RESOLUTION NO. 69 - 1998
A RESOLUTION APPROVING CLEAN-UP AT 650 ELY STREET
TO ELIMINATE ALL CODE VIOLATIONS
WHEREAS, the City of Fridley has endeavored to eliminate City Code
violations through a systematic enforcement process; and
WHEREAS, the City of Fridley has sought to educate the public regarding
Code issues and provide the information necessary to gain compliance; and
WHEREAS, the City of Fridley utilized its education process to inform Mr.
William Erickson of his violations; and
WHEREAS, the City of Fridley provided the necessary information to allow
Mr. Erickson the ability to know what corrections were necessary; and
WHEREAS, Mr. Erickson's violations are of a nature that may harm, soil,
ground water, may encourage rodents and vermin, and may diminish other's
enjoyment of their property in this general area; and
WHEREAS, Mr. Erickson has chosen not to correct his violations, has
received numerous citations, has appeared in court, was found guilty, and
was ordered to jail on September 24, 1998; and
WHEREAS, By Court Order, Mr. Erickson was to provide a dumpster by October
12, 1998, or remain in jail for 180 days and the City was then permitted to
eliminate all code violations on the property; and
WHEREAS, Mr. Erickson chose to not comply with the Court Order; and
WHEREAS, Minnesota Statute allows for abatement of nuisances; and
WHEREAS, the City has chosen at this to ask for the assistance of the Court
in providing a Court Ordered Clean-up by the City Oto abate the exterior
nuisances at 650 Ely Street; and
WHEREAS, the City has provided an inventory (attached as EXHIBIT A) .
NOW, THEREFORE, BE IT RESOLVED, THAT THE City Council of the City of
Fridley hereby authorizes its City Attorney to proceed with requesting a
clean-up order in Anoka County Court allowing abatement of the nuisances
that exist at 650 Ely Street. This resolution is also meant to emphasize
the fact that all associated costs plus an administrative fee of 25% shall
be assessed to the property owner at 650 Ely Street.
