WHEREAS, the Minnesota Women of Today and the Fridley Women of Today have set aside
July 1 to recognize the many community activities of dedicated Women of Today members across
the state; and
WHEREAS, the Minnesota Women of Today is an organization of over 1,200 women in 65
chapters across the state; and
WHEREAS, the Minnesota Women of Today and the Fridley Women of Today are dedicated to
actively promoting such public awareness and service programs as: Domestic Violence
Prevention, Breaking Free, Tour de Cure Bike Ride for Diabetes, Relay for Life, Fridley'49er
Days, SACA Food Drive, School Supply Drive and Santa's Workshop; and
WHEREAS, the Minnesota Women of Today and the Fridley Women of Today provide personal
enrichment and leadership training; and
WHEREAS, the Women of Today believe that "Through us, great lessons can be learned,
worthy deeds performed, and a hand of fellowship extended to millions of women everywhere. "

APPROVAL OF CONSENT AGENDA:
Councilmember Bolkcom asked if Item No. 2 would not be approved until it is back behind the
right of way.
Scott Hickok, Community Development Director, said they chose a position that does not need a
variance, and it is better. The new location creates a nicer site line.
Councilmember Saefke asked if there was the capability to dim the sign if it was really bright.
Mr. Hickok replied yes. Currently, the City does not have a measuring device to set a standazd
for brightness in signs. The sign has to be a certain distance from residential and others to
address that issue. Sometimes new sign owners put a bright background and dark text but you
see the background and not text. The text looks better on a dark background with these types of
signs. As they work with the sign, they will find something that works. Staff has received no
complaints. Nearly every church has an electronic sign.
Roland Peterson, 235 Craig Brook Way, Chair of the Board of Elders, stated that the current
sign is very old, broken and is no longer an asset to anyone. He said 73`d Avenue is a busy street,
and a good place for the sign. They will be able to advertise food distribution and other events
happening at the church. The new location of the sign puts it further away from residents and
will be a good asset for�he church and the City.
MOTION by Councilmember Barnette to approve the proposed Consent Agenda. Seconded by
Councilmember Varichak.

OPEN FORUM:
Pam Reynolds, 1241 Norton Avenue, has an issue with the new website. It looks like it is Civic
Plus, the same as Anoka County, and it is not very user friendly. She will learn how to use it but
the old design was much better to work with and easier to navigate.
Wally Wysopal, City Manager, replied that it is Civic Plus. The benefits of the new website is
that when using it from a smart phone you can see the entire page. Staff has received positive
ca11s and emails about this design from people who access it on their smart devices. The old
website did not convert the webpage to the portable devices.

PUBLIC HEARING•
7. Consideration of a Proposed Text Amendment, TA #15-02, Amending Chapter 205.33
of the Fridley City Code Pertaining to Transit Oriented Development Overlay District.

Scott Hickok, Community Development Director, stated the purpose of the text amendment is to
incorporate the design criteria of the Norkhstar TOD Master Plan adopted by City Council on
December 8, 2014, into the City Code--lighting, benches, waste receptacles and bike racks, to
consider changing the electronic sign prohibition, to define "redevelopment" and to change the
Farmers Market reference.
Mr. Hickok stated the current TOD Overlay Code prohibits electronic, changeable signs. The
Holiday Station Store and CVS Pharmacy obtained their signs before the creatinn of the TOD
Zoning District. The SA gas station on 57th Avenue wants an electronic gas price sign.
Typically, electronic signs are prohibited in TOD Areas, so Fridley followed that standard.
However, Fridley has many high speed roadways in the TOD area, where you typically see
electronic, changeable message signs.
Mr. Hickok stated staff still finds that electronic wall signs are not pedestrian friendly, but
recognizes that free-standing signs are designed to be viewed by vehicle traffic from greater
distances. The purpose is to have a uniform look and pedestrian scale design. The text
amendment will incorporate the designs already approved into code.
Mr. Hickok noted the Planning Commission held a public hearing on May 20, 2015. No one
from the public appeared at the hearing. The Commission approved the proposed amendment
language unanimously. The City Council must also hold a public hearing on text amendments.
Councilmember Bolkcom asked if the lights were approved.
Mr.Hickok replied yes. There was no motion made to take them out of the TOD standard.
Councilmember Bolkcom asked if those were the lights that had to be used.
Mr. Hickok replied they are looking for uniformity. The issue could be addressed and be
brought back for a new standard if needed. The light is downcast and shielded, plus it meets the
code requirement.

