Scott Hickok, Community Development Director, stated the petitioner, Bruce Powers, on behalf of Kurt Manufacturing, located at 5280 Main Street, is seeking a special use permit to expand their existing outdoor storage area which they received a special use permit for in 2009. The special use permit in 2009 was approved to allow a storage container on the west side of the property. The petitioner would like to expand the outdoor storage area on the west side of the property, next to the storage container, for plastic tote storage and then add an area on the south side of the building for pallet storage and plastic tote storage. Mr. Hickok stated the property is zoned M-2, Heavy Industrial as are the properties to the north and south. The Burlington Northern Santa Fe Railroad property is to the west and Single Family Residential properties are located to the east. It is located on Main Street, south of Interstate 694. The property was originally developed in 1959. Several additions have been constructed to that original building since 1959. Mr. Hickok stated City Code allows limited outdoor storage in the industrial districts that is up to 50 percent of the building footprint with a special use permit. The building's square footage is 114,450 square feet, so City Code would essentially allow up to 57,225 square feet of outdoor storage on this site. Planning Commission December 18, 2013 Page 2 of 6 The special use permit approved in 2009 allowed the storage of one storage container on the west side of the property. That storage container remains on site and is 320 square feet in size. The petitioner would like to expand the outdoor area next to the storage container on the west side of the property to allow plastic tote storage. This area is proposed to be 240 square feet in size. So, the west outdoor storage area will be 560 square feet in size. The proposed area on the south side of the building for pallet storage and plastic tote storage, especially during the winter months is 960 square feet (40 feet by 24 feet) in size. Both storage areas combined is 1,520 square feet which is well below the allowable outdoor storage area for this property. Mr. Hickok stated it should be noted that although City Code would allow up to 57,225 square feet of outdoor storage on this site based on the square footage of the building, the site still needs to comply will all other requirements, which are discussed below. So, it is unlikely that 57,225 square feet of outdoor storage could actually occur on this site. Mr.Hickok stated based on the breakdown of uses within the building, parking needs for this site are 273 parking stalls. There are 179 parking stalls on site. The petitioner has articulated they have more than enough parking on-site for employees and have never had a parking issue. Their manufacturing space is full of machine tools and large pieces of equipment used in the manufacturing process. As a result of there are fewer employees. Mr. Hickok stated staff has not noticed that parking has been a problem, but will stipulate that at which time parking does become an issue for this tenant or future tenants of the building that the interior space may need to be re-worked to better meet City Code parking requirements. Mr.Hickok stated the storage container the property owner received a special use permit for in 2009 is in the northwest corner of the property and is not visible from the Main Street. The storage container itself provides sufficient screening. It also provides screening for the plastic totes from the rail right-of-way. The pallet and tote storage location on the south side of the building also is not visible from any public right-of-way, so no screening is required. Mr.Hickok stated the proposed site plan meets all other Code requirements. Mr.Hickok stated City Staff recommends approval of this special use permit, with stipulations as limited outdoor storage is a permitted special use in the M-2, Heavy Industrial zoning district, provided specific Code requirements are met, subject to stipulations. Mr. Hickok stated staff recommends that if the special use permit is granted, the following stipulations be attached. 1. Outdoor storage area shall be limited to the two areas as shown on Exhibit B of the resolution approving this special use permit request. 2. The types of materials stored within the two outdoor storage areas shall be reviewed and approved by the Fire Marshal. 