Res 1999-99 The motion for the adoption of the foregoing resolution was duly made by Councilmember Barnette and seconded by Councilmember Bolkcom. CITY OF FRIDLEY COUNTY OF ANOKA STATE OF MINNESOTA RESOLUTION NO. 99 - 1999 A RESOLUTION APPROVING SPECIAL LEGISLATION. BE IT RESOLVED by the City Council (the "Council") of the City of Fridley, Minnesota (the "City"), as follows: WHEREAS, Laws of Minnesota 1999, Chapter 243, Article 10, Section 23 (the "Special Law") was enacted by the Legislature of the State of Minnesota and signed into law by Governor Jesse Ventura on May 25, 1999, and relates to special rules governing the use of tax increment financing by the City within a designated area of the City; WHEREAS, Subdivision 2 of the Special Law provides that the Special Law is effective upon approval by the governing bodies of the City, Anoka County (the "County") and Independent School District No. 13 (the "School District") and that the City, the County and the School District comply with Minnesota Statutes, Section 469.1782, subdivision 2, and Section 645.021; WHEREAS, Minnesota Statutes, Section 469.1782, subdivision 2, and Section 645.021 provide that upon approval of the Special Law by the City, the County, and the School District, the City must file with the Secretary of State a certificate of approval, as proscribed by the Attorney General, along with a copy of the resolutions of approval of the City, the County and the School District prior to the first day of the next regular session of the Legislature; WHEREAS, on July 27, 1999, the Board of Commissioners of the County adopted its Resolution No. 99-104, approving the Special Law; WHEREAS, on August 24, 1999, the School Board of the School District adopted its resolution, approving the Special Law; and WHEREAS, the first day of the next regular session of the Legislature is Tuesday, February 1, 2000. Resolution No. 99-1999 Page 2 NOW, THEREFORE, BE IT RESOLVED by the Council of the City as follows: 1. The Special Law is hereby approved. 2. The City Clerk is hereby directed to file a certificate of approval and a certified copy of the City's resolution of approval with the Secretary of State. 3. The City Clerk is further directed to obtain a certified copy of the County's resolution of approval and the School District's resolution of approval and to provide them to the Secretary of State. 4. The City Clerk is further directed to provide the above documentation to the Secretary of State prior to Tuesday, February 1, 2000. 5. The Special Law is effective upon compliance with the above requirements by the City, the County and the School District. Adopted by the Council of the City this 13th day of December 1999. Upon vote being taken thereon, the following voted in favor thereof: Mayor Jorgenson, Councilmembers Barnette, Billings, and Bolkcom. and the following voted against the same: None (Councilmember Wolfe being absent) Whereupon said resolution was declared duly passed and adopted, and was signed by the Mayor and attested to by the City Clerk. 7)14 ' , ,, •d4 CY J.