Pam Reynolds, 1241 Norton, asked about the benches and if the cutout of the grass was safe for
small children.
Councilmember Bolkcom replied the children would not get hurt and it is a nice bench.
Ms. Reynolds asked if the developer paid for the lights.
Mr.Hickok replied yes.
Ms. Reynolds asked on the first page of ordinance in Item No. 4, where it talks about when the
site is ready for redevelopment, is that was the same as someone tearing down a garage at an
apartment complex and putting something that is better in place.
Mayor Lund replied her example would be considered a replacement of a deteriorated building
structure. This ordinance reads only for the TOD.
Mr. Hickok added in her example, the principle structure is remaining and the accessory
structure is being removed; that is not redevelopment. Redevelopment is removing the entire
structure and starting over.
Ms.Reynolds asked if Triland was a redevelopment.
Mr. Hickok replied that was a PUD; so it is a different classification.
Ms. Reynolds said thought that on 205.33.10(1) Landscaping, B, Item 3; there is a word or
something missing.
Mr. Hickok will make a note of the ordinance and bring to Council.
Ms. Reynolds asked on Item C, Water, what are green walls and filter strips.
Mr. Hickok replied there are a number of advances in stormwater management. A green wall is
the framework to allow plants to grow and take the storm water into the wall and structure.
Filter strips are horizontal and slow down the water to help the water filter into the soil.
Ms. Reynolds asked where the list of best management practices was listed in the street lighting
section.
Mr. Hickok replied the best management practices go back to the standards to any new building
or lighting and have best management practices in the engineering and that will be pointed out in
the first reading.
Mayor Lund asked if the changes Ms. Reynolds was referring to were changes or in the existing
ordinance.
Ms. Reynolds replied that they are underlined as changes.

Councilmember Bolkcom noted that Council did not have the entire ordinance; only the
changes.
Attorney Erickson recommended keeping the public hearing open and proceeding to the first
reading.

Councilmember Saefke.

NEW BUSINESS:
8. Resolution Considering a Comprehensive Plan Amendment, CP #15-01, to Update the
Economic Redevelopment and Transportation Chapters of the Fridley 2030
Comprehensive Plan
Scott Hickok, Community Development Director, stated the text changes are extensive due to
the numerous changes within the building of the Northstar Train Station and many new projects
in the TOD Zoning District. Recognition of the Northstar TOD Plan is critical for future City
Planning. Recognition of the Active Transportation Plan is essential for future trails/sidewalk
expansion.
Mr. Hickok noted the Planning Commission held a public hearing on May 20, 2015 and no one
from the public appeared to testify. Staff will await feedback from surrounding jurisdictions (due
by July 18) before submitting the amendment to the Metropolitan Council. Once the Met
Council approves the amendment, it will come back to the City Council for final consideration.
Staff recommends forwarding Comprehensive Plan Amendment, CP #15-01, to the Metropolitan
CounciL
Councilmember Bolkcom asked if Council could see the neighboring communities' comments
before it goes to the Met Council.
Mr. Hickok replied that staff could create a document with comments if needed
Councilmember Bolkcom asked how staff chose what to change and what not to change.
Mr. Hickok replied they only added what is new to the Comprehensive Plan. They do not want
to change the entire plan.
Councilmember Bolkcom asked what a road diet was.
Mr.Hickok replied that a road diet reduces the roadway, making it narrower and more defined.
Councilmember Saefke asked why St. William's Park and Ride was crossed out.

- Mr. Hickok will check on it and get back to Council. Maybe that Parlc and Ride is not going to
continue.
Mayor Lund replied if that is correct,the map needs to be changed as well.
Pam Reynolds, 1241 Norton Avenue, asked why it was so important to go through this process
change if the Comprehensive Plan will be rewritten next year.
Mayor Lund replied that the Comprehensive Plan rewrite starts next year. It will take about
three years to rewrite the entire plan.
Mr.Hickok added the law reads to make amendments to update the Comprehensive Plan.
Mayor Lund asked what was driving this item.
Mr.Hickok replied the requirements of the Metropolitan Council.
MOTION by Councilmember Bolkcom to adopt Resolution No. 2015-35. Seconded by
Councilmember Barnette.

