Res 2019-42 Ordering Preparation of Preliminary Plans University Ave Service RoadRESOLUTION NO. 2019 - 42 A RESOLUTION RECEIVING A PETITION AND ORDERING PREPARATION OF A PRELIMINARY REPORT FOR MONROE STREET BETWEEN 67TH AVENUE AND RICE CREEK TERRACE NE WHEREAS, the City of Fridley staff regularly monitors the condition of streets and maintains them in good condition, and WHEREAS, the City of Fridley staff has developed a long-range pavement management plan to rehabilitate select street segments by neighborhoods identified in the plan, and WHEREAS, the City of Fridley thereby maintains the condition of its streets in the most cost- efficient manner through this methodology, avoiding failing street conditions and reducing excessive maintenance costs, and WHEREAS, the City of Fridley funds these rehabilitation projects through its street reserve fund, with special assessments in accordance with its policies as one source of funding for said projects WHEREAS, the City of Fridley has not programmed the segment of Monroe Street from 67h Avenue to Rice Creek Terrace in its long-range pavement management plan which extends for the next ten years, and WHEREAS, the City of Fridley has received a petition in accordance with Minnesota Statutes Chapter 429 signed by more than 35% of the potentially benefitting property owners under the City's Special Assessment Policy requesting street resurfacing, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley as follows: 1. A certain petition requesting the improvement by street resurfacing of Monroe Street NE between 67'h Avenue NE and Rice Creek Terrace NE filed with the council August 22, 2019, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minn. Stat. § 429.035. 2. That the aforementioned petition for proposed improvement is hereby referred to the Public Works Director, James Kosluchar, PE, and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed or in connection with some other improvement; the estimated cost of the improvement as recommended; and a description of the methodology used to calculate individual assessments for affected parcels. 3. That said preliminary report of the Public Works Director shall be furnished to the City Council. PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 26th DAY OF AUGUST 2019. Scott J.