3. If a parking shortage occurs on the site, the petitioner shall develop an agreeable plan approved by City staff to re-work the interior space of the existing building or find other parking options. Commissioner Oquist asked Mr. Hickok, regarding Stipulation No. 3, did he mean interior or exterior? Planning Commission December 18, 2013 Page 3 of 6 Mr. Hickok replied that might seem puzzling, but it is worded correctly. It is saying if a parking shortage occurs on site,the petitioner would work on the overall plan to possible redistribute space inside. If you have a really large open area that can accommodate a number of employees inside the building, it may be that you do not have enough parking outside and to look for,alternatives outside. Staff takes a look at the relationship between the space inside and outside of the building. That is where the petitioner's comment about the machinery becomes extremely important because that space would be huge and would represent an enormous number of parking stalls. It is not anyone's desire to have more j parking than would ever be the demand. However, if they find out they have a parking problem, it may be that there needs to be interior space adjustments so that it is not an imbalanced relationship. Commissioner Oquist asked whether he meant they would have to knock walls down? Mr. Hickok replied not necessarily. There is always the option of buying additional land. Considering that they are already boxed in and buying additional land is probably not a good reality, then maybe the site then is overpopulated in terms of employment there. The City is not trying to tell them how to run their operation other than to say that if parking becomes an issue here, their solution may be an internal fix as opposed to trying to find parking elsewhere. It might mean they do have other facilities, shifting of staff, having something at this facility that is less demanding in terms of employment population. They might have to do some adjustments in size, and this is putting them on notice that at a point where they have a parking issue,they might have to look at that interior balance. Chairperson Kondrick asked the petitioner if he had any questions about the stipulations or any comments? Bruce Powers, Kurt Manufacturing, replied he was a little confused about Stipulation No. 3; but, good and bad, their machines are getting more efficient all the time and require less employees. They expect their employee count will go down in the future instead of going up. Commissioner Sielaff asked, what is their employee count right now? Mr.Powers replied right around 250. Commissioner Sielaff asked,the shifts overlap then? Mr.Powers replied,yes, slightly. Commissioner Sielaff asked they have no parking problems? Mr.Powers replied;no. Chairperson Kondrick asked, what kind of items are stored in the storage containers? Mr.Powers replied,their raw materials come in the totes and on those pallets. Chairperson Kondrick asked,there is nothing hazardous is out there? Mr.Powers replied,no. OTHER BUSINESS: Planning Commission December 18, 2013 Page 5 of 6 Planning Commission End of Year Review Mr. Hickok stated they had no comprehensive plan amendments, but they do have one coming around the corner. Also,they had 1 lot split, 1 master plan amendment, 2 rezonings, 1 special use permits, 0 text amendments, 1 TOD master plan, and 2 vacations. Mr. Hickok stated they were at 19 land use items this year; 21 last year. They have a lot of development around the corner for this year. It has been a fairly typical year in 2013, but staff is sensing a lot more activity next year. Mr. Hickok stated the Planning Commission approved a very big development master plan this year with the Paul Hyde rezoning and BAE property to an S-2 redevelopment district. Mr. Hyde continues to work . on this very exciting project. He has been given some of the early grant dollars that were necessary for the clean-up of his first phase. He does plan to begin the first phase, both the clean-up portion of it and construction of the first building in this next 2014 season. His early projection is it is not going to be a matter of finding people interested in this site, it is producing land fast enough to keep up with the demand. Mr. Hickok stated they have the TOD master plan they approved for the John Allen site. Staff does believe that the first building, Phase I, is going to happen in 2014 which will be a 134,000 square foot office building. There were also two five-level, 150,000 square foot a piece office buildings and 120-unit multi-family building as part of this complex as well. They do anticipate that Mr. Allen will move ahead . with Phase I of this. Mr. Hickok stated they had some health-related facilities that made some nice big additions this year. Special use permit was approved for the construction of the new transitional care facility at Unity Hospital, and theirs started already. Also, the Fairview Clinic has started with their new construction. One of the things they will accomplish is a pharmacy back in the facility. Also, they will have a gurney- sized elevator that is being built on the southern corner of the building which they are excited about because they do perform some day surgeries and have some needs for gurneys. Mr. Hickok stated they had 7 special use permits for outdoor storage, very much like tonight. Much of that comes back through the City's systematic code enforcement process. The industries have been very good to work with. Their sites are all getting cleaned up, and their stuff is now stored very neatly on their sites. It has been a very good year. Mr. Hickok stated also the Citgo station on University Avenue and 61'will be demolished. That will be a great improvement. As they may recall the City has an exclusive development agreement now for the Gateway Northeast site, and staff will be bringing