9. Motion to Receive the Fridley Columbia Arena Corridor Development Initiative
Summary Report and Final Recommendations.
Gretchen Nichols, LISC, said she is honored to be part of this process which creates a better
understanding and looks at what is possible before a developer shows up with a proposal. It also
creates working relationships with stakeholders which lead towards efficient production. This
process engages a wide range of experts and there was a lot of community outreach and
communication.
Ms. Nichols stated that the process involved four workshops and topics which were to gather
information, participate in a block exercise, have a developer panel, and frame the
recommendations. There are a lot of positive things about the site, and it is in a remarkable
location. Development ideas included creating a mix of uses like housing options, environmental
improvements and options for different age groups. Some concerns were not to start something
that cannot and to also include public amenities.
Barbara Ray, Center for Policy and Performance, noted that most people have an emotional
connection to the arena. They would like to preserve some things but change will still happen.
They discussed what is important to preserve and what the opportunities are. People can get
excited about change if it is done well and people have advance notice of what is coming.
Ms. Nichols noted that the Columbia Arena is an iconic symbol in the community. It took time
for people to accept that the building is not salvageable. A block exercise was done and people

interacted to build different development scenarios. The areas used included the Columbia site,
the Columbia site plus the park and the Columbia site, the park and the Public Works site. All
three areas have various scales and potential and it can be difficult to calculate how much private
industry is needed to recoup the public investment.
Ms. Ray noted there is a strong interest for public investment on this site which would increase
taxes so the conversation ended with a mix use.
Ms.Nichols stated the third workshop was the developer panel which came up with a wide range
of ideas. There is a challenge to get the right balance, but it was agreed that a mix of housing,
small office and commercial would be best. Natural amenities were a strong interest for
residential uses. The last workshop is where the draft goals were developed. The challenge is to
determine what the right scale would be. Different options were discussed but there was a strong
support for Options B and C, with the majority for Option B.
Ms. Nichols outlined the three goals:
1. To preserve and enhance the amenities of the area through greater connectivity.
2. To create an area that is unique and special that serves to provide new elements that
are not currently available in the community.
3. To make public use work, advance a public/private partnership that benefits the
community, which might include:
• Residential Development
• Small lot or townhome options
• Consider non-traditional types of housing such as senior coops
• A mix of mid-density housing options
• Space Dedicated for special uses such as farmer's markets, outdoor theater, or
music
• To serve as a buffer between the industrial area to the north and the rest of the
site, reconfigure the public works facilities and potentially relocate the City Hall
and other City services (Police and Fire).
• A multi-generational community center which could include rental spaces (this
is an option only if Scenario C expands the use of land for redevelopment,
although there is disagreement).
Ms. Ray added they want to attract people to Fridley and it was a generational conversation.
There is interest in mass transit and different types of housing and to bring in something new that
people need which is not currently being addressed. �
Ms. Nichols continued that these recommendations can be used as marketing materials for new
developers and will help show a developer what the community is trying to create in this
location.
Ms. Ray stated that a small percent of people filled out the evaluation forms. There was strong
support for the project and everyone's voice was heard through this process.

Ms.Nichols stated this was the highest participation they have ever experienced.
Mayor Lund noted that there was a dynamic change to every meeting; including people
adamant this is owned by the City and they wanted to leave the entire area as public area. This
requires public and private partnership because of the cost and not to overburden the t�payers.
It is a great opportunity and we want to get it right.

Development Initiative Summary Report and Final Recommendations. Seconded by
Councilmember Varichak.
Mr. Hickok stated that after the document is received by Council it will be on the website for
everyone to see and read.

SUBJECT: Receive and Reject Bids, Miscellaneous Concrete Project No. 473
City staff published a request for bids for the 2015 Miscellaneous Concrete Repair Project
No 473 on June 4th, and received bids from three contractors on Thursday June 1 gtn
The work generally includes miscellaneous repair and replacement of curb, concrete
walks, driveway aprons concrete panels, and boulevard restoration associated with
infrastructure repair, or driveway repair or replacement.
Advertisements were published requesting bids, and six sets of plans and specifications
were sent out and three bids were received as shown in the attached bid tabulation.
The apparent low bidder was Twin City Outdoor Services, with Ron Kassa Construction
and Pember Companies second and third. The first and second low bids were found to
be non-responsive, and the third nearly three times the amount of the low bid.
Staff requests that the City Council move to receive the bid per the attached bid

