RES 1970-145let RESOLUTION NO. 145 -1970 A RESOLUTION DIRECTING THE ATTORNEYS REPRESENTING THE CITY OF FRIDLEY TO FILE APPEALS AND CROSS- APPEALS ON CONDEMNATION PROCEEDINGS 31257 - PROJECTS: PARK AND RECREATION PURPOSES WHEREAS, the City of Fridley has initiated condemnation proceedings in the District Court, Anoka County, Tenth Judicial District, for the taking of certain lands for Park and Recreation Purposes, and WHEREAS, on June 30th, 1970 the Court appointed Commissioners made their report establishing the amount of the awards for Parcel 10 at Seventy -six Thousand Two Hundred Ninty -six Dollars ($76,296), for Parcel 300 at Sixty Thousand ($60,000) for Parcel 600 at Twenty -six Thousand Two Hundred Dollars ($26,200) and Parcel 3000 at One Hundred Thirteen Thousand Two Hundred Fifty Dollars ($113,250), and WHEREAS, these amounts are substantially higher than the original estimates received by the City and are higher than the amounts submitted to the State and Federal authorities for participating grant, and WHEREAS, the owner of Parcels 10 and 3000 has appealed his award of the Commissioners. NOW THEREFORE, BE IT RESOLVED that the Council of the City of Fridley, Anoka County, Minnesota as follows: The attorneys for the City shall file in behalf of the City cross - appeals on those parcels that are being appealed by the land owners and direct appeals on those parcels not yet appealed by the owners so that the matter will be tried in the Anoka County District Court, before that Court and a jury.