the Planning Commission a master plan right around the corner. It is 256 units of residential and a very nice, high class complex of three buildings that will be the City's first real significant TOD building. Both this development and the John Allen project are within walking distance of the train station. The building south of this Citgo that is coming down will be built in a way that will have an elevator core potentially on the north portion of the building so it can connect to an overpass over University Avenue. If their master plan comes to the Planning Commission the way they have seen it in its early round, they would have a skyway connecting their northernmost section and their second building so people in that building can walk through skyway, get to that corner, and walk over University at some point in the future. SITE DESCRITPTION &HISTORY The subject property is located on the northwest corner of Interstate 694 and University Avenue. It is M surrounded by right-of-way on all sides. In 1966,the original 165,000 square foot building was constructed. Two variances were granted on the subject property since it was originally developed, one oz to reduce the amount of required parking stalls and another to allow the construction of a loading dock facing the public right-of-way. The lot has already been replatted twice to allow for the creation of the existing CVS lot and Holiday gas station lot. i In 2010, the property was rezoned from C-3, General Shopping to PUD, Planned Unit 3 PP g 6 Development. Since that rezoning was ° ' -- approved, several changes have occurred on I the site. Approximately 30,000 sq.ft. of the original building has been removed, Cub Foods has moved to a smaller space on the west side of the building and the Fridley Liquor Store has a new space on the east side of the building. CODE REQUIREMENTS Tri-land Developments Inc. is seeking to replat the subject property to allow for the creation of two separate parcels from the original lot, which will allow for further development along 57th Avenue. The proposed replat will consist of three lots that will be legally described as; Lot 1, Lot,2, and Lot 3, Block 1, Fridley Market. Proposed Lot 1 will be 608,839 sq.ft.or 13.98 acres in size, Lot 2 will be 31,406 sq.ft.or .72 acre in size and Lot 3 will be 27,532 sq.ft.or.63 acres in size. The property is zoned PUD, Planned Unit Development. The PUD designation was approved to allow flexibility with the redevelopment of the property. When the rezoning was approved, a General Plan of Development was also approved that establishes guidelines that dictate what type of quality development the City wants to see. The PUD zoning doesn't have a lot size minimum or maximum; however, staff has generally referred to the most similar zoning designation for comparison. The C-3, General Shopping minimum lot size is 35,000 sq.ft, and the C-2,General Business minimum lot size if 20,000 sq.ft. Lot 1 of the proposed subdivision, where the main building is located would most closely relate to a C-3, General Shopping zoning designation,while Lots 2 and 3,would most closely relate to a C-2, General Business zoning designation. Based on those comparisons,the proposed subdivision would comply with code requirements. Since the PUD zoning doesn't have a minimum lot size requirement and allows flexibility in meeting regular code standards, staff has determined that this preliminary plat meets the intent of the PUD zoning designation and redevelopment of this property. Though Lots 2 and 3 will be separate from Lot 1 for sale and tax purposes, the PUD zoning will need to stay with those properties to ensure lot size compliance. Shared parking and access easements will also need to be established between the lots. RECOMMENDATIONS City Staff recommends approval of the preliminary plat request, with stipulations. • Plat meets the intent of the PUD zoning STIPULATIONS Staff recommends that if the preliminary plat and special use permit are granted,the following stipulations be attached. 1. Staff Report Prepared by: Stacy Stromberg 5925 University Avenue: Land Use Applications S-2 Master Plan #14-01, TOD Master Plan #14-01 and SAV #14-01 THE REQUEST Roger Fink of Trident Development, LLC, is requesting three land use items to allow for the redevelopment of the properties located at 5831 E Ni 5865, 5895, 5905, 5925, 5943, 6005, 6041, 6061, and 6071 University Avenue, known as, "Gateway Northeast". I. S-2 Master Plan—These properties were rezoned in 2012 from C-2 General Business to S-2 Redevelopment District to accommodate future redevelopment. Once there is a development plan for the properties, an S-2 Master Plan needs to be reviewed and approved by the City Council before development can start on site. 2. TOD Master Plan—These properties are Gateway NE within the TOD Overlay District, so a TOD Properties Master Plan also needs to be reviewed and approved by the City Council before development can start. 