Subject: Continued Public Hearing for Northstar TOD Zoning Overlay District Text
Amendment, TA#15-02
Background
Due to the City Council not receiving the full staff report on this proposed text amendment at the last
meeting, it was requested that staff continue the public hearing for TA#15-02 onto the next meeting agenda.
As presented on June 8,this text amendment is proposed by staff to incorporate the design specifications of
the Northstar Transit Oriented Development(TOD)TIF Master Plan into the Northstar TOD Zoning Code
text. The TOD Master Plan, specifies design criteria for lighting,benches,bike racks,waste receptacles and
planters,which developers need to be aware of when implementing individual projects based on the Master
Plan of the TOD district. These bench and lighting components of the Northstar TOD Master Plan are part of
a document that was approved by the Fridley City Council last December,as well as,the Metropolitan
Council as part of our final LCDA grant report. Code requires City Council review and approval of each
individual TOD Master Plan. If the City Council has concerns about how a specific design feature blends
with a proposed development,they will have the opportunity to request something different at that time.
Besides adjusting some definitions and other language adjustments,another purpose of this text amendment
is to revisit the electronic sign restriction. Staff has been receiving many requests for electronic changeable
message signs in the TOD Zoning District from properties along 57'�Avenue,so, in support of local
business,staff suggests that the City Council consider changing the electronic sign restriction.
Analysis
The TOD code currently prohibits electronic signs.The purpose for the prohibition was that electronic signs
on buildings cannot be read by someone walking on the sidewalk next to a building and are commonly
prohibited in pedestrian-oriented development for that reason—keeping design features at a pedestrian scale.
Fridley has a rather unique TOD District,however,bordered by a freeway and having two highways dissect
it. In addition,technology is improving for electronic signs,making them easier to read at a closer distance.
As staff has considered the design impacts to Fridley's TOD area,we concluded that electronic,changeable
message signs would be acceptable on free-standing signs that are designed to be viewed from passing
vehicles. Staff continues to take the position that changeable, electronic wall signs would not be appropriate

in the TOD area where buildings will be built within ]5 feet of the property line, close to the roadway. It is
legal for staff to make this distinction in the sign code,because we are regulating location, not content of the
signs.
The Planning Commission held a public hearing regarding TA#OS-02 on May 20, 2015 and approved the
proposed amendment unanimously. No one appeared from the public for the hearing. Chair Kondrick did
suggest that the City consider design specifications for signs. Staff recommends that sign design and colors
be considered and reviewed carefully during the individual master plan review process. Any multi-tenant
building will be required to have a sign plan approved by the City Council, and Council would have
discretion at that time to influence a certain design or color scheme in a sign plan.
Recommendation
Staff recommends that the City Council reopen and continue the public hearing regarding this proposed text
amendment, TA# I 5-02, on June 22, 2015, and hold the first reading of the proposed ordinance language on
the same night. Normally, the City would not conduct the first reading of an ordinance on the same meeting
agenda as the public hearing, but here is a business awaiting a decision on this amendment. The Planning
Commission has already reviewed and approved a special use permit request for a free-standing, electronic,
gas pricing sign from the Super America gas station on University and 57`h, which is in the TOD Overlay
Zoning District, pending approval of this proposed text amendment. The special use permit request for the
electronic sign is scheduled to come before the City Council on July 13.

AN ORDINANCE AMENDING CHAPTER 205.33 OF THE FRIDLEY CITY CODE
PERTAINING TO TRANSIT ORIENTED DEVELOPMENT OVERLAY DISTRICT

The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that the Fridley City Code be hereby amended as follows:
Section 1: That Section 205.33.03, District Boundary, of the Fridley City Code be hereby
amended as follows:
The TOD Overlay District consists af those areas designated on the Northstar TOD District map,which is
Ap�endix A to this Cha�ter and is on file with the City Clerk and dated Apri122,20l 1.
Section 2: That Section 205.33.04, Definitions, of the Fridley City Code be hereby
amended as follows:
205.33.04. DEFINITIONS
The following words, terms, and phrases, when used in this section, shall have the meanings ascribed to
them in this Section, except where the context clearly indicates a different meaning;
1. Drive-Through Service
A type of service provided by a business that allows occupants of a motor vehicle to receive or obtain
a product or service through a building opening without leaving the vehicle.
2. Mixed Use Structures
A building or development that contains two or more different uses such as, but not limited
to, residential, commercial, industrial, or public facilities.
3. Primary Street
The street adjoining the property which has the highest traffic counts.
4. Redevelonment
When all of the existin� structures on a site are removed to read�the site for new construction.
54. Zero Lot Line Setback
The location af a building on a lot in such a manner that one or more of the building's
exterior edges xest directly on a side property line.

