Wdgner NEWS: Sept. 11, 18, 1963 EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF REGULAR MEETING HELD SEPTEMBER 30, 1963, AT 8:00 O'CLOCK, P.M., AT THE CITY HALL, CITY OF FRIDLEY, MINNESOTA. Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Fridley, Minnesota, was duly held at the City Hall in said City on Monday, the 30th day of September, 1963, at 8:00 o'clock P.M. following members were present: Mayor Nee, Councilmen Sheridan, Brook, Wolke, Johanson and the Following were absent: None. The Clerk announced that the proposed assessment for STORM SEWER IMPROVEMENT PROJECT NO. 53 had been filed in his office on the 4th day of September, 1963, and that notice of a hearing on said assessment to be held at the special meeting of the Council on the 30th day of September, 1963, had been given in the form and manner as provided by law. The Clerk presented an affidavit showing publication of such notice in the official news- paper, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor announced that the meeting was open for consideration of objections to the assessment heretofore filed with the City Clerk for STORM SEWER IMPROVEMENT PROJECT NO. 53 The Clerk reported that written objections had been filed by the following persons affecting the following described lots, pieces or parcels of land, to-wit: NONE the following persons were then heard and presented their objectjOns to said assessment: Mr. John Hays Lot 1, Block 2, Hayes River Lots Assessed nore than others in the area Mr. V. RESOLUTION NO. uol963 RESOLUTION CONFIRMING ASSESSMENT FOR STORM SEWER IMPROVEMENT PROJECT NO. 53 BOURDEAUX'S SPRING BROOK PARK, RIVERWOOD MANOR, ANNA & CHARLES STREET, AND OSBORNE MANOR. BE IT RESOLVED By the City Council of the City of. Fridley, Minn- esota, as follows: 1. he City Clerk has with the assistance of the Engineers hereto- fore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the STORM SEWER IMPROVEMENT PROJECT NO. 53 BOURDEAUX'S SPRING BROOK PAR, RIVERWOOD MANOR, ANNA AND CHARLES STREET, AND OSBORNE MANOR in said City against every assessible lot, piece or parcel of land in accordance with the provisions of law, aid has pre- pared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspedtion and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed; except: NONE 4. The amounts specified in the proposed assessment are changed and altered as follows: NONE 5. This Council finds that each of the lots, pieces or parcels of land ennurnerated in said proposed assessment as altered and mod- ified was and is specially benefited by the STORM SEWER IMPROVEMENT PROJECT NO. 53 in the amount in said proposed assessment as altered and mod- ified by the corrective roll in the amount set opposite the description of each such lot, piece or parcel of land, and that said amount so set out is hereby levied against each of the.res- pective lots, pieces or parcels of land therein described. 6. Such proposed assessment as altered, modified and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified and corrected, with the changes and alterations herein above made, are affir- med adopted and confirmed as the proper special assessment for 7. each of said lots, pieces or parcels of land respectively. Said assessment so affirmed, adopted and confirmed shall be certified to by the City Clerk and filed in his office and shall thereupon be and constitute the special assessment for STORM SEWER IMPROVEMENT PROJECT NO. 53 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of six per cent (6%) per annum. 9. Such assessment shall be payable in one or twenty equal annual installments payable on the 1st day of January in each year, beginning in the year 1964, and continuing until all of said installments shall have been paid, each installment to be coll- ected with taxes collectible during said year by the County. The City Clerk is hereby directed to make up and file in the office of the County Auditor of Anoka County a certified state- ment of the amount of all of such unpaid assessments and the amount which will be due thereon on the 1st day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Sheridan, and upon vote being taken thereon the following voted in favor thereof: Unanimously, and the following voted against the same: None.