3. Street and Alley Vacation—In order to accommodate the redevelopment t of the subject properties, a portion of 60tH Avenue from the University Avenue Service Drive to the alley on the east side of the subject properties. An alley is also �- proposed to be vacated that is to the east of the subject properties and south of vacated 59th Avenue. At a later date, a vacation request will be submitted for the University Avenue NE ' Service Drive. Theetitioner is asking for p g approval of the above requested land use items to allow the construction of a phased project for a multi- family apartment community, to be called "Cielo". The project will include (3) separate 51 HP a buildings with the Phase 1 building starting on the corner of University Avenue and 61't Avenue. Phase 2 and Phase 3 buildings will continue south on the remaining properties. There will be covered and surface parking available for all (3) buildings as well as the installation of new landscape features and storm water treatment. SITE DESCRIPTION AND HISTORY The subject properties are approximately 8.86 acres in size total and front on the University Avenue Service Drive from 581h Avenue to 61"Avenue. They were originally developed mainly in the 1950's and 1960's for commercial uses, restaurant and gas stations. When access was limited as a result of upgrading University Avenue, several of the businesses began to suffer and as a result significant vacancies occurred and the buildings became blighted. The City and the HRA have wished to redevelop this area for a number of years and consequently,the HRA started to acquire some of the properties in 2006, after being approached by property owners wanting to sell their obsolete retail buildings. Acquisitions of the properties concluded in 2013 and demolition of the properties was done in three phases. The first phase of demolition was started in late 2009, the second phase took place in 2011, and the last building that was purchased in 2013 (Vet Clinic), was also demolished that same year. The HRA currently owns all of properties involved in these land use requests. Prior to demolition of the buildings, resolutions were adopted determining that certain parcels are occupied by structurally substandard buildings and were to be included in a tax increment financing district. To acquire and prepare the site for reuse, the HRA has spent over$4.5 Million. The properties have a value, depending on its reuse, between $1-2 million. It is this difference of$2.5-3.5 Million that will be paid from the tax increment financing district. If it wasn't for the availability of tax increment to pay for acquisition, demolition, relocation, environmental remediation, infrastructure, and site preparation this project would not proceed. In 2007, the HRA partnered with the Corridor Housing Initiative to brainstorm, collaborate and develop some plans for the future of the subject properties. The buildings proposed by the petitioner are of the similar height and scale as those buildings the neighbors and other residents designed for the site at that time. Below are two sketches of the buildings designed by the residents. IN '. - . In late 2011,the HRA hired Premier Commercial Partners to market the properties. In 2012, there was interest from three different parties wanting to purchase all or at least portions of the property for redevelopment. As a result, City Planning staff and the HRA decided it would be beneficial to have the properties rezoned to the redevelopment district to give the potential buyer/development more flexibility when designing a project. Since the rezoning approval, staff has been working with the Trident Group to develop a plan that meets the goals of the HRA and the City. 2 Over the few months, City staff and the HRA have spent a great deal of time working with Trident, their surveyor, the HRA's title company, Mn/DOT and Anoka County to identify and clean up the issues that p are always associated with plats that were recorded 130 years ago. '. The issues include alleyways that were vacated but not filed at the County, Mn/DOT parcels that have been turned back to the City and other minor corrections that Anoka County is helping to fix. We expect all of the title/plat issues to be resolved in time to allow for a transfer of property to the petitioner this spring. There have also been meetings with utility companies to identify locations of utilities,to ensure that existing utilities will be protected ;n and review new locations for any and all utilities. PROJECT DESCRIPTION ' The proposed development, which will be called, "The Cielo",will have a total of 256 s apartment �kty units, r_ contained in (3) separate y buildings. _ Each building is proposed to � ■11 a be 4-stories, with threes �r stories of living above indoor, ground level parking. Two of the buildings proposed have 104 units and the third building has 57 units. _ Buildings 1 and 2 will be connected to each other through a skyway. Each building will have adequate parking and green space provided to accommodate the development. The petitioner has designed the project with removal of the University Avenue Service Drive. A new private drive coming off of 61"Avenue will be installed on the east side of the subject A`_ properties, which will allow access to the project. The project will also receive access from 60th Avenue