Land Use Application Special Use Permit #14-09 RE UEST The petitioner, Haider Algezi, of Good Deal Auto Sales, Inc., is requesting a special use permit in order to operate a business that will allow the sale and display of new and/or used vehicles at the property located at 7298 Hwy 65. The use of the property as an automobile service station is no longer in business. HISTORY AND ANALYSIS The subject property is located on the southwest u nu nu 73U 73U � m corner of 73'd nuAvenue and Highway 65. It is zoned C- SOUTH CIRCLE HE m 2, General Business. In 1971, the property wasnu un i nu 7M nu nu nu 7su nu $ rezoned from M-2, Heavy Industrial to C-2, General Business. As a result of the rezoning and special use permit approval, the existing gas station xt,� building was constructed. The property has remained a gas station since. Within the last few months the gas >� station has closed and currently the property is vacant of any business. .SERVICE Op Agencies selling or displaying new and/or used f vehicles is a permitted special use in the C-2, General m Business zoning district, subject to stipulations. b The petitioner plans to utilize the existing building by m remodeling it for sales/office area, storage and .,v restrooms. The parking lot boundary will remain the >u� same, with the exception of closing the east access point to the site from 73rd Avenue. The west access off 73rd Avenue will remain as will the access off the Service Road. The parking lot will be stripped for the display of the vehicles for sale. The submitted site plan shows l8 2 rkin_ttalls along the north and east edge of the parking lot and then four stalls along the west edge for customers. Based on the site plan submitted, no employee arking stalls hav een designated. The petitioner does plan to remove the gas pumps, but leave the canopies and use the area underneath for display of 6 additional vehicles. There are (4) underground gas tanks,which will be required to be removed to MPCA standards prior to operation of this business. It is unclear based on the information submitted whether any exterior improvements are being proposed to the site. Though staff believes this use isn't ideal for this site due to the shape and size of the lot,the use may work only if it strictly adheres to the stipulations suggested by staff. These stipulations are typical of what has been previously approved for other outdoor car sales lots in Fridley. STAFF RECOMMENDATION City Staff recommends approval of these special use permits, with stipulations. Agencies selling or displaying new and/or used vehicles are an approved special use permit in commercial zoning districts, provided stipulations can be met. y STIPULATIONS City staff recommends if the special use permit is approved,the following stipulations be attached. The property owner shall sign the special use permit application prior to filing of the resolution for this special use permit at Anoka County. 2. The underground gasoline/diesel tanks and pumps shall be removed in accordance with an approved Response Action Plan(RAP), approved by the Minnesota Pollution Control Agency (MPCA)prior to issuance of a building permit for the remodel of the existing building or issuance of the City license to operate a car sales lot. 3. The petitioner shall apply for any required building permits for the remodel of the existing building. 4. The petitioner shall comply with any and all building,fire and ADA requirements. 5. The existing free-standing sign is located over a sewer line, as a result, the sign shall either be re- located on-site or an encroachment agreement with the City needs to be executed. The petitioner shall submit a new site plan designated with customer and employee parking prior to issuance of a building permit for the remodel of the existing building or issuance of the City license to operate a car sales lot. 7. All parking stalls used on-site shall be designated through parking lot stripping, customer and employee parking shall be clearly marked. Parking stall size shall comply with code requirements. r S. No vehicles shall be parked in a manner so as to impede the free travel of vehicles in areas intended as drive aisles. 9. No employee or customer parking shall be allowed along the Hwy 65 Service Drive or 73rd Avenue. 10. No vehicles parking shall take place on any boulevard or green areas. 11. No vehicle washing shall take place outside. 12. No vehicle repair shall take place on-site. 13. The petitioner shall install a new dumpster enclosure. 14. The existing building and canopies shall be repainted as part of the building remodel. All old signage from the previous use shall be removed. 15. Any new signage on the building or free-standing sign will required sign permits. 16. The existing bikeway/walkway easement shall remain free of vehicle parking. 17. The petitioner shall submit a landscape and irrigation plan to City staff for review and approval at the some time as building permit submittal for remodel. 18. If the petitioner plans to install a fence on the property, the design and material type shall be reviewed and approved by City staff. 