property is liable to be assess - ad-..with the making of these improvements (as noted in said notices) were given ten (10) days published notice of the Council hearings through two (2) weekly publications of the required notices, and the hearings were held and the property owners heard thereon at the hearings, as noted in said notices. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Minnesota, as follows: That the following improvements heretofore proposed by Council reso- lutions are hereby ordered to be effected and completed as soon as reasona ly possible, to -wit: (a) All of the improvements as noted in the notices of hearing on the same as are noted (EXHIBIT "A" in said notices) except (none); , that the work involved in said improvements as listed above shall hereafter be designated as: STREET IMPROVEMENT PROJECT NO. ST 1962 -4 The plans and specifications prepared by the City Engineer, Calvin G. Brown, P.E., for such improvements and each of them, pursuant to the Council resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are hereby approved and shall be filed with the City Clerk. The work to be performed under STREET IMPROVEMENT PROJECT N0. ST 1962 -'41 shall be performed under one contract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such im- provements under such approved plans and specifications. Tje advertisement shall be published for two (2) weeks (at least 15 days), and shall specify the work to be done and will state that bids will be opened and considered at 12:00 o'clock Noon on the 17th day of September, 1962, in the Council Chambers of the City Hall, and that no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for STREET IMPROVEMENT PRO- ' JECT NO. ST 1962 -4 shall be substantially in form as that noted in Exhi- bit "B" attached hereto for iaference and made a part hereof. Street base, bituminous surfacing, curb and appurtenant work located in all the streets and serving all the area described as follows: 1. 73rd Avenue N.E. from T.H. No. 47 to T.H. No 65. ESTIMATED COST ....... ..............................$ 229,000.00 THAT THE AREA PROPOSED TO BE ASSESS,;D FOR SAID IMPROVEMENT IS AS FOLLOWS: FOR CONSTRUCTION ITEM, A. ABOVE: All of the land abutting upon said street named above and all lands within, adjacent and abutting thereto. All of said land to be assessed proportionately according to the benefits received by such improvements. That the Council proposes to proceed with each of said improvements as separate improvements, except as hereafter otherwise provided by the Council all under the following authority, to —wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof, and in conformity with the City Charter. GREIG MAYOR �1 RESOLUTION NO. 122 EXHIBIT "B" CITY OF FRIDLEY NOTICE TO BIDDERS = Sealed bids will be received, publicly opened and considered by the City Council of the City of Fridley, Anoka County, Minnesota, at the office of the City Manager in said City on the 5th day of November, 1962, at 12:00 Noon for the furnishing of work and materials for Street Improvement Project St. 1962 -4. The project consists of the following principal items of work and approximate quantities: 332450 Sq. Yds. Bituminous Surfacing 11,7 "0 Lin. Ft. Bituminous Curbing 14,000 Sq. Yds. Soil Stabilized Base All in accordance with plans and specifications prepared by Calvin G. Brown, P.E., City Engineer, Fridley City Hall, 6431 University Avenue N.E. Fridley, Minneapolis 21, Minnesota. Telephone: 560 - 3450. Plans and specifications may be examined at the office of the City Manager, and conies may be obtained for the Contractor's individual use, by applying to the City Engineer and depositing with the City Engineer X15.00 for each set. The deposit will be refunded to each bidder submitt- ing a bonafide bid upon return of the documents in good condition within ten (10) days from the bid opening date. Bids must be made on the basis of cash payment for work, and accom- panied by a cash deposit, certified check ion a responsible bank in the State of Minnesota), or a bidders bond and made payable without condition to the City of Fridley, Minnesota, in an amount of not less than 5% of the total amount of the bid. The City council reserves the right to reject any and all bids and to waive any informalities in any bids received without explanation. No bid may be withdrawn for a period of thirty (30) days. RIVER EDGE WAY BE IT RESOLVED, by the Council of the City of Fridley as follows: t = -j t -: 1. That it appears in the interest of the City and of the property owners affected that there be constructed cer- tain improvements, to -wit: a. Street improvements, including grading, stabilized base, bituminous surfacing, concrete curb and gutter and appurtenant facilities, located as follows: (1) River Edge Way - West and So-nth leg.: b. That petitions relative to said improvements have been received and filed with the City as follows:` (1) Petition No. 12 -1962 and Petition No. 37 -1962 ' relating to Item a (1) above. 2. That the City Engineer, Calvin G. Brown, P.E., is hereby authorized and directed to draw preliminary plans and speci- fications and to tabulate the results of his estimates of the costs of said improvements, including every item of cost from inception to completion and all fees and expenses incurred (or to be incurred) in connection therewith, or the financing thereof, and to make a preliminary report of his findings, stating therein whether said improvements are feasible and whether they can best be made as proposed, or in connection with some other improvements (and the estimated cost as recommended), including also a description of the lands or area as may receive benefits therefrom and as may be proposed to be assessed. 3. That the City Clerk shall act to ascertain the name and address of the owner of each parcel of land directly affected on within the area of lands as may be proposed to be assessed for said improvements (and each of them); and, upon receipt from said Engineer of the said preliminary report, calculate the estimates of assessments as may be proposed relative thereto against each of said lands. ' 4. That said preliminary report of the Engineer and estimates of assessments of the Clerk, shall be furnished to the Council, and made available for inspection to the owner of any parcel of land as may be affected thereby at any public hearing held relative thereto, as well as at any prior time reasonable and convenient.< ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 4TH DAY OF SEPTEMBER, 1962. �.E MAY .R - T.
