Res 2020-49 PH Not Assess ST2019-01RESOLUTION NO. 2020 - 49 RESOLUTION DECLARING COST TO BE ASSESSED, ORDERING PREPARATION OF THE PROPOSED ASSESSMENT ROLL AND DIRECTING PUBLICATION OF A PUBLIC HEARING NOTICE FOR STREET REHABILITATION PROJECT NO. ST–2019–01 WHEREAS, a contract has been let for Street Rehabilitation Project No. ST–2019-01 and the contract priced for such improvement is $762,412.61, and the expenses incurred or to be incurred in the making of such improvement amount to $35,485.30 so that the total cost of the improvement will be $797,897.91; and WHEREAS, by resolution passed by the City Council on September 14, 2020, the City Clerk, with the assistance of the City Engineer and City Treasurer, was directed to prepare a proposed assessment of the cost of Street Rehabilitation Project No. ST–2019-01; and WHEREAS, the City Clerk, with the assistance of the City Engineer and City Treasurer, has notified the City Council that such proposed assessment has been completed and filed by their office for public inspection. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FRIDLEY, MINNESOTA: 1. The portion of the cost of such improvement to be paid by the City is hereby estimated to be $707,680.75, and the portion of the cost to be assessed against benefited property owners is estimated to be $90,217.16 for a total cost of $797,897.91. 2. Assessments shall be payable in installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 2021 and shall bear interest at the rate of 5.25 percent per annum from the date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the City Engineer and City Treasurer, shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and they shall file a copy of such proposed assessment in their office for public inspection. BE IT FURTHER RESOLVED THAT THE CITY COUNCIL: 1. A hearing shall be held at 6:30 p.m. on October 12, 2020 in the City Hall located at 7071 University Avenue Northeast to pass upon such proposed assessment. All persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk, with the assistance of the City Engineer and City Treasurer, is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing and they shall state in the Resolution No. 2020 – 49 Page 2 notice the total cost of the improvement. They shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county, pay the whole or any part which is not less than one–half thereof, provided that such partial payment shall in any event be in a sum of at least one hundred dollars ($100.00) of the assessment on such property, with interest accrued to the date of payment, to the City of Fridley, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. Upon receipt of any such prepayment, the City Clerk, with the assistance of the City Treasurer, shall note the same upon the records of the City, credit the payee therefore, and reduce the assessment as originally made in the amount of the prepayment received. The balance remaining shall then be noted as the amount due and may then be certified to the county together with and as a part of the assessment roll in which the original amount due was contained. A property owner may at any time, thereafter, pay to the City of Fridley the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. Notices are being mailed to all property owners. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a signed, written objection is filed with the City Clerk prior to the hearing or is presented to the presiding officer at the hearing. The City Council may, upon such notice, consider any objection to the amount of a proposed individual assessment at an adjourned meeting, upon such further notice to the affected property owners, as it deems advisable. A property owner who has properly objected to the assessment may appeal an assessment to district court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or City Clerk. The City of Fridley has adopted Resolution No. 14-1995 deferring special assessment payments for senior citizens. The City Council may defer the payment of special assessments for any homestead property owned by a person 65 years of age or older, or for persons retired due to permanent and total disability for which it would be a hardship to make the payments.
