EXTRACTS OF MINUTES OF THE CITY COUNCIL OF THE CITY OF FRIDLEY ANOKA COUNTY, MINNESOTA RESOLUTION ORDERING CONDEMNATION ON PROJECT #64 Pursuant to due call and notice thereof, the meeting of the City Council of Fridley was duly held at the City Hall, said City, on the 20th day of August, 1963, at 8:00 o'clock PX., The following members were present: Mayor Nee, Councilmen Wake, Brook, Johanson The following members were absent: Sheridan Councilman Johanson introduced the following Resolution and moved its adoption: RESOLUTION NO._ 121-1963 WHEREAS, by previous resolutions of the Council of the City of Fridley it was determined to construct and extend the utility system as providd in Project #64 of the City of Fridley and to acquire ease- ments for said utility purpose, and WHEREAS, the City Engineer determined that the project was feas- ible, and • WHEREAS, public hearings were held on the matter at the City Hall, and WHEREAS, following said public hearings of the City Council did resolve that the project was feasible and necessary and did approve plans and specifications and let bids for the construction and installip • ation of said utility improvements, and WHEREAS, as a part of said improvement certain easement is nec- essary for the completion of a pending contract now under construe- tion cannot be acquired by negotiation. The easement required is described as follows: Michael L. and Evelyn L. Gideo -A permanent easement with lateral support for underground utilities described as follows: The West 20 feet of the East 661.5 feet of the South 387.36 feet of the Northwest Quarter (Nlqi) of the Northeast Quarter (NE ) of Section 12, Township 30, Range 24, except the South 33 feet thereof, and temporary construction easerents with lateral supports described as two five foot wide strips of land lying East of the West of and adj- acent to the following described strip of land: The West 20 feet of the East 661.5 feet of the South 387.36 feet of the Northwest Quarter (ne) of the Northeast Quarter (NE-1) of Section 12, Township 30, Range 24, except the South 33 feet thereof. NOW, THEREFORE, BE IT R SOLVED by the City Council of the City of Fridley as follows: 1. It is necessary for the purpose qf utility improvement that the above stated easement be taken. 2. Said easement is to be used as a utility easement for the II/ improvement as shown on the plans and specifications of Project #64 of the City of Fridley. 3. The attorneys for the City are authorized and directed to acquire such easement by condemnation action in Anoka County District Court. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Brook and upon vote being taken thereon, all numbers present voted in favor thereof. The following members were present: Mayor Nee, Councilmen Wolke, Johanson, Brook The following members were absent: Councilman Sheridan Councilman Wolke introduced the following Resolution and moved its adoption: RESOLUTION NO. l22-l96 WHEREAS, by previous Resolutions of the Council of the City of Fridley, it was determined to construct and extend the water utility system in the northern part of the City and to acquire an easement for utility purposes, and WHEREAS, the City Engineer determined that the project was feasible, and WHEREAS, public hearings were held on the matter at the City Hall, and WHEREAS, following said public hearings, the City Council did resolve that the project was feasible and necessary and did approve plans and specifications and let bids for the construction and installation of said water utility improvement, and WHEREAS, as a part of said water utility improvement certain easements are necessary for the completion of a pending contract now under construction and cannot be acquired by negotiation, as follows: All of the North 20' of the Southiof the North -- of Section 2, Township 30, Range 24, Anoka County lying westerly of the present T.H. 47 (old M.S.T.H. #56) excepting the easterly 115' thereof. The West 20' of the 115' lying westerly of and adjacent to the West line of T.U. #47 (old M.S.T.H. #56) from the North line of the South -22- of the North -1Tof Section 2, Township 30, Range 1 , to the N.P.L. of Osborne Road in the North - of Section 11, Town- ship 30, Range 24 in Anoka County, Minnesota. THEREFORE, RE IT RESOLVED, By the City Council of the City of Fridley, as follows: 1. It is necessary for the purpose of water utility iirprove- ment that the above stated easements be taken; 2. Said easements are to be used as utility easements for the improvement as shown for each parcel; 3. That the attorneys for the City are authorized and dir- ected to acquire such easements by condemnation action in Anoka County, istrict Court.