Section 4: That Section 205.33.07, Process for TOD Plan Approvai, of the Fridley City
Code be hereby amended as follows:
205.33.07. PROCESS FOR TOD PLAN APPROVAL �
A. Plans for each individual project or combination of projects in the TOD District must be
submitted upon payment of any required fee as provided in Chapter 11, except plans for
individual, detached, single family housing construction projects in the Hyde Park zoning
district, which are exempt from the TOD plan review process. Project plans will be
reviewed by the Planning Commission, who will provide a recommendation to the City
Council. The City Council shall have final authority to approve all project plans.
B. Project plans submitted to the Planning Commission and City Council shall include the
following minimum criteria:
(1) Scalable site plans, showing the location of buildings, off-street parking, street and
utility locations, auto and pedestrian access to and from the project, any modification
to existing services, grading plans, storm water plans, building exterior finish,
lighting and signing, TOD streetscape features, and landscape plans.
Section 5: That Section 205.33.08, Design Criteria, of the Fridley City Code be hereby
amended as follows:
205.33.08. DESIGN CRITERIA ,
All new development or redevelopment TOD proposals requiring a building permit after the
effective date of this ordinance must meet the following design criteria standards designed to
enhance the pedestrian scale and safety of the development. Single family construction projects
located within the Hyde Park Zoning Overlay District are exempt from following the TOD
design standards. In situ�tions where an existing building is being partially expanded, the new
standards will only apply to the new addition, except as provided in Section 205.33.08.B,
Setbacks. Landscapin� and streetscape design features shall be specified in a pro�ect's Master
Plan to match the models shown in Appendix B of this code section.

Section 6: That Section 205.33.10, Landscape and Streetscape Requirements, of the
Fridley City Code be hereby amended as follows:
205.33.10 Landscape and Streetscape Requirements
1. Landscaping
A. Scope
A landscaping plan shall be submitted according to the requirements of the underlying
zoning district, except for as provided in Sectian 205.33.10.B.1. Mixed use projects must
have a unified landscaping scheme. The landscaping reguirements in this Chapter will
only apply to new construction projects or prajects where existing buildings are expanded
to the reduced 15 foot setback.
B. Plant Materials Substitutions
The landscaping requirements in the underlying zoning district shall apply to properties
in the TOD Overlay District with some exceptions.
1) TOD landscape plans for redevelopment of property located in the underlying
Hyde Park zoning district must follow the landscape requirements for the
zoning district that most closely represents the use proposed.
2) In the TOD Overlay District, one ornamental tree will count as one over-story
deciduous tree. In addition, ornamental trees may exceed 50 percent of the
required trees.
3) Due to the amount of hardscape needed for pedestrian walkways, if the level
of open space for planting restricts the ability to provide adequate growth
space for tree roots, shrub�er� and perennial planting beds, permanent
lp anters, • e�s may also be substituted for over-story trees at a rate
of 36 square feet per tree.
4) Decorative walkway light poles meeting the
�T'n'-' a:�+�;�+ desi�n_specified in the Fridley Northstar TOD TIF District
Master Plan as shown in Appendix B may be substituted at a ratio of one light
pole for two trees if the site design warrants additional walkway lighting.
5) Street-side sculptures, public art, permanent or movable �ge planters,
, light pole banners, clock towers, arbors, seating
benches, or similar ornamentation may be considered as substitution to meet
landscaping requirements.
If it is not feasible to meet the landscaping requirements of the underlying zoning district
with the allowed substitutions above, the City may approve a monetary payment per fees
established in Chapter 11 into the TOD Capital Project Fund for the purpose of funding
streetscape amenities within the street rights of ways within the TOD overlay district.

lighting in the TOD District. Pedestrian-oriented lighting is required on all streets, trails,
sidewalks, and public gathering places within the district. A lighting plan and fixture
specification schedule shall be included in the documents submitted to the City for
approval. Ener�v efficiency is encouraged in all aspects of a project's Master Plan

E. Outdoor Dining
Outdoor dining areas may be incorporated into the front and side yard setbacks up to five

designed with safety protections that reasonably attempt to prevent vehicles from
accidentally encroaching into the dining area. Store locations that serve alcohol must
apply for a patio endorsement on their liquor license, but relaxation of screening
requirements may be considered by the City in the TOD District.