19. The petitioner shall be responsible for litter control on the site and litter shall be cleared from the site daily. 20. The parking lot shall be properly lighted for security reasons, but needs to be shielded and downcast to not impact neighboring properties. 21. The petitioner shall prepare and submit to the City a security plan to assure oversight of the storage lot and to deter crime to the property. The S-2 zoning doesn't have a lot size minimum or maximum; however,staff has generally referred to the most similar zoning designation for comparison. The M-2, Heavy Industrial zoning district requires a minimum lot size of 61,500 sq.ft. or 1.41 acres.The creation of the new lots would most closely relate to an M-2, Heavy Industrial zoning designation. Based on this comparison,the proposed subdivision would comply with code requirements. Since the S-2 zoning doesn't have a minimum lot size requirement and allows flexibility in meeting regular code standards,staff has determined that this preliminary plat meets the intent of the master plan that was approved with the S-2 rezoning for this property. Staff would also like to note that the side yard setback in an M-2, Heavy Industrial zoning district is 20 ft. The portion of the main building that is being kept,will comply with that 20 ft. setback requirements, based on the new property line location. There is a detached accessory building, known as Building 37 to the property owner;that is located north of the existing building and will be approx. 15 ft.from the newly created north property line. Accessory structures in all zoning districts can be located 5 ft.from the side yard property line,so the creation of this new lot will not create a non-conforming setback situation. Project Narrative - Fridley Site Redevelopment The purpose of this memo is to outline the environmental issues associated with the redevelopment of the Site. Existing Conditions The River Road Redevelopment Site consists of 122 acres located at 4800 East River Road in Fridley,approximately Y2 mile south of I-694 and Y4 mile east of the Mississippi River. The existing main building contains approximately 2 million square feet of commercial/industrial space. There are multiple tenants in the building,the anchor tenant being British Aerospace who occupies 1.2 million sf. All leases in the existing building expire by Dec. 31, 2015. Proposed Redevelop Fridley Land LLC is proposing the redevelop the Site into 1.6 million square feet of new industrial buildings, in four distinct phases. The development is being phased to accommodate the existing tenants in the existing building. Phase I of the redevelopment (see attached Phased Site Plan) will occur on the south side of the existing building on a 32 acre parking lot and grass field. Phase I will consist of approximately two buildings, a 213,000 sf Bulk Warehouse and a 135,000 sf Office Warehouse. Phase II of the redevelopment will consist of consolidating a tenant in the existing building into a 560,000 sf office and technology center. Construction of the 560,000 sf building will begin in the Spring of 2015, and be completed in October 2015. This building will be accessed from the existing access to the BAE building on E. River Rd. Phases III of the redevelopment will take place on the northern 30 acres, currently vacant land. Phase III will be accessed from 51St Way. Phase IV will begin once the demolition of the current 2 million building is completed in 2016. Phase IV will be accessed from the signalized intersection of E River Rd and Northern Stacks Blvd. Phases III and IV will consist of approximately 400,000 sf each. The entire redevelopment is expected to take 5 to 7 years to complete Environmental History From 1941 the site has been home to a defense contractor, originally Northern Pump who built gun turrets for Navy ships in World War 11. More recently the site has been occupied by British Aerospace who designs weapon systems for the US Navy. Chlorinated solvents used the Navy in de-greasing gun barrels leaked into site souls and ground water. A superfund cleanup was conducted in the 1990's resulting in the excavation of soils impacted by chlorinated solvents and the construction of a groundwater treatment system operated by the US Navy. The groundwater treatment system consists of a network of 9 ground water extraction wells that run along the western boundary of the Site. Those wells capture groundwater leaving the site and run it through a large charcoal filtration system that cleans the water. The US Navy is responsible for all costs associated with operating the ground water treatment system. Phase I if the redevelopment takes place on the southern portion of the Site which was always a parking lot and grass fields. The Developer conducted a thorough investigation of the Phase I development site prior to redevelopment and the Minnesota Pollution Control Agency (MPCA) approved a cleanup plan that: • Incorporates the black top from the old parking lot in areas under Phase I buildings parking lots and truck docks; • Lines storm water ponds with clay to make sure the Navy's groundwater treatment system is not affected. • Placed a vapor barrier and