Res 1963-104 89 - RESOLUTION NO. 104-190 A RESOLUTION ORDERING A NEW PUBLIC PEARING ON SEWER AND WATER PROJECT NO. 63 WHEREAS, the council has by previous resolution conducted a public hearing, received a feasibility report and an estimate of cost, has advertised for bids in reference to the improvement by the install- ation and construction of Sewer and Water lines and facilities to the area north of Highway #100 and on either side of East River Road, ands WHEREAS, bids for the construction of said Sewer and Water fac- ilities were opened by the Council on the third day of June, 1963, and WHEREAS, the properties to be assessed for said improvement include the following: Parcel 4700, Auditor's Subdivision No. 78; Parcel 4750, Auditor's Subdivision No. 78; Parcel 2880, Auditor's Subdivision No. 78; Parcel 2900, Auditor's Subdivision No. 78, all being parts of Lots 13 and 18, Auditor 's Subdivision No.,78, Anoka County, Minnesota, and WHEREAS, the consulting engineers, Comstock and Davis, have reported that the bids for construction of said project are running approximately 18% in excess of the estimated total cost of the improvement, and WHEREAS by letter dated June 17, 1963, from the law office of Dorsey, Owen, Marquart, Windhorst & West, representing the' Studebaker Corporation, protest is made and objection has been made to the letting of the construction bids, and WHEREAS, Comstock and Davis have submitted a report to the Council dated June 17, 1963, indicating that said project is feasible and that it should be made as proposed and that the estimated cost of the improve- ment is the sum of $26,000.00, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA, 1. The Council will consider the improvement of said property by the installat:on and construction of sewer and water service in accordance with the report of the City Engineer, and the assessment of abutting property for all or a portion of the improvement pursuant to Laws of 1953, Chapter 398, at an estimated total cost of the improvement of $26,000.00. 2. A public hearing shall be held on such proposed improvement on the first day of July, 1963, in the council chambers of the City Hall at Fridley, Minnesota, at 8:00 o'clock P.M., and the Clerk shall give published notice of such hearing and improvement as required by law. Bi."unsell RESOLUTION NO. 104 EXHIBIT "A" CITY OF FRIDLEY NOTICE OF HEARING ON IMPROVEMENTS WHEREAS, the City Council of the City of Fridley, Anoka County, Minnesota, has deemed it necessary and expedient that the improvements hereinafter described be made, NOW, THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 1st day of July, 1963, at 8:00 o'clock P.M., the City Council will meet at the City Hall in said City, and will at said time, and place, hear all parties interested in said improvements in whole or in part. The general nature of the improvements in the construction (in the lands and streets noted below) of the following improvements, to-wit: CONSTRUCTION ITEM: A. Water Lateral and Service Connections and Sanitary Sewer Lateral and Service Connections located in all of the streets and serving all of the area described as follows: a. Lot 18 Auditor's Subdivision No. 78 -- Parcel No. 4700 b. Portion of Lot 18, Auditor's Subdivision No. 78 — Parcel No. 4750 C. Lot 13, Auditor's Subdivision No. 78 -- Parcel No. 2900 and No. 2880 ESTIMATED 26,000.00 THAT THE AREA PROPOSED TO BE ASSESSED FOR SAID IMPROVEMENT IS AS FOLLOWS: or construction item A, above: All of the land abutting upon said streets named above and all lands adjacent and abutting thereto. Brunsell RESOLUTION NoLl22:12a__ A RI5ZOLUTION CERTIFYING CHARGES TO THE COUNTY AUDITOR TO BE LEVIED AGAINST CERTAIN PROPERTIES FOR COLLECTION WITH THE 1963 TAXES WHEREAS, a nuisance condition has been found to exist on Lots 4 and 5, Block 15, Fridley Park Addition, and, WHEREAS, the owner of such property was given notice to abate such nuisance, and, WHEREAS, the owner of such property did not abate such nuisance, and the City of Fridley, under authority of Section 145.23 Minnesota State Statute of 1953 did therefore abate the nuisance at a total cost of $116.00, NOW, THEREFORE BE IT RESOLVED, that the City Clerk is hereby authorized and directed to certify to the County Auditor for collec- tion with the 1963 taxes, the charges as listed below:
