RES 1962-711 77 EXTRACT OF MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF FRIDLEY, OF A REGULAR MEETING HELD J'!LY 169 1962 AT 8:00 OIC'_OCK PM, AT THE CITY HALL, CITY OF FRIDLEY, ANOKA COUNTY, MINA?ESOTA The matter of the construction of certain improvements, and the hearings held heretofore on the same were discussed, and the Council being fully advised in the matter Councilman Nee introduced the following resolution and moved its adoption. RESOLUTION �0. 71 -1962 A RESOLUTION ORDERING IMPROVFT_vEivT, APPROVAL OF PLANS, AND ORDERING ADVERTESHZRF,icT FOR BIDS. WHEREAS, the resolution of the City Council adopted on the 2nd day of July, 1962, set the date for hearing on the proposed improvements, as specifically noted in the notice of hearing attached hereto for reference as EXHIBIT "A," and, WHEREAS, all the property owners whose property is liable to be assessed with the making of these improvements (as noted in said notice) were given ten (10) days published notice of the Council hearing through two (2) weekly publications of the required notice, and the hearing was held and the property owners heard thereon at the hearing, as noted in said notice. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley, Minnesota, as follows: 1. That the following improvements heretofore proposed by Council resolution are hereby ordered to be effected and completed as soon as reasonably possible, to -wit: (a) All of the improvements as noted in the notice of hearing on the same as are noted (Exhibit "A" in said notice) except (none); that the work involved in said improvements as listed above shall hereafter, be designated as: WATER AND SANITARY SEWER IMPROVEMENT PROJECT NO. 50 2. The plans and specifications prepared by Comstock and Davis, Inc., Consulting Engineers, for such improvements and each of them, pursuant to the Council resolutions heretofore adopted, a copy of which plans and specifications are hereto attached and made a part hereof, are hereby approved and shall be filed with the City Clerk. 3. The work to be performed under WATER AND SANITARY SEWER IMPROVEMENT PROJECT #50, 1962, shall be performed under one contract. The City Manager shall accordingly prepare and cause to be inserted in the official newspaper advertisements for bids upon the making of such improvements under such approved plans and specifications. The ,advertisement shall be published for 3 weeks (at least 21 days),and shall specify the work to be done and will state that bids will be opened and considered at o1clock, on the day of , 1962, in the council chambers of the City Hall, and that no bids will be considered unless sealed and filed with the City Clerk, and accompanied by a cash deposit, bid bond, or certified check payable to the City for five percent (5 %) of the amount of such bid. That the advertisement for bids for WATER AND SANITARY SEWER IMPROVEMENT PROJECT NO. 50 - 1962 shall be sub- stantially in form as that noted in Exhibit "B" attached hereto for reference and made a part hereof. Grei RESOLUTION NO. 71 EXHIBIT "n" NOTICE TO CONTRACTORS Sealed bids will be received until 12:00 Noon on the 19th day of September, 1960, by the City Ccund 1 of the City of Fridley, Minnesota, at the office of the City Manager, for the furnishing of work and materials for the installation of Water and Sanitary Sewer Extens3.ons, Municipal Liquor Outlet No. 2. The Project consists of the following approximate quantities: 1 Meter Chamber 7')O Lin. Ft. 1" Copper 'dater Service Line (Type K) 225 Lin. ft. 8" Sanitary Sewer. All bids must be made upon printed proposal forms) furnished and in accordance with the plans and specifications. Plans and specifications may be examined at the office of the City Manager and copies may be had for the Contractar's individual use by applying to the Engineers, Comstock R- Davis, Inc., Consulting Engineers, 1446 County Road "J ", Minneapolis 21, Minnesota, Telephone: SUnset 4 -9346. Plans and specifications may be had by depositing 8`25.00 per copy. Bids must be made on the basis of cash payment for the work and accompanied by a cash deposit, certified check on a responsible bank in the State of Minnesota, or a bidder's bond, any made payable without condition to the City of Fridley, Minnesota in the amount of not less than 5% of the total amount of the bid accompanying such cash deposit, certified check or bidder's bond. The City Coun- cil rescr ves the right to waive any informalities in any bid rec- eived, and to reject any or all bids received, without explanation. WAQ'M CITY MANAGER RESOLUTION NO. 71 EXHIBIT "A" S &W #50 CITY OF FRIDLEY NOTICE OF HrARING ON IMPROVEMENTS WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it necessary and expedient that the improve- ments hereinafter described be made. NOW, THEREFORE; NOTICE IS HEREBY GIVEN THAT ON the 16th day of July, 1962, at 8:00 o'clock P.M., the City Council will meet at the City Hall in said City, and will at said time and place hear all parties interested in said improvements, in whole or in part. The general nature of the improvements is the construction (in the lands and streets noted below) of the following improvements, to -wit: CONSTRUCTION ITEM: A. Water and Sanitary Sewer Mains, Laterals and certian Service Connections located in all of the streets and serving all of the area described as follows: Marshall Street from 37th Avenue N.E. to the South boundary line of Minneapolis Waterworks and lying between East River Road and the Mississippi River. ESTIMATED COST .. ..............................$ 28,840.00 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENT IS AS FOLLOWS: FOR CONSTRUC -ION ITEM A, ABOVE: All of the land abutting upon said streets named above and all land adjacent, abutting and lying within the boundaries des- cribed heretofore. All of said land to be assessed proportionately according to the benefits received by such improvements. That the Council proposes to proceed with each of said improve- ments as separate improvements, except as hereafter otherwise pro- vided by the Council all under the following authority, to -wit: Minnesota Laws 1953, Chapter 398 and laws amendatory thereof, and in conformity with the City Charter.