Background
Following completion of the public hearing for TA#15-02 on June 22,2015,staff encourages the City
Council to conduct the first reading of the ordinance amending Chapter 205.33 of the Fridley Zoning Code.
The purpose of this text amendment is to:
1. Incorporate the design specifications of the Northstar Transit Oriented Development(TOD)TIF
Master Plan into the Northstar TOD Zoning Code text.
2. Consider allowing electronic changeable free-standing signs in the TOD Overlay District
3. Add a definition for the term"redevelopmenY'to ensure that existing businesses can expand without
being required to meet the 15' m�imum front yard setback.
4. Remove the language about farmers markets that is now outdated due to other code changes
Commission Review
The Planning Commission held a public heazing regarding TA#OS-02 on May 20,2015 and approved the
proposed amendment unanimously.No one appeared from the public for the hearing.
Recommendation
Staff recommends that the City Council hold the first reading of the proposed ordinance language for
TA#15-02 on June 22,2015.The City has received a special use permit request for a free-standing,
electronic,gas pricing sign from the Super America gas station on 57'�,which is in the TOD Overlay Zoning
District,pending approval of this proposed text amendment,which is scheduled to come before the City
Council on July 13.

AN ORDINANCE AMENDING CHAPTER 205.33 OF THE FRIDLEY CITY CODE
PERTAINING TO TRANSIT ORIENTED DEVELOPMENT OVERLAY DISTRICT

The City Council of the City of Fridley hereby finds, after review, examination and
recommendation of staff, that the Fridley City Code be hereby amended as follows:
Section 1: That Section 205.33.03, District Boundary, of the Fridley City Code be hereby
amended as follows:
The TOD Overlay District consists of those areas designated on the Northstar TOD District map, which is
Ap�endix A to this Chapter and is on file with the City Clerk and dated April 22,201 l.
Section 2: That Section 205.33.04, Definitions, of the Fridley City Code be�hereby
amended as follows:
205.33.04. DEFINITIONS
The following words, terms, and phrases, when used in this section, shall have the meanings ascribed to
them in this Section, except where the context clearly indicates a different meaning;
1. Drive-Through Service
A type of service provided by a business that allows occupants of a motor vehicle to receive or obtain
a product or service through a building opening without leaving the vehicle.
2. Mixed Use Structures
A building or development that contains two or more different uses such as, but not limited
to, residential, commercial, industrial, or public facilities.
3. Primary Street �
The street adjoining the property which has the highest traffic counts.
4. Redevelopment
When all of the existin¢ structures on a site are removed to readv the site for new construction.

The location of a building on a lot in such a manner that one or more of the building's
exterior edges rest directly on a side property line.

Permitted uses in the O-8 TOD Overlay District are those uses which are acceptable to the
Northstar TOD Master Plan as

Section 4: That Section 205.33.07, Process for TOD Plan Approval, of the Fridley City
Code be hereby amended as follows:
205.33.07. PROCESS FOR TOD PLAN APPROVAL
A. Plans for each individual project or combination of projects in the TOD District must be
submitted upon payment of any required fee as provided in Chapter 11, except plans for
individual, detached, single family housing construction projects in the Hyde Park zoning
district, which are exempt from the TOD plan review process. Project plans will be
reviewed by the Planning Commission, who will provide a recommendation to the City
Council. The City Council shall have fina] authority to approve all project plans.
B. Project plans submitted to the Planning Commission and City Council shall include the '
following minimum criteria: �
(1) Scalable site plans, showing the location of buildings, off-street parking, street and
utility locations, auto and pedestrian access to and from the project, any modification
to existing services, grading plans, storm water plans, building exterior finish,
lighting and signing, TOD streetscape features, and landscape plans.
Section 5: That Section 205.33.08, Design Criteria, of the Fridley City Code be hereby
amended as follows:
205.33,08. DESIGN CRITERIA
All new development or redevelopment TOD proposals requiring a building permit after the
effective date of this ordinance must meet the following design criteria standards designed to
enhance the pedestrian scale and safety of the development. Single family construction projects
located within the Hyde Park Zoning Overlay District are exempt from following the TOD
design standards. In situations where an existing building is being partially expanded, the new
standards will only apply to the new addition, except as provided in Section 205.33.08.B,
Setbacks. Landscaping and streetsca�e desi�n features shall be specified in a project's Master
Plan to match the models shown in Appendix B of this code section

