Res 2020-69 Spec. Assessment Deferral 340 Hugo RESOLUTION NO. 2020-69 RESOLUTION DEFERRING THE SPECIAL ASSESSMENT FOR STREET REHABILITATION PROJECT ST–2020–01 FOR THE PROPERTY LOCATED AT 340 HUGO STREET WHEREAS, pursuant to Minnesota Statute § 435.193, a home rule city making a special assessment may, at its discretion, defer the payment of that assessment for any homestead property; and WHEREAS, the City Council adopted a resolution establishing standards and guidelines for determining the existence of a hardship and for determining the existence of a disability (Resolution No. 2020–46); and WHEREAS, the City received an application to defer the duly adopted special assessment for Street Rehabilitation Project ST–2020–01 (Resolution No. 2020–62) from the owners of the property located at 340 Hugo Street; and WHEREAS, staff reviewed the application and determined that the property owners are eligible for a deferment; and WHEREAS, during the period of the deferment and until complete payment of the special assessment, interest will continue to accrue at the rate of 5.25 percent per annum from the date of the adoption of the special assessment; and WHEREAS, pursuant to Minnesota Statute § 435.165, the option to defer the payment of special assessment shall terminate and all amounts accumulated plus applicable interest, shall become due and payable. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fridley that the special assessment levied by the City Council on October 12, 2020 for Street Rehabilitation Project No. ST–2020–01 for the property located at 340 Hugh Street Northeast in the amount of $2,813.58 is hereby deferred; and BE IT FUTHER RESOLVED, that the City Clerk, with the assistance of the City Assessor, shall transmit a certified duplicate of this deferment to the County Auditor or any other party necessary to create, maintain and/or terminate this deferment.
