IIIRESOLUTION NO. 50 - 1996
A RESOLUTION OF THE CITY OF FRIDLEY, MINNESOTA, AGREEING
TO AND AUTHORIZING EXECUTION OF A RECREATIONAL FACILITY
COOPERATIVE AGREEMENT BETWEEN THE CITY OF FRIDLEY AND
INDEPENDENT SCHOOL DISTRICT 14 FOR THE JOINT USE OF
HAYES ELEMENTARY SCHOOL IN THE CITY OF FRIDLEY
WHEREAS, the City of Fridley currently runs a recreational program for the
benefit of its citizens; and,
WHEREAS, the program has, in the past, utilized facilities owned by Independent
School District 14 for the purpose of providing services in its recreation
program in a manner that is most cost-effective and beneficial to all of the
citizens of the City, including the facility at the Hayes Elementary School site
in the City of Fridley; and
WHEREAS, Independent School District 14 planned to construct improvements and
additions to Hayes Elementary School located in the City of Fridley, including
provision for a new elementary gymnasium facility; and
WHEREAS, the City finds that the proposed Hayes Elementary School facility
improvements could, if upgraded to a standard-type gymnasium, with provision
III for, among other things, warming house facilities, significantly improve the
services the City provides in its recreation program; and
WHEREAS, the City finds that the cost of the additional construction to the
Hayes Elementary School to provide these benefits is substantially below the
cost that would be the case if constructed by the City in any other manner; and
WHEREAS, the City has directed its staff to negotiate with Independent School
District 14 for an agreement that would permit the additional construction on
the Hayes Elementary School facility to occur, with a contribution by the City
for the costs of the construction of the facility, not to exceed One Hundred
Nine Thousand ($109,000.00) dollars, in exchange for its use by the City for its
recreation program in a manner mutually agreed to; and
WHEREAS, both the City and Independent School District 14 wish to use this
project as the basis of a broader agreement and understanding of joint
utilization of public facilities located within the City where expansion of
those facilities by the School District is contemplated; and
WHEREAS, while the proposed agreement does not, in itself, provide any framework
for a broader agreement between the parties, it notes the history of cooperation
between the City of Fridley and Independent School District 14 in the past on
similar issues and commits both parties to ongoing good-faith in implementing
IIIthe agreement, as well as addressing future needs;

NOW, THEREFORE, BE IT RESOLVED, that the City of Fridley, based on the foregoing
findings and stated understandings, by action of its City Council this 22nd day
of July, 1996, agrees to the terms of the document entitled Recreational
Facility Cooperative Agreement, and commits the City to fulfillment of its
stated obligations under that Agreement upon its approval and execution by the
School Board of Independent School District 14.
BE IT FURTHER RESOLVED, that the City Council, by this action, authorizes the
Mayor and City Manager to execute any and all necessary documents to effect the
stated purpose of this resolution.
