RES 1962-3540 meet the bond obligations due, as the amount of the assessment roll adopted was less than the amount of the bond issue, NOW THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, meeting at a regular session on the 7th day of May, 1962, that there be transferred from the operating accounts of the Public Utility Fund to the Sinking Account of Sewer and Water Improvement Project No. 13 - 1960 in the amount of $9,500.00. Brunsell RESOLUTION NO. 35 -1962 A RESOLUTION CALLING A PUBLIC HEARING ON THE MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVEMENTS FOR THE PURPOSE OF CORRECTING CERTAIN OMISSIONS, ERRORS OR MISTAKES IN RELATION THERETO. ' WHEREAS, The City Attorney has found and determined that the original notices published and given with respect to those certain improve- ments noted in EXHIBITS "A ", "B ", and "C ", hereto attached and made a part hereof by reference, were defective and contained omissions, errors, or mistakes, and had advised the City Council that any assessments or any part thereof with respect to said improvements, and each of them, is or may be invalid by reason thereof, and had advised the City Council to correct said defects, omissions, errors or mistakes by giving new Notice of a Hearing thereon, and holding new public hearings with respect thereto for such pur- poses, and, WHEREAS, the construction of certain improvements as hereinafter noted is deemed to be in the best interest of the City of Fridley and the property owners affected, BE IT RESOLVED By the Council of the City of Fridley, as follows: 1. That this Council will meet on the 21st day of May, 1962, at 8 :00 o'clock P.M.,at the City Hall in the City of Fridley for the purpose of holding a new and corrective public hearing on the improvements noted in each of the Notices attached hereto and made a part hereof as "EXHIBIT A", EXHIBIT B ", and EXHIBIT C ", the original hearing on the improvements noted in EXHIBIT A" having heretofore been held on March 15, 1960, the original hearing on improvements noted in EXHIBIT B" having heretofore been held on April 5, ' 1960, and the original hearing on improvements noted in EXHIBIT C" HAving heretofore been held on October 3, 1961. 2. That the area proposed to be assessed for said improvements, and each of them, as noted in said notices, and each of them, are all the lands and areas noted in said notices, and each of them as therein noted; all of the same to be assessed proportionately according to the benefits received. 3. That the City Manager is authorized and directed to give a corrected notice of such public hearing by publishing notice thereof in the official 41 newspaper of the City of Fridley according to law, such notice to be sub- stantially in the form and substance of the notices attached hereto as EXHIBITS "A ", "B ", and "C ". Each of said improvements as noted in the respective notices attached as Exhibits hereto shall be treated as separate improvements, except insofar as the Council shall otherwise hereafter determine. The Council shall at the time set in said notices,t and each of them, as contained in EXHIBITS "A ", "B ", and "C:' attached hereto and made a part hereof by reference, meet at the time and place set therein and hold such corrective public hearings according to law, and for the purpose of correcting any invalid procedure heretofore taken by the Council with respect to said improvements, and each of them. Brunsell RESOLUTION NO. 36 -1962 RESOLUTION ORDERING IMPROVEMENT AND FINAL PLANS AND SPECIFICATIONS SEWER AND WATER - #55 WHEREAS, Resolution #24 -1962 of the City Council adopted the 16th day of April, 1962' set the date for hearing on the proposed improvement, as specifically noted in the Notice of Hearing attached hereto for reference as Exhibit "A ", and WHEREAS, All of the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days published notice of the Council hearing through two (2) weekly publications of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice.