Section 6: That Section 205.33.10, Landscape and Streetscape Requirements, of the
Fridley City Code be hereby arnended as follows:
205.33.10 Landscape and Streetscape Requirements
1. Landscaping
A. Scope
A landscaping plan shall be submitted according to the requirements of the underlying
zoning district, except for as provided in Section 205.33.10.B.1. Mixed use projects must
have a unified landscaping scheme. The landscaping requirements in this Chapter will
only apply to new construction projects or projects where existing buildings are expanded
to the reduced 1 S foot setback.
B. Plant Materials Substitutions
The landscaping requirements in the underlying zoning district shall apply to properties
in the TOD Overlay District with some exceptions.
1) TOD landscape plans for redevelopment of property located in the underlying
Hyde Park zoning district must follow the landscape requirements for the
zoning district that most closely represents the use proposed.
2) In the TOD Overlay District, one ornamental tree will count as one over-story
deciduous tree. Tn addition,•ornamental trees may exceed 50 percent of the
required trees.
3) Due to the amount of hardscape needed for pedestrian walkways, if the level
of open space for planting restricts the ability to provide adequate growth
space for tree roots, shrub�er3� and perennial planting beds, permanent
lanters e�s may also be substituted for over-story trees at a rate
of 36 square feet per tree.

Master Plan as shown in Appendix B may be substituted at a ratio of one light

established in Chapter 11 into the TOD Capital Project Fund for the purpose of funding
streetscape amenities within the street rights of ways within the TOD overlay district.

walkways. Alternative storm water treatments such as permeable pavers, porous asphalt,

specifications in Appendix B and coordinated with the overall design of City-installed
lighting in the TOD District. Pedestrian-oriented lighting is required on all streets, trails,
sidewalks, and public gathering places within the district. A lighting plan and fixture
specification schedule shall be included in the documents submitted to the City for
approval. Energy efficienc�is encoura�ed in all aspects of a project's Master Plan.
C. Signs
Changeable electronic signs will only be allowed on free-standin signs according to the
requirements in Chapter 214 of Citv Code and will not be allowed as wall si n�s in the
TOD District. Door and window awnings are encouraged and will not count towards wall
signage percentage allowed on a building face.

Decorative fencing, railings, walls, bike racks, benches, and waste receptacle screening

E. Outdoor Dining

designed with safety protections that reasonably attempt ta prevent vehicles from
accidentally encroaching into the dining area. Store locations that serve alcohol must
apply for a patio endorsement an their liquor license, but relaxation of screening

SUBJECT: Approve Cost-share Grant Agreement with the Rice Creek Watershed
District for Village Green Stormwater Detention Expansion
On July 2011, a severe rainfall event occurred in the City of Fridley. Several properties east of
Village Green Apartments and bordering on their storm water detention area experienced flooding
as a result of this storm.This detention area receives water from an approximate 80-acre watershed
which reaches south to 61 st Avenue befinreen 5th and 7th Streets,east to Quincy Street along 63rd
Avenue,and northwest to the Fridley Municipal Center property(see attached map).As a condition
of development,Village Green was to provide stormwater runoff storage for a 50-year rainfall event.
City staff surveyed the detention basin area and initiated a study of the capacity of the storm water
management system adjacent to Village Green Apartments.This study concluded that the 50-year
event storage was no longer provided by the detention area, and that 1) excavation of filled in
areas, and 2) modifications to outFall piping and the control structure could potentially provide
additional flood storage and water quality improvements.
We are interested in enhancing flood protection in this as one of three most vulnerable areas in the
City of Fridley, and therefore have explored alternatives for potential cost share opportunities to
enhance the basin's flood storage capacity to the 100-year event. We have identified opportunities
for cost-sharing of this project through the Mississippi Watershed Management Organization and
Rice Creek Watershed District, as the project also achieves water quality goals of these agencies. _
Wall Companies, who own and operate the Village Green site, and the City of Fridley have
partnered with the Mississippi Watershed Management Organization (MWMO) for cost-share
assistance in funding preliminary analysis work. A future funding request will be sought from the
MWMO for construction beyond the established 50-year design requirements for this detention
system.
The City of Fridley prepared an additional funding request which has been approved by the Rice
Creek Watershed District for a$50,000 cost-share in construction. The entire project is estimated
- to cost$174,650.00,which includes contingency for the project pending conclusion of detailed site
analysis. Match funding for the current budget would be provided by the following sources: 1)Wall
Companies for the proportionate cost/share to provide for their required 50-year storage($50,000
estimated), 2) MWMO request for cost-share for construction ($50,000 estimated), and 3)City of
Fridley Storm Water Utility capital funds available forthis project($25,000 estimated). Agreements
formalizing these match sources will be presented as secured by the City. If matching sources do
not meet the City's allocation for the project, the scale of the work completed may be reduced.