vent system under building floors to make sure there are no vapors entering the buildings. The Phase I cleanup work is now completed and the MPCA will issue a Certificate of Completion in the Spring of 2015 certifying that all cleanup actions that they required have been completed. MPCA will also provide tenants with a No Association Letter upon request. This process will be repeated for Phases II, III and IV of the redevelopment. The petitioner would like to sell the property at 7220 Central Avenue, but in order to do so the property line needs to be modified to ensure the wastewater treatment building on site remains with the parcel at 124172nd Avenue. The complexity of the infrastructure inside the wastewater treatment building makes it very difficult to relocate the building somewhere else on site; and it is used by the tenant that is located in the building at 124172nd Avenue. As a result,the replat is being requested to modify the existing property line between the two properties. HISTORY AND ANALYSIS The subject properties are zoned M-1, Light Industrial, as are the properties to the north and west. Over the years buildings were added to 1241 72nd. In the mid to late 90's Determan Welding needed more office and warehouse space and in about 1998 entered into a 10 year lease with Joe Miller,the owner of 7220 Central. At the end of the 10 year lease,Determan purchased the 7220 Central property from Joe Miller. During the occupancy of these 2 properties, many improvements were made and connections between the buildings for utilities, phone, computer/internet lines, alarm and fire security, etc. were added. When Determan entered into the lease with Joe Miller around 1998,the West side embankment of the 7220 building was unimproved and soil was eroding away from the 7220 building and washing onto the 1241 72nd Ave property. Due to the elevation gradient from 7220 to 1241, there were very few ways to make good use of this area along the property line between 7220 and 1241. Determan received permission from Joe Miller to: • Build a retaining wall (photo 7220-2) • Pour a sidewalk along the 7220 building(photo 7220-3) • Construct a concrete stair between 7220 and 1241 from the elevation of 7220 to the elevation of 1241 (photo 7220-4) • These improvements eliminated the erosion of soil from 7220 to 1241,made it safer to walk along the side of 7220 at all times and especially in the winter, move between buildings at 7220 and 1241, and allowed 1241 to use the east side of the 1241 property more efficiently. (photo 7220-5) In exchange for these improvements,Joe Miller, owner 7220, granted Determan, owner 1241,permission to build a portable shed encroaching on 7220 in the area improved by Determan. See photo 7220-6. With the elevation gradient between 7220 and 1241 it would be difficult in any circumstance and/or impractical for the owner/occupant of 7220 to use the property between the property line and the building in the unimproved state with a soil or grass embankment. The 7220 building does not have any windows or doors on the west side. To improve both properties,Determan made the changes detailed above and was able to utilize this area as Determan occupied both buildings and had significant pedestrian traffic between the 7220 and 1241 buildings. Determan Welding a/k/a Determan Brownie sold most of the business assets in 2 separate business asset sales on Oct 29, 2012, and April 30, 2013. With the sale of the business assets,the need for the buildings has changed and the buildings are now occupied by other entities. The 7220 property is no longer engaged in a"common tenancy"with 1241 and therefore there is no longer any need for pedestrian traffic between the 2 buildings. Restoring the area to its prior state would serve no useful purpose and would only degrade the value of both 7220 and 1241. DET 7220 is submitting this variance request to alter the property line permanently to reflect the current configuration of the sidewalk, retaining wall,and stairway. (Variance and Lot Split) The photos take about 3 messages to transmit due to file size so I'll start sending them over. The wastewater treatment building is not a shed. It is insulated, heated, properly wired, and houses some wastewater treatment equipment owned and operated by our tenant WCEC Industrial Services, LLC. There are underground pipes, wiring, and sanitary sewer lines coming up inside the building. Moving it would be difficult due to the complexity of the infrastructure inside, and finding a new location that could connect to all of these systems, especially the underground piping, would be very difficult. Additionally, the disruption to the treatment process would put the operator out of business for the period while the system is relocated, probably weeks due to the complexity of the systems involved. The treatment process removes contaminants from contaminated snow and water removed from petroleum spills caused by truck rollovers, railcar spills, and petroleum tank leaks and cleanups. This is a very important service provided to the 5 state area. I will forward photos of the treatment equipment that is inside the building.
