RES 1962-213236 2. That a transfer from the Municipal Liouor Dispensary Fund to the General Fund in the amount of $42,000.00 as provided for in the 1962 budget is hereby approve' and confirmed. WHEREAS, the City of Fridley has hereto fore found use and need for certain storm sewer facilities in and u_non the lads and area known as Melody Manor, and WHEREAS, it has been found to be in the interest of the City and the public that the City obtain the ownership of the same for the use of the City and the public, either by con�emnation under the power of eminent domain or under agreement for purchase, and 4?HEREAS, it anpears that there is nrw an offer and agreement negotiated by the owner and the r•presentatives of the City, and such offer and agreement appears reasonable and acceptible to the City and to the advantage of the City and the public, and direct acquisition will save the City and the public further costs and expense as may be incurred by proceeding further in condemnation, NOW, THEREFORE, BE IT RESOLVED, By the Council of the City of Fridley as follows: 1. That the agreement heretofore negotiated and proposed to be made as attached hereto and made a part hereof by ref - erence is accented and approved and tile officers and rep- resentatives Wayor and Pfanager) of the City are authorized and directed to execute the same on behalf of the City of Fridley. Greig� 1 7 1 IJ RESOLUTION NO. 213 EXhIPIT "A° BILL OF SALE For and in consideration of the sum of Seventy three thousand five hundred dollars ($73,500.00) the receipt of which is hereby acknowledged, the undersigned, E & M DEVELOPMENT CO., hereby sells, assigns and transfers to the City of Fridley, a municipal corporation, all of the storm sewers, including manholes, catch basins and conn- ecting pipe, heretofore installed by us in the platted or proposed subdivisions of Melody Manor in the City of Fridley. The undersigned agrees to maintain and warrant said storm sewers against any defects in material or workmanship for a period to and including August 31, 1963. In witness whereof, the Vice- president and Secretary have here- unto set their hands and affixed the Corporate Seal of the said Corporation this 27th day of December, 1962.