In order to formalize and outline this funding commitment from RCWD, the attached grant
agreement has been reviewed and approved for execution. Staff is recommends that the City
Council move to approve the attached Rice Creek Watershed District cost-share grant
agreement for the Village Green Stormwater Detention Expansion.

easement or detlaration must be approved by the District before it is recorded.
C. Construction and Maintenance. The City,through its pwn personnel and or contractors,will
construct the Praject in ac�ordance with the approved Project plans and specifications and
maintain it indefinitely in accordance with the approved maintenance plan. In doing so,the City
will comply with all applicable laws and regulations and witl be responsible for acquiring all
permits,approvals and temporary and permanent rights of access or easement.
D. .Completion nf Construction. The City's staff or consulting engineer will certify the completion of
Project construction no later than December 31,2017. The City wil!submit to fhe District
docamentation of Project expenditures and the certification o#completion no later than March
31,2018,
II. DISTRICT RESPONSIBILITI�S.
A. Cost-Share funds. To defray the Project cost to the City,the District wi8 provide the City cost-
share assistance in the amount of 50 percent of the ProjecYs eligible costs,as determined by the
District,not to exceed$SU,OOO.tI�.
B. Payment Schedule. On District approval of the Project plans and specifications and maintenance
plan,certification by the Gty that it has obtained all necessary permits and approvals,and
receipt of the City's issued notice to proceed,the District w+ll disburse 50 percent of the RCWD
Board approved cost-share amount to the City. On District receipt of the certification of
completion and review of such Pro�ecY documentation as it may require,the District will

disbu�se the remaining RCWD Board approved funds. Project documentation includes the
maintenance documents cited in paragraph I.B,above.
C. Contingencies. The DistricYs obligation to provide cost-share funds is contingent on the City's
complia�ce with the terms of this agreement,includi�g but not limited to Project completion in
accordance with the District-approved ptans and specifications by December 17,2017. The City
will retum to the District any cost-share funds already�eceived if this condition is not satisfied.
III. MISCELLANEOUS.
A. Re/ationship of Parties. Nothing in this agreement c�eates or establishes a partnership,joint
venture o�agency relationship between the parties. District review or approval of design plans
and specifications,a maintenance plan and any other Project-related documents is solely for the
DistricYs own accounting for funds expended. As between the parties,the City is solely
responsible for selection of the Project design and the means,method and manner of
construction. Nothing in this agreement creates any right in any third party or affects any
immunity,defense or liability limitation enjoyed by either party.
B. Employees. The City represents that it has or will secure,at its own expense,all personnel
and/or contractors required for the performance of this agreement. No City personnel or
contractor will be considered an agent,representative or employee of the District.
C. Liability. The City agrees to hold harmless and indemnify the District,and its managers,staff
and representatives,against any claim,expense or damage,including atto�ney fees,arising from
the performance of this agreement.
D. Assignment or Modi}�cation. This agreement binds and inures to the benefit of the Ciiy and the
Oistrict,and their respective successors and assigns. Neither party may assign this agreement
without the prior writt�n consent of the othe�. A�y modification of the agreement must be in
writing and signed by both parties.
E. Public Documents. All submitted information,including application,conceptual design,cost
estimates,bid tabulations,final designs and specifications,copies of permits and proof of
expenditures will become a part of the public record.
F. Effective Date. This agreement is effective as of the date all of the signatures below have been
provided.