and on the south end of the site from the Service Road connected to 57%Avenue. The City is currently working with Anoka County and Mn/DOT on the University Avenue Service Road turn-back documents. Once staff has the clarification needed on those documents, a street vacation request of ' the service road will be reviewed by the Planning Commission and `x City Council. {, " , According to the petitioner, "due to the long, narrow shape of the site, the buildings are positioned in a lineal fashion fronting the ^ length of University Avenue. The buildings are situated approximately 90 ft.from the eastern property line,where the rear yards of the single family homes are located. The surface parking is located on the east side of the building so as to not be visible from University Avenue. A portion of the development will be green space which will offer outdoor amenities such as walking trails, a picnic and grilling area and a gazebo. This open space also allows for certain amount of storm water infiltrations. Sidewalks are also included in the design, providing convenient pedestrian access to public sidewalks and to other areas of the neighborhood." Additional information about the types of services the buildings will provide is attached in the narrative submitted by the petitioner. S-2 MASTER PLAN AND TOD MASTER PLAN ANALYSIS S-2 Master Plan When any property is rezoned to S-2 Redevelopment District, it requires that the accompanying site plan become the Master Plan for the site. Once the S-2 Master Plan is approved by the City Council, any modification to that approved master plan would require a Master Plan Amendment. When this site was rezoned in 2012,a master plan wasn't developed and as a result, "the plan"wasn't approved with the rezoning. This is the first master plan the City is reviewing for the subject properties. Review and Recommendation is also required by the HRA to the City Council before the master plan can be approved. The HRA has seen the plans for the proposed project and will formally review this request at their February 6, 2014 meeting. To allow the HRA time to review this application before it goes to the City Council,this item will go before the City Council on February 10, 2014. TOD Master Plan The Planning Commission and City Council will recall that in 2011, the Transit Oriented Development (TOD) Overlay District was approved. The subject properties are within the TOD Overlay District. See map to the right,for the TOD district boundaries. The proposed development is the City's third TOD Overlay Master Plan request that aims to achieve the desires the City set forth when creating this district. As a result,the project needs to comply with the TOD standards that were designed to enhance the pedestrian scale and safety of any particular development.The TOD Overlay allows for flexibility when designing a redevelopment project that encourages dense, mixed use, pedestrian-friendly developments. It was also created to minimize the use of the automobile by allowing reduction in parking requirements, if certain conditions can be met and sidewalks are constructed. Over the last 8 years the City's HRA has been purchasing and demolishing the dilapidated buildings along this corridor of University Avenue to allow for future redevelopment. The petitioner has designed a project that meets the TOD standards that will enhance the development and achieve what the City and HRA were hoping to see with redevelopment of this land. Below is table showing the new TOD development regulations and how the petitioner plans to comply with them. They also plan to construct a skyway from Building 1 to Building 2,which will go over the vacated 601h Avenue, but will allow enough room for utility companies to get access if need be. When the 12 ft. alley is vacated, the abutting property owners will acquire 6 ft. of additional land along their rear lot lines. As a result,the HRA would get 6 ft. and the neighboring properties to the east would get 6 ft. The additional land area is needed to make this project successful. BUILDING DESIGN- The Cielo is intended to bring a contemporary,urban feel to the University Avenue corridor. The buildings are each designed with flat roof&parapet roof line, multiple variations in the vertical plane(i.e.numerous"bump-outs"and"in-sets")providing visual relief to the long continuous building plan. Buildings 1 and 2 are approximately 576 feet in overall length. A variety of different,maintenance-free exterior materials and colors are also introduced add interest and balance to the building fagade. Exterior materials such as EIFS, cultured stone and metallic panels are currently being considered. The buildings are all designed as four-story structures,however the first floor will contain a parking garage with main entrance(at grade)and common areas. Three stories of apartment units are then situated above the parking structure. There will be no apartment units on first floor. Overall building height is approximately 51 feet. The entire building will be served by an automatic fire suppression system,hydraulic elevator, security camera system and controlled entry devices.
