Res 2019-56 SP 19-03 Statewide TowingRESOLUTION NO. 2019 - 56 A RESOLUTION APPROVING SPECIAL USE PERMIT, SP #19-03 TO ALLOW A TOWING BUSINESS FOR STATEWIDE TOWING INC. AND LDH INVESTMENT, THE PROPERTY OWNER OF 7645 BAKER STREET NE WHEREAS, Section 205.17.1.C.14 of Fridley City Code allows towing services in the M-1, Light Industrial zoning district by a special use permit if certain conditions can be met; and WHEREAS, on September 18, 2019 the Fridley Planning Commission held a public hearing to consider a request by Statewide Towing Inc., for the property located at 7645 Baker Street NE in Fridley, legally described in Exhibit B for a Special Use Permit SP 419-03 to allow towing services; and WHEREAS, on September 18, 2019, the Planning Commission unanimously recommended approval of Special Use Permit, SP 419-03; and WHEREAS, on October 14, 2019, the Fridley City Council approved the stipulations represented in Exhibit A to this resolution as the conditions on Special Use Permit SP 419-03; and WHEREAS, the petitioner, Statewide Towing Inc., was presented with Exhibit A, the stipulations, at the October 14, 2019 City Council meeting; and WHEREAS, Section 205.05.5.G of the Fridley City Code states that this special use permit will become null and void one year after the City Council approval date if work has not commenced or if the petitioner has not petitioned the City Council for an extension; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that the Special Use Permit SP 419-03 and stipulations represented in Exhibit A are hereby adopted by the City Council of the City of Fridley. The petitioner shall comply with all the conditions set forth within the M-1 zoning district code standards for a towing service business. 2. Per Section 205 of the Fridley City Code, this Special Use Permit will become null and void one year after the City Council approval date if work has not commenced or if the Petitioner has not petitioned the City Council for an extension.
