Now, THEREFORE, BE IT RESOLVED, that the City shall and hereby does request the Commissioner of Highways of the State of Minnesota to act as agent of the City of Fridley to design and prepare plans and specifications for all municipally owned utilities located within the corporate City limits that must be relocated due to proposed State construction operations on said Trunk Highway No. 694; to contract for all labor, materials, equip- ment and other services necessary for the completion of said utility re- locations as a part of the. Statets Trunk Highway construction contract, and to make the necessary arrangements to obtain Federal Aid in financing the cost of said utility relocations. Brunsell RESOLUTION NO. 188-1963 A RESOLUTION PROHIBITING ENCROACHMENT - TRUNK HIGHWAY NO. 694 At a regular meeting of the City Council of the City of Fridley duly held on the 2nd day of December, 1963, the following Resolution was offered by Johanson, Councilman, seconded by Wolke, Councilman, to-wit: WHEREAS, the City of Fridley has approved the plans and specifi- cations for the improvement of that part of Trunk Highway number 393 renumbered as Trunk Highway Number 694 within the corporate limits of the City of Fridley from Trunk Highway No. 47 to Trunk Highway No. 65, and WHEREAS, in order to obtain Federal Aid in the construction of said Trunk Highway Number 393 renumbered as Trunk Highway Number 694 the Bur- eau of Public Roads requires the assurance of any nature or kind what- soever on the right of way of said Trunk Highway number 393 renumbered as Trunk Highway number 694 within the corporate limits of said City of Fridley. NOW, THEN, BE IT RESOLVED, that said City of Fridley does hereby agree and covenant that it will never permit or suffer, within its corporate limits, any encroachnent of any kind whatsoever, including curb gas pumps and gas stations, billboards, other structures of any kind whatsoever, upon the right of way of Trunk Highway Number 393 renumbered as Trunk Highway Number 694 and to the above end said City of Fridley hereby agrees that it will never issue any license, permit, or grant or give any leave or liberty or any other consent of whatever form for the =Instruction or maintenance of any encroachment whatsoever, including curb gas pumps and -gas stations, billboards, 5or other structures of any kind whatsoever, upon said right of way; and that said City of Fridley will cooperate insofar as possible to eliminate existing encroachments constituting traffic hazards and will further take any necessary action to eliminate any encroachment that may hereafter exist on said trunk highway right of way. Upon the call of the roll the following members voted in favor of the Resolution: Mayor Nee, Wolke, Johanson, Brook. (Sheridan absent) T he following members voted against its adoption: NONE whereupon the Mayor and presiding officer declared the resolution adopted.
