In 2000,that building was demolished. if In 1999,the subject property was granted a special use permit to allow an automobile • :- service station in a C-2, General Business 1 ' zoning district. The — existing building was then constructed in 2000 as Bona Bros.Automotive Services. In 2003, a special use permit was granted to expand an automotive service station that would connect the gas station with the service station; consequently that connection was constructed in 2004. vn mn �° sns n•! The petitioner is also interested in continuing to create a pleasing image along this corridor. !n { m By gaining additional land area, he would be able to install a wrought iron fence in place of the existing "°° •n= Mn/DOT chain link fence. Prior to any of this work being done,the petitioner will have to submit plans to be reviewed and approved by the Minnesota Department of Transportation. There is an alley along the east side of the subject property that is used by some of the residents on 4th Street. If the vacation of the University Avenue Frontage Road is approved,the petitioner has agreed to allow an access easement through his site to allow those property owners who utilize the alley and access through his site if needed,just as they do today. This access easement will also ensure that a garbage/recycling truck or any other service vehicle will have access through the site. The City will still be responsible for the snow removal of the alley; however the petitioner will now be responsible for snow removal of the vacated University Avenue Frontage Road. STAFF RECOMMENDATION City staff recommends approval of the easement vacation request, with stipulations. STIPULATIONS 1. The petitioner shall submit a landscape plan to be reviewed and approved by City staff prior to installation. 2. Land alteration permit shall be reviewed and approved, including storm water management plan, by City engineering staff prior to work started. 3. The petitioner shall receive approval from the Mississippi Watershed Management Organization prior to issuance of a land alteration permit. 4. There shall be no parking along the vacated University Avenue Frontage Road, except for parking stalls identified on plan, titled "Revised Parking Plan and Easements', dated 12112112. 5. The petitioner shall ensure that activity on his site does not block access to the alley. 6. The petitioner shall submit parking lot expansion plans to Mn/DOT for site plan review. 7. The petitioner shall obtain a right-of-way permit from Mn/DOT for any work done within the right-of-way, including but not limited to fence removal or construction, landscaping, irrigation. B. The petitioner shall sign a maintenance agreement prepared by the City for snow removal and the maintenance of the vacated right-of-way prior to approval of this vacation request. 9. The petitioner shall sign an access easement based on the plan, titled "Revised Parking Plan and Easements", dated 12112112 prior to approval of this vacation request. We officially received your applications for a Street/Easement Vacation and a Special Use Permit on December 14, 2012. It has been determined that the special use permit application is no longer required as you aren't using neighboring residential property for parking of vehicles. As a result, that application fee is in the process of being refunded to you